B.3 STATEMENT OF WORK

The Jonathan M Wainwright Memorial VA Medical Center (VAWW), located at 77 Wainwright Drive, Walla Walla, WA, seeks a service contract for the annual performance of emergency generator testing as required by NFPA 110. There are currently eight diesel electric generators on the VAWW campus which have insufficient connected load and require annual testing with a supplemental load bank.

Table 2. Past Supplemental Testing (* approximate planned installation date) VAWW conducts monthly generator testing on the third Monday of every month. The contractor shall likewise perform generator testing on the third Monday of April, unless a different date within 20 days of the specified date is agreed upon in advance with the contracting officer’s representative (COR).

The contractor shall proactively maintain the generator testing schedule for compliance with NFPA 110 Chapter 8. Each generator shall be exercised annually for a minimum of 30 minutes at not less than 50% of the nameplate load for 30 continuous minutes and not less than 75% of the nameplate rating for 60 continuous minutes for a total test duration of not less than 90 continuous minutes. Once every 36 months from the dates listed above in the Previous Triennial Test Date column, the contractor shall perform an extended annual load bank test, with supplemental load bank provided to achieve 30% of the nameplate load for 180 continuous minutes and 75% of the nameplate load for an additional 60 minutes, for a total test duration of not less than 240 minutes (four hours). The contractor shall provide a full test report to the COR within 7 calendar days of any test performed. The contractor shall proactively contact the COR 30 days prior to test due dates and confirm the intended schedule. While on site to perform generator testing, the contractor shall perform all NFPA 110 required weekly inspections of the diesel generators and appurtenant components. An inspection report with any applicable recommendations for repair or adjustment shall be submitted with the test report. Incomplete or missing test reports will serve as a basis for withholding payment under the contract until such time as the full report is supplied.

SECURITY REQUIREMENTS. The Contractor employees shall not have access to VA sensitive or computer information and will not require routine access to VA Facilities. The Contractor employees shall require intermittent access only.

No background investigation is required.

Escorting of Employees. All contract employees, including subcontractor employees who are not in possession of the appropriate security clearance or access privileges, will be escorted in areas where they may be exposed to classified and/or sensitive materials and/or sensitive or restricted areas.

Pre-screen of Employees. The Contractor must pre-screen Candidates using the E-verify Program (http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible Candidates must be provided to the COR no later than 3 calendar days after the initial contract award.

MANDATORY ELECTRONIC INVOICING: VA published the final rule requiring vendors to submit invoices electronically to the Financial Services Center (FSC) in the November 27, 2012 Federal Register. The rule became effective December 27, 2012. The rule includes a new contract clause to be inserted in all solicitations and contracts by the contracting officer (VAAR 852.232-72). Vendors can comply with the rule by using either of the two methods below:

1. The FSC uses a third-party contractor, Tungsten Network, to transition vendors from paper to electronic invoice submission. For information on Tungsten Network electronic invoicing set-up, vendors should call 1-877-489-6135, or email VA.Registration@Tungsten-Network.com.

Vendors are required to register with Tungsten Network and submit invoices electronically as a condition of acceptance of this contract or order.

FSC and VA’s Office of Acquisition, Logistics and Construction (OALC) will assist existing commercial vendors in migrating to the electronic process. Until the transition to electronic format is complete, FSC will continue to process paper invoices for commercial vendors.

C.2 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days.

C.3 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed five (5) years.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
