(a) Definitions. As used in this clause— Commercially available off-the-shelf (COTS) item— (1) Means any item of supply (including construction material) that is—
(i) A commercial product (as defined in paragraph (1) of the definition of ‘‘commercial product’’ at Federal Acquisition Regulation (FAR) 2.101.
(ii) Sold in substantial quantities in the commercial marketplace; and
(iii) Offered to the Government, under a contract or subcontract at any tier, without modification, in the same form in which it is sold in the commercial marketplace; and

Component means an article, material, or supply incorporated directly into an end product.
Cost of components means—
(1) For components purchased by the Contractor, the acquisition cost, including transportation costs to the place of incorporation into the end product (whether such costs are paid to a domestic firm), and any applicable duty (whether or not a duty-free entry certificate is issued); or
(2) For components manufactured by the Contractor, all costs associated with the manufacture of the component, including transportation costs as described in paragraph (1) of this definition, plus allocable overhead costs, but excluding profit. The cost of components does not include any costs associated with the manufacture of the end product.
Critical component means a component that is mined, produced, or manufactured in the United States and deemed critical to the U.S. supply chain. The list of critical components is at FAR 25.105.
Domestic end product means—
(1) For an end product that does not consist wholly or predominantly of iron or steel or a combination of both—

(ii) An end product manufactured in the United States, if—
(A) The cost of its components mined, produced, or manufactured in the United States exceeds 60 percent of the cost of all its components. Components of foreign origin of the same class or kind as those that the agency determines are not mined, produced, or manufactured in sufficient and reasonably available commercial quantities of a satisfactory quality are treated as domestic. Components of unknown origin are treated as foreign. Scrap generated, collected, and prepared for processing in the United States is considered domestic; or
(B) The end product is a COTS item; or
(2) For an end product that consists wholly or predominantly of iron or steel or a combination of both, an end product manufactured in the United States, if the cost of foreign iron and steel constitutes less than 5 percent of the cost of all the components used in the end product. Iron or steel components of unknown origin are treated as foreign. Produced in the United States means that all manufacturing processes of the iron or steel must take place in the United States, from the initial melting stage through the application of coatings, except metallurgical processes involving refinement of steel additives. The origin of the elements of the iron or steel is not relevant to the determination of whether it is domestic or foreign.
Predominantly of iron or steel or a combination of both means that the cost of the iron and steel content exceeds 50 percent of the total cost of all its components. The cost of iron and steel is the cost of the iron or steel mill products (such as bar, billet, slab, wire, plate, or sheet), castings, or forgings utilized in the manufacture of the product and a good faith estimate of the cost of iron or steel components excluding COTS fasteners.
Steel means an alloy that includes at least 50 percent iron, between 0.02 and 2 percent carbon, and may include other elements.

(c) Offerors may obtain from the Contracting Officer a list of foreign articles that the Contracting Officer will treat as domestic for this contract.
(d) The Contractor shall deliver only domestic end products except to the extent that it specified delivery of foreign end products in the provision of the solicitation entitled "Buy American Certificate."

The National Disabled Veterans Winter Sports Clinic (NDVWSC) is seeking procurement of three (3) Enabling Technologies adaptive sit-skis and eight (8) updated adaptive seating systems in accordance with industry standards for utilization for disabled Veterans at the NDVWSC. The NDVWSC provides adaptive rehabilitative outdoor recreation opportunities for Veterans with various qualifying disabilities to include but not limited to traumatic brain injuries (TBI), amputations, paralysis, and neurological disorders. Amongst a multitude of adaptive equipment utilized by disabled Veterans throughout the NDVWSC, a sit-ski, and the associated seating systems provide a modified approach to skiing which allows for maneuverability on snow in a seated position, allowing full participation while implementing skiing techniques consistent with traditional methods of skiing. Enabling Technologies manufactures the most advanced and technologically apt adaptive sit-skis on the market using advanced seating systems, user friendly adjustments, and advanced shock systems. The makeup of Enabling Technologies sit-skis are highly revered as cutting edge within the industry. The advancement of seating systems allows for a wide variety of ability levels and adaptive needs while being appropriate for usage by beginner sit-skiers and more advanced participants. Enabling Technologies is the only entity to offer a Tension Load System lift mechanism which allows for participants with limited strength/dexterity to effectively participate at their full ability of independence. Moreover, in comparison to other lift mechanisms on the market, the Enabling Technologies Tensions Load System requires limited/no engagement of core muscle groups to initiate, making this lift mechanism ideal for a wide range of physical disabilities consistent with spinal cord injuries (SCI), TBI, neurological disorders or injuries at or near core areas. This particular type of lift mechanism is only available on Enabling Technologies and allows participants to use the mechanism to easily lift and lower the seating system over the shock when entering and exiting a ski lift. The procurement of additional seating systems that are designed and manufactured by Enabling Technologies and are specific to Enabling Technologies sit-ski frames. The procurement of updated High Back clamshell seating systems are to replace aged-out plastic molded seating systems, with a robust composite seating system consistent with industry standard recommendations for the safety and usability for disabled participants. The procurement of High Back Clamshell seating systems is intended to replace no-longer relevant seating systems in the NDVWSC ski inventory. The High Back clamshell seats are only produced by Enabling technologies and are manufactured, drilled, and tailored to fit only Enabling Technologies sit-ski frame specifications. The procurement of one (1) Pique-R mono ski, two (2) (Dynamique Bi Skis (Medium and Large), and eight (8) updated high back clamshell seating systems would allow for disabled Veterans at the NDVWSC to use the most updated, industry leading sit-skis, lift mechanisms, and seating systems, all of which can only be provided by Enabling Technologies. The proprietary components used exclusively by Enabling Technologies offer a user-friendly and specific approach to providing a lightweight, advanced skiing system that can be utilized by a wide spectrum of skill levels and disabilities. The adaptive sit-skis will add to NDVWSC inventory which will enhance Veteran experiences in the rehabilitative event and will update aged-out seating systems with updated equipment based on manufacturers recommendations for optimal safety and performance of skis.
Although there are other adaptive sit skis and seating systems available on the market, none of them possess the same unique features that the Enabling Technologies Pique, Dymanique, and High Back Clamshell seating systems provide. The procurement of Enabling Technologies is sought to enhance the adaptive skiing experience for Veterans and will allow for a wide spectrum of disabilities to utilize the equipment during the NDVWSC. The Enabling Technologies equipment is unlike any other adaptive skiing equipment on the market and not available through other vendors.
