B.3 STATEMENT OF WORK

1. Contract Title: Regulated Medical Waste Services

2. General Information: This is a non-personal services contract to provide Regulated Medical Waste Services for the Alaska Veteran Affairs Healthcare System. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor, who in return is responsible to the Government.

3. Description of Services: The Contractor shall furnish all labor, materials, and transportation to pick up and dispose of Regulated Medical Waste (RMW) for the Alaska Veteran Affairs Healthcare System.

RMW consists of liquid or semi-liquid blood or other potentially infectious materials; contaminated items that would release blood or other potentially infectious materials in a liquid or semi-liquid state if compressed; items that are caked with dried blood or other potentially infectious materials and are capable of releasing these materials during handling; contaminated sharps; and pathological waste and microbiological wastes containing blood or other potentially infectious materials generated during surgeries or medical procedures performed by the Alaska VA Healthcare System.

The Contractor shall comply with all applicable federal, state, and local laws and regulations, which includes, but not limited to, the Federal Environmental Protection Agency; U.S. Department of Transportation (DOT) Class 6, Division 2 Hazardous Material classified as UN 3291, Regulated Medical Waste not otherwise classified as defined in 49 CFR 173.134; Alaska Department of Environmental Conservation (ADEC) and all other applicable local regulations including the Municipality of Anchorage Medical Waste Disposal Policy and other laws, regulations and policies in the State of Alaska concerning the handling and disposal of medical wastes.

4. Background Information: The Alaska Veteran Affairs Healthcare System requires Contractor personnel to provide Regulated Medical Waste Services and does not have the personnel and applicable licenses to perform these services.

5. Place of Performance/Pickup Locations:

- Alaska VA Healthcare System main clinic loading dock located at 1201 North Muldoon Road, Anchorage, AK 99504. Pickup estimate for RMW is 200 pounds biweekly – every other week.

- Alaska VA Domiciliary, 3001 C Street, Anchorage, AK 99503. Pickup estimate for RMW is 25 pounds every two months (mid-month of Jan, Mar, May, July, Sept, and Nov).

- Juneau VA Outreach Clinic, 709 West 9th Street, Suite 150, Juneau, AK 99801. May be shipped from this location if necessary. Pickup estimate for RMW is 25 pounds per shipment every two months.

- Kenai VA Community Based Outpatient Clinic, 11312 Kenai Spur Highway, Suite 39 Kenai, AK 99611. Pickup estimate for RMW is 75 pounds every two months (mid-month of Jan, Mar, May, July, September, and Nov).

- Mat-Su VA Community Based Outpatient Clinic, 865 North Seward Meridian Parkway, Suite 105, Wasilla, AK 99654. Pickup estimate for RMW is 75 pounds every two months (mid-month of Jan, Mar, May, July, Sept, and Nov)

6. Specific Tasks:

6.1 The Contractor shall provide appropriately sized containers for RMW that are rigid, leak resistant, impervious to moisture, sealed to prevent leakage during transport, puncture resistant, and labeled with visual biohazard warning and the DOT shipping identification number UN 3291. The Contractor shall pick up RMW and replace the containers with disinfected containers. The Contractor shall ensure that the transport vehicle for RMW has a fully enclosed, leak-proof, cargo-carrying body that protects the waste from animals, vectors, and weather conditions. The transport vehicle cargo must be kept locked while RMW is in transport.

6.2 The Contractor shall ensure all containers of RMW are properly treated and disposed per all Federal, State, and Municipal codes or laws.

The Contractor shall maintain throughout this contract all permits, and business license required to accept, transport, handle, process and disposal of RMW and make such information available at the beginning of the contract prior to the contractor performing work under the contract to the Facility Management Service POC and upon request from the Facility Management Service POC.

6.4 The Contractor shall maintain the following category of information per Federal and State regulations: RMW Transporter information, RMW disposal facility, DOT shipping description, and manifest tracking number.

6.5 The Contractor shall provide receipt of total weight of RMW, with and without container, after pickup has been accomplished and shall ensure a copy of the manifest accompanies the transporter until the medical waste is properly disposed of. The Contractor shall return an electronic copy of the manifest to Facility Management Service POC within 14 days of pickup and provide monthly certification of destruction for each pickup location to Facility Management Service POC.

8. Qualifications:

8.1 The Contractor shall provide supporting documentation to the Facility Management Service POC at the beginning of the contract prior to the contractor performing work under the contract, that all employees are trained, certified, kept current as necessary to collect, transport and properly dispose of RMW, to show evidence of their capacity to completing the requirements of this contract.

