Revision 02 Eff Date: 02/21/2020
The purpose of this procurement is to contract qualified, licensed Locum Medical Technicians to perform duties at the Portland, Roseburg, and White City VA Health Care Systems as outlined in the Performance Work Statement. The Medical Technicians consist of Phlebotomists, Medical Technologists, Histotechnologists, and Cytotechnologists that are critical in the support of the VA Medical Center Laboratories. The Portland VA currently has 5 contract Phlebotomists, 2 contract Histotechnologists, 1 contract Cytotechnologist, and 2 contract Medical Technologists working under the incumbent contract, which expires 03/31/2020. Portland also has an urgent need to procure 2 additional Phlebotomists and 1 additional Cytotechnologist. The Roseburg VA currently has 2 contract Medical Technologists and 1 contract Phlebotomist working under the same incumbent contract. White City VA currently has 2 contract Phlebotomists working under the same incumbent contract. These Locums need to be available to fill the gaps when full-time VA employees schedule leave, training, or other absences. This request is for a 6-month contract to begin no later than 04/01/2020, with clause FAR 52.217-8 Option to Extend Services, for an additional 6 months, included if needed.
(4) Identify the Authority and Supporting Rationale (see below and if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.
FAR 8.405-6(a)(1)(A): An urgent and compelling need exists and following the ordering procedures would result in unacceptable delays:
FAR 8.405-6(a)(1)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized;
The process for onboarding contract staff averages a minimum of 12 weeks. This consists of resume reviews, onboarding paperwork completion, fingerprinting, PIV Card issuance, and background investigation completion. Competing this requirement and ultimately awarding the contract to a new vendor any less than 12 weeks prior to the current contract expiration date of 03/31/2020 will result in a significant gap in coverage that the Portland, Roseburg, and White City VA Health Care Systems will not be able to sustain with current VA medical staff. Health Care Connections, Inc. currently has these contract staff with completed background investigations and active PIV cards available and ready to continue working under the new contract, effective 04/01/2020. Due to the length of time it takes to onboard new contract staff, it is determined that, in accordance with FAR 8.405-6(a)(1)(B), the incumbent contractor, Health Care Connections, Inc. is the only source capable of providing these services to the requesting VA Medical Centers without a significant gap in coverage, adversely affecting veteran care.
FAR 8.405-6(a)(1)(C): In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The
VHAPM Part 808.405-6 Limiting Sources Page 3 of 5
Revision 02 Eff Date: 02/21/2020 original order must not have been previously issued under sole source or limited source procedures.
FAR 8.405-6(b): Items peculiar to one manufacturer:
A patent, copyright or proprietary data limits competition. The proprietary data is:
These are “direct replacements” parts/components for existing equipment.
The material/service must be compatible in all aspects (form, fit and function) with existing systems presently installed/performing.
(5) Describe Why You Believe the Order Represents the Best Value consistent with FAR 8.404(d) to aid the contracting officer in making this best value determination:
This order will be made against the Contractor’s FSS Schedule Contract, V797D-30106, where hourly rates have already been determined to be fair and reasonable. Quoted hourly rates will be evaluated against the FSS Schedule Contract, the current expiring contract, and the IGCE.
Quoted per diem rates will be evaluated against GSA’s FY20 Per Diem Rates for Portland, Roseburg, and White City, OR. Awarding a task order to HealthCare Connections, Inc. against their current FSS Contract, with qualified, cleared contract staff available for continuity of care represents the best value in accordance with FAR 8.404(d).
(6) Describe the Market Research Conducted among schedule holders and the results or a statement of the reason market research was not conducted.
In accordance with VAAR 810.70 and The Veterans First Contracting Program, market research was conducted to determine if any VOSBs or SDVOSBs active in the Vendor Information Pages held FSS Contracts and could meet the needs of this urgent requirement. A search in VIP determined that there were 79 VOSB and SDVOSB under NAICS 561320 with FSS contracts. A list of these vendors is attached. These VOSBs and SDVOSBs, however, do not currently have Medical Technicians with completed OPM background investigations and active PIV cards for the respective Portland, Roseburg, and White City VA Medical Centers, and are available to work effective 04/01/2020 with no lapse in continuity of care. This 6-month bridge contract will be awarded to maintain care at the Medical Centers in order to allow for time to solicit and award a long-term, competed Medical Technician contract.
(7) Any Other Facts Supporting the Justification:
This Sole Source Justification is consolidated to support the 3 VA Health Care Systems currently serviced by HealthCare Connections, Inc. The 3 procurement requests will be combined into one bridge contract. All 3 requesting offices have submitted separate Sole Source Justifications, which are uploaded in the eCMS AP briefcase. Reference “P03 Sole Source Justification – 653 Roseburg, dated 02-07-2020 02:50PM”, “P03 Sole Source Justification – 648 Portland, dated 03-

(8) A Statement of the Actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made:
Network Contracting Office 20 is currently working to establish a long-term contract that will be competed amongst schedule holders, allowing time for the winning Contractor and the using services to onboard the new Locum Medical Technicians.
(9) Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge. I understand that processing of this limited sources justification restricts consideration of Federal Supply Schedule contractors to fewer than the number required by FAR Subpart 8.4.
