1. We have a follow-up question regarding a conflict in the answers to the questions. The Q&A states that we should put N/A in the areas where we don’t think we can provide onsite court reporting. However, it then goes on to say that vendors must be able to provide all services. Can you please clarify which is the case?

As stated on in section E.11 BASIS OF AWARD of solicitation 36C26023Q0442 “No offer will be accepted from a contractor that is not able to provide pricing and information regarding all items listed in the Price Cost Schedule (Attachment B). If services cannot be provided at a location listed on the Price Cost Schedule (Attachment B), then enter Not Available or N/A”.

Therefore, if an offeror cannot provide services for one or more of the locations listed in the Price Cost Schedule (Attachment B), the enter Not Available or N/A so it is clear which WSNC location(s) a prospective offeror cannot provide Court Reporter Services.

There is no statement in section E.11 BASIS OF AWARD in solicitation 36C26023Q0442 that states prospective offerors must be able to submit a quote for all locations listed in the Price Cost Schedule (Attachment B). Section E.11 BASIS OF AWARD does state that, “No offer will be accepted from a contractor that is not able to provide pricing and information regarding all items listed in the Price Cost Schedule (Attachment B).”

In section E.11 BASIS OF AWARD of solicitation 36C26023Q0442 it also states, “If multiple offers are not received for a location(s) or only a single quote for a location(s) is received, then pricing will be evaluated based on other pricing factors in accordance with FAR 13.106-3 (a).” Therefore, offerors can submit quoted pricing for one location, several locations, or all the locations listed in the Price Cost Schedule (Attachment B), and if there are specific locations where services cannot be provided, then enter Not Available or N/A.

2. Is it possible to submit a proposal for this RFP to only provide service in California and Nevada?

Interested firms can submit a quote for one location, several locations, or all the locations listed in the Price Cost Schedule (Attachment B). If there are locations that services cannot be provided, enter Not Applicable or N/A in the Price Cost Schedule (Attachment B) so that its clear which location(s) an offeror cannot provide Court Reporter Services.

3. In states where certified court reporters are not required to also be a notary to administer the oath, will they be required to be a notary under this contract?

As stated in the Performance Work Statement (PWS) in section 2. COURT REPORTER QUALIFICATIONS d.- Court Reporters must hold the certification as a National Court Reports Association (NCRA) Registered Professional Reporter (RPR), or equivalent (i.e., certified by the state of performance, other appropriate licensure, certification, or proof of education). Appropriate credentials must be provided within one week, upon request by a WSNC CO.

h. Court Reporters shall be competent to administer oaths. Depositions shall be transcribed by a duly authorized notary. No separate fee may be charged for notary services, administering oath, or affixing seal.

Therefore, depositions shall be transcribed by a duly authorized notary and the VA ordering facility, and each individual task order placed under this BPA may require certified court reporters for VA Federal Court proceedings that are a notary regardless of state laws.

4. In Section B.2 7 under Working Conditions sub-section H, do we need to list a cancellation rate on the price worksheet submitted, or will the rate be determined at the time of cancellation?

The Price Cost Schedule (Attachment B) has been amended to include CLIN 0065 for offerors to submit a quote for cancelation fees.

As stated in solicitation 36C26023Q0442 section E.11 BASIS OF AWARD- The total evaluated price will be the sum of all Contract Line-Item Numbers (CLINs) and Years 1 through 5 as listed in the Price Cost Schedule (Attachment B). Only locations that are quoted upon by multiple vendors will be evaluated competitively. If multiple offers are not received for a location(s) or only a single quote for a location(s) is received, then pricing will be evaluated based on other pricing factors in accordance with FAR 13.106-3 (a).

CLIN 0065 Appearance Cancellation Fee in the updated and attached Price Cost Schedule Amended, will be included in the total evaluated pricing of quotes, and offers as stated in section E.11 BASIS OF AWARD of solicitation 36C26023Q0442.

5. Is the 1x4 hour block the minimum appearance if the proceeding is shorter than 4 hours?

This solicitation is to establish a firm-fixed price contract. As noted in the Price Cost Schedule (Attachment B), pricing is for a 1x4 hour block, and will be a firm-fixed price for a 1x4 block window even if an in-person or virtual appearance for a VA court proceeding is shorter than 4 hours.

6. Are proceedings billed in the 4 hours blocks?

The proceedings will be billed in 4-hour blocks as priced in the Price Cost Schedule (Attachment B).

7. based on some of the requirements that seem to require specific types of national certifications that not all sates require or they have their own State requirements there are things we see in the PWS that would make if difficult to comply with the requirements as written.

As stated in the Performance Work Statement (PWS) in solicitation 36C26023Q0442:

d. Court Reporters must hold the certification as a National Court Reports Association (NCRA) Registered Professional Reporter (RPR), or equivalent (i.e., certified by the state of performance, other appropriate licensure, certification, or proof of education). Appropriate credentials must be provided within one week, upon request by a WSNC CO.

As stated in the E.11 BASIS OF AWARD in solicitation 36C26023Q0442 and section C. Responsibility Criteria: Documentation or proof of court reporting staff with credentials or certification of program training approved by the National Court Reports Association (NCRA), Registered Professional Reporter (RPR), or equivalent credentials from institutions such as those recognized by the U.S. Department of Education. Or the ability to obtain staff with such credentials or certifications.

Therefore, an offerors submission of state certifications, federal certifications, equivalent credentials, or other certifications will be evaluated by the government as “Acceptable” or “Not Acceptable” as outlined in section E.11 BASIS OF AWARD.

8. We wanted to see if the Government would be able to provide any possible extension to the due date on this opportunity?

Per Amendment 0003, the hour and date specified for receipt of Offers has been extended from 06/16/2023 15:00 PTD to 06/23/2023 15:00 PTD.

The deadline for submission of vendor questions has been extended from 06/10/2023 to 06/17/2023.