8.2 The Contractor shall be required to comply with all VA Security requirements. The Contractor shall coordinate with the COR and providing all information required of employees for performance of work. All security requirements must be met and employees must be cleared prior to the contractor performing work under the contract. Employees that cannot meet the security and clearance requirements shall not be allowed to perform work under this contract.

9. Security Requirements:

9.1 The contractor employees shall not have access to VA sensitive or computer information and will not require routine access to VA Facilities. The contractor employees shall require intermittent access only and will be escorted by VA employees while at VA Facilities. No background investigation is required.

9.2 Some RMW may contain Personally-Identifiable Information (PII). The Contractor shall safeguard this information in accordance with the Privacy Act of 1974, 5 U.S.C. § 552a (Public Law 93-579). Employees must be trained in the key elements of the Privacy Act of 1974 including, at a minimum, the following:

- The provisions of the Privacy Act of 1974 (5 U.S.C. 552a) including penalties for violations of this act;

- The appropriate handling and safeguarding of personally identifiable information;

- The restriction on the use of unauthorized equipment to create, collect, use, store, maintain disclose, dispose, or otherwise access personally identifiable information;

- The prohibition against the unauthorized use or unauthorized disclosure, access, handling, or use of personally identifiable information; and

- Procedures to be followed in the event of a suspected or confirmed breach of information or unauthorized disclosure, access, handling, or use of personally identifiable information.

- The training must include measures to test the knowledge level of user.

10. Hours of Operation: Pickup times for all locations as listed above in section five (5) operating hours are Monday – Friday 8:00am – 4:00pm, except for the following holidays:

11. Invoicing: A copy of all invoices will be sent to the Alaska VA Healthcare System for verification/certification. The Contractor shall then send the official invoice electronically per electronic invoicing procedure:

An itemized invoice shall accompany each service order from the Contractor. This invoice must show item number, description, quantity, unit, unit price, and totals for each design (advanced and basic) used.

All invoices shall include contract number, purchase/delivery order number and detail of services provided. The itemized invoices submitted for payment through On-Line Certification System (OLCS) shall include the contract number, purchase/delivery order number and detail of services provided. All invoices will be submitted in accordance with these instructions.

VA uses a third-party invoicing provider named Tungsten to provide us with electronic invoices. Please register with Tungsten so you can submit your invoice electronically to us for processing as it is a federal mandate. Contractor will need to go to the Tungsten website http://www.tungsten-network.com/uk/en/ for the registration process. Please provide to Tungsten the VA’s Tungsten Buyer Number AAA544240062.

Invoices will be electronically submitted to the Tungsten website at http://www.tungsten-network.com/uk/en/ Tungsten direct vendor support number is 877-489-6135 for VA contracts.

The VA-FSC pays all associated transaction fees for VA orders. During Implementation (technical set-up) Tungsten will confirm your Tax Payer ID Number with the VA-FSC. This process can take up to 5 business days to complete to ensure your invoice is automatically routed to your Certifying Official for approval and payment. In order to successfully submit an invoice to VA-FSC please review “How to Create an Invoice” within the how to guides. All invoices submitted through Tungsten to the VA-FSC should mirror your current submission of Invoice, with the following items required. 12. Option to Extend Services: In accordance with FAR Clause 52.217-8, Option to Extend Services, the contract may be extended, at the Government’s sole discretion, for a period of up to six (6) months, exercisable in increments of not less than one (1) month.

The prices applicable during the short-term extension(s) shall be the price(s) applicable during the immediately succeeding option period if there is one (for example, CLIN 1001 subject only to any adjustment required by the Service Contract Act). If there is no immediately succeeding option period, the price(s) shall be the price(s) applicable during the immediately preceding contract period, subject only to any adjustment required by the Service Contract Act.

The extension(s) may be exercised by the Government IAW FAR Clause 52.217-8, provided that the CO has given notice of the Government’s intent to exercise the extension at least 7 calendar days before this contract is to expire. A notice will be provided for each separate extension.

For requirements items, the prices applicable during the short-term extension(s) shall be the prices applicable during the immediately succeeding option period, if there is one. If there is no succeeding option period, the prices shall be the prices applicable during the immediately preceding contract period.

