About this file

This is a solicitation (RFQ) for hazardous waste disposal services issued by the Department of Veterans Affairs for the Western Colorado Health Care System in Grand Junction, Colorado. The solicitation 36C25925Q0659 is set aside 100% for Service-Disabled Veteran-Owned Small Businesses (SDVOSB) under NAICS code 562112 with a $47 million size standard.

The contract requires comprehensive hazardous waste management services including collection, packaging, transportation, disposal, training, and documentation for various waste streams including hazardous pharmaceuticals, universal waste (batteries, lamps, mercury equipment), characteristic wastes (flammable, corrosive, reactive, toxic), and non-hazardous materials. Services will be performed at the Grand Junction VA Medical Center and an off-site warehouse facility. The contract structure includes a one-year base period (September 1, 2025 - August 31, 2026) with four one-year options, featuring quarterly services for ongoing waste management and a one-time disposal service for expired materials. Questions are due August 14, 2025 at 12:00 PM MST, with quotes due August 20, 2025 at 5:00 PM MST to heather.chase2@va.gov. The procurement uses a lowest price technically acceptable evaluation approach with special responsibility standards requiring specialized licensing for contractors, facilities, and subcontractors, plus demonstrated experience in hospital/university hazardous waste management. Contractors must maintain all federal, state, and local permits, provide trained personnel, and ensure compliant disposal methods prioritizing recycling, fuel blending, and proper treatment over landfill disposal.

B.2 STATEMENT OF WORK

Western Colorado Health Care System (WCHCS) Waste Disposal Service Statement of Work (SOW)

1.0 Purpose:

1.1 The Western Colorado Health Care System medical center, located at 2121 North Avenue in Grand Junction, Colorado has a requirement to properly dispose of hazardous and universal waste, per the requirements of the United States Environmental Protection Agency (EPA).

2.0 Objectives

2.1 To provide all waste collection, packaging materials, packaging of waste, transportation of waste, disposal of waste, training of on-station personnel, and the creation and submittal of all required documentation for the disposal of hazardous, non-hazardous, and universal waste that meet the minimum requirements of The EPA’s Resource and Conservation Act (RCRA) waste definitions, State, County, and City laws, ordinances, and regulations and section 5.0 Mandatory Tasks and Deliverables.

3.0 Scope

3.1 The Contractor shall provide all labor, materials, tools, equipment, analysis, travel, training, transportation, documentation, waste treatment, disposal and support services required to categorize, package, transport, document and dispose of hazardous, non-hazardous, neutralized DEA controlled substances and universal wastes.

3.2 The Contractor, and Subcontractor if applicable, shall provide and maintain all licenses and permits to conduct waste removal to final disposal.

3.3 The Contractor shall be required to provide initial hazardous waste orientation training to the WCHCS personnel, based on the Contractor’s processes. The Contractor shall possess the necessary technical expertise and resources required by this solicitation to be considered for contract award.

3.4 The Contractor shall provide cleanup and disposal materials and support for spills/releases of hazardous wastes, and universal wastes that happen on station. Not to include any remediation waste.

3.5 The Contracting Officer (CO) will designate a Contractors Officers Representative (COR) to act for him/her in furnishing technical guidance and advice to generally monitor the work to be performed under this contract. Such designation will be in writing and will define the scope and limitation of the COR’s authority. A copy of the designation shall be furnished to the Contractor.

3.6 The COR for each facility’s healthcare system will arrange for routine (non-emergency) waste pickup based upon rate of generation. However, out-of-cycle pickups may be required for episodic events.

3.7 The Government reserves the right to award one or more contracts resulting from this solicitation. Services will be provided during the five-year period.

3.8 Work shall be performed during normal business hours of 7:30 AM and 4:30 PM local time, Monday through Friday, excluding Federal Holidays. The facility COR or Point of Contact (POC) shall be available during normal business hours for the approval of manifests and other required documentation, unless unusual circumstances require services during an unscheduled time period.

3.9 The Government reserves the right to change generator size at any facility for the duration of this contract.

4.0 Definitions

4.1 Very Small Quantity Generator (VSQG)– generates less than 100kg of non-acute hazardous waste in a month and less than 1 kg of acutely hazardous waste (P-listed) in a month. There are no storage timetables or on-site amount restrictions to VSQGs. Pharmaceutical rules of 40 CFR part 266 Subpart P, (Subpart P) are optional.

4.2 Small Quantity Generator (SQG) – generates more than 100kg but less than 1000kg of non-acute hazardous waste and less than 1 kg of acutely hazardous waste (P-listed) in a month. SQG’s can only store 1 kg of acute hazardous waste on site at any given time but can store up to 6000kg overall of hazardous waste at one time. May store both types of hazardous waste for 180 days (or 270 if waste travels over 200miles). Pharmaceutical rules of Subpart P are mandatory.

4.3 Large Quantity Generator (LQG) – generates more than 1000kg of non-acute hazardous waste and/or over 1kg of acute hazardous (P-listed) waste a month. All waste must be removed within 90 days of moving to the central accumulation area. Pharmaceutical rules of Subpart P are mandatory.

4.4 Characteristic Hazardous Waste –

4.4.1 Ignitable - Wastes that are hazardous due to the ignitability characteristic include liquids with flash points below 60 °C, non-liquids that cause fire through specific conditions, ignitable compressed gases, and oxidizers.