The cost ceiling(s), base fee(s), and award fee(s) during the short-term option(s) shall be the pro rata portion of the costs and fees applicable to the immediately succeeding option period, if there is one. If there is no succeeding option period, the cost ceiling(s) and fee(s) shall be the pro rata portion of the costs and fees for the immediately preceding contract period.

C.3 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days of the contract expiration date.

C.4 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days of the contract expiration date; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed five (5) years.

C.5 52.223-5 POLLUTION PREVENTION AND RIGHT-TO-KNOW INFORMATION (MAY 2011)

(a) Definitions. As used in this clause— "Toxic chemical" means a chemical or chemical category listed in 40 CFR 372.65.

(b) Federal facilities are required to comply with the provisions of the Emergency Planning and Community Right-to-Know Act of 1986 (EPCRA) (42 U.S.C. 11001-11050), and the Pollution Prevention Act of 1990 (PPA) (42 U.S.C. 13101-13109).

(c) The Contractor shall provide all information needed by the Federal facility to comply with the following:

(1) The emergency planning reporting requirements of Section 302 of EPCRA.

(2) The emergency notice requirements of Section 304 of EPCRA.

(3) The list of Material Safety Data Sheets, required by Section 311 of EPCRA.

(4) The emergency and hazardous chemical inventory forms of Section 312 of EPCRA.

(5) The toxic chemical release inventory of Section 313 of EPCRA, which includes the reduction and recycling information required by Section 6607 of PPA.

(6) The toxic chemical and hazardous substance release and use reduction goals of section 2(e) of Executive Order 13423 and of Executive Order 13514.

C.6 VAAR 852.232-72 ELECTRONIC SUBMISSION OF PAYMENT REQUESTS (NOV 2018)

(a) Definitions. As used in this clause—

(1) Contract financing payment has the meaning given in FAR 32.001;

(2) Designated agency office means the office designated by the purchase order, agreement, or contract to first receive and review invoices. This office can be contractually designated as the receiving entity. This office may be different from the office issuing the payment;

(3) Electronic form means an automated system transmitting information electronically according to the accepted electronic data transmission methods and formats identified in paragraph (c) of this clause. Facsimile, email, and scanned documents are not acceptable electronic forms for submission of payment requests;

(4) Invoice payment has the meaning given in FAR 32.001; and

(5) Payment request means any request for contract financing payment or invoice payment submitted by the contractor under this contract.

(b) Electronic payment requests. Except as provided in paragraph (e) of this clause, the contractor shall submit payment requests in electronic form. Purchases paid with a Government-wide commercial purchase card are considered to be an electronic transaction for purposes of this rule, and therefore no additional electronic invoice submission is required.

(c) Data transmission. A contractor must ensure that the data transmission method and format are through one of the following:

(1) VA’s Electronic Invoice Presentment and Payment System at the current website address provided in the contract.

(2) Any system that conforms to the X12 electronic data interchange (EDI) formats established by the Accredited Standards Center (ASC) and chartered by the American National Standards Institute (ANSI).

(d) Invoice requirements. Invoices shall comply with FAR 32.905.

(e) Exceptions. If, based on one of the circumstances in this paragraph (e), the Contracting Officer directs that payment requests be made by mail, the Contractor shall submit payment requests by mail through the United States Postal Service to the designated agency office. Submission of payment requests by mail may be required for—

(1) Awards made to foreign vendors for work performed outside the United States;

(2) Classified contracts or purchases when electronic submission and processing of payment requests could compromise the safeguarding of classified or privacy information;

(3) Contracts awarded by contracting officers in the conduct of emergency operations, such as responses to national emergencies;

(4) Solicitations or contracts in which the designated agency office is a VA entity other than the VA Financial Services Center in Austin, Texas; or

(5) Solicitations or contracts in which the VA designated agency office does not have electronic invoicing capability as described above.

C.7 VAAR 852.237-70 CONTRACTOR RESPONSIBILITIES (APR 1984)

The contractor shall obtain all necessary licenses and/or permits required to perform this work. He/she shall take all reasonable precautions necessary to protect persons and property from injury or damage during the performance of this contract. He/she shall be responsible for any injury to himself/herself, his/her employees, as well as for any damage to personal or public property that occurs during the performance of this contract that is caused by his/her employees’ fault or negligence and shall maintain personal liability and property damage insurance having coverage for a limit as required by the laws of the State of Alaska. Further, it is agreed that any negligence of the Government, its officers, agents, servants and employees, shall not be the responsibility of the contractor hereunder with the regard to any claims, loss, damage, injury, and liability resulting there from.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