4.4.2 Oxidizer is a characteristic of ignitable. It is a substance such as a chlorate, permanganate, inorganic peroxide, or a nitrate, that yields oxygen readily to stimulate the combustion of organic matter.

4.4.3 Corrosive - Wastes that are hazardous due to the corrosivity characteristic include aqueous wastes with a pH of less than or equal to 2, a pH greater than or equal to 12.5 or based on the liquids ability to corrode steel.

4.4.4 Reactive - Wastes that are hazardous due to the reactivity characteristic may be unstable under normal conditions, may react with water, may give off toxic gases and may be capable of detonation or explosion under normal conditions or when heated.

4.4.5 Aerosols can be a characteristic of reactivity if it is capable of detonation or explosive reaction when subjected to a strong initiating source or if heated under confinement.

4.4.6 Toxic - Wastes that are hazardous due to the toxicity characteristic are harmful when ingested or absorbed. Toxic wastes present a concern as they may be able to leach from waste and pollute groundwater.

4.5 Listed Hazardous waste - A waste is determined to be a hazardous waste if it is specifically listed on one of four lists (the F, K, P and U lists) found in title 40 of the Code of Federal Regulations (CFR) in Part 261 and meets either the process based or sole active ingredient requirements.

4.5.1 Subpart P removes these listed characteristics for pharmaceuticals. Locations may still have unused commercial U-listed chemicals outside of pharmaceuticals; acetone, methanol, phenol, xylenes. There will be no P-listed waste outside of Subpart P.

4.5.2 The VA does not have any K-listed. There are processed based F-listed wastes that may include spent non-halogenated solvents.

4.6 Hazardous Pharmaceuticals – Pharmaceuticals under Subpart P that are characteristic or listed and are not eligible for reverse distribution, are over the counter, prescription, or supplements.

4.7 Non-hazardous Pharmaceuticals- pharmaceuticals that are not characteristic or listed as described above.

4.7.1 Bulk Chemo – classified under the National Institute of Occupational Safety and Health (NIOSH) Table 1 as a hazardous drug or antineoplastic but is not a RCRA hazardous waste pharmaceuticals.

4.7.2 DEA Controlled Substances - A “hazardous waste controlled substance” is a waste pharmaceutical that is both a RCRA hazardous waste and a DEA controlled substance. Under Subpart P, EPA has exempted hazardous waste pharmaceuticals that are also DEA controlled substances as hazardous waste if they are sent for combustion. Substances under this contract will be pre-wasted into neutralizing media.

4.8 Universal Waste is a subsection of hazardous waste and includes:

4.8.1 Batteries. Means a device consisting of one or more electrically connected electrochemical cells which is designed to receive, store, and deliver electric energy. An electrochemical cell is a system consisting of an anode, cathode, and an electrolyte, plus such connections (electrical and mechanical) as may be needed to allow the cell to deliver or receive electrical energy. The term battery also includes an intact, unbroken battery from which the electrolyte has been removed.

4.8.2 Lamps. Is defined as the bulb or tube portion of an electric lighting device. A lamp is specifically designed to produce radiant energy, most often in the ultraviolet, visible, and infra-red regions of the electromagnetic spectrum. Examples of common universal waste electric lamps include, but are not limited to, fluorescent, high intensity discharge, neon, mercury vapor, high pressure sodium, and metal halide lamps.

4.8.3 Mercury Containing Equipment. Means a device or part of a device (including thermostats but excluding batteries and lamps) that contains elemental mercury integral to its function.

4.8.4 Pesticides. Means any substance or mixture of substances intended for preventing, destroying, repelling, or mitigating any pest, or intended for use as a plant regulator, defoliant, or desiccant, other than any article that is listed in 40 CFR 273.9 “Pesticide”

4.8.5 Aerosol Can. Means a non-refillable receptacle containing a gas compressed, liquefied, or dissolved under pressure, the sole purpose of which is to expel a liquid, paste, or powder and fitted with a self-closing release device allowing the contents to be ejected by the gas. Currently only Colorado and Utah have this rule but anticipate all states adopting in course of contract.

4.9 Dual – specific to this contract, this indicates a hazardous waste that is also a regulated medical waste due to blood or other potentially infectious material (OPIM). Typically, clinical lab generated diagnostic tests with hazardous reagents and blood.

4.10 Non-hazardous waste – items that do not meet the characteristic or listed waste definitions but may also do not meet drain disposal or landfill requirements. This may include non-hazardous pharmaceuticals.

4.11 Asbestos. Asbestos is a mineral fiber that occurs in rock and soil that is not classified as a hazardous waste. Because of its fiber strength and heat resistance asbestos has been used in a variety of building construction materials for insulation and as a fire retardant. Asbestos has also been used in a wide range of manufactured goods, mostly in building materials (roofing shingles, ceiling and floor tiles, paper products, and asbestos cement products), and services will be small scale in-house abatement debris.

4.12 Affirmative Procurement. Refers to products or services as having a lesser or reduced effect on human health and the environment when compared with competing products or services that serve the same purpose. This comparison may consider raw materials acquisition, production, manufacturing, packaging, distribution, reuse, operation, maintenance or disposal of the product or service.
