B.2 PERFORMANCE WORK STATEMENT

HOMELESS VETERAN HOUSING

A. PURPOSE

The Jack C Montgomery VA Medical Center (JCMVAMC), located at 1011 Honor Heights Drive, Muskogee, OK, 74401 has ongoing requirement for a Mental Health transitional living provider who can deliver transitional living, emergency housing (if available), and services consistent with Healthcare for Homeless Veterans (HCHV) contract objectives which emphasizes the Housing First and Recovery Models to homeless Veterans. a) It is agreed that the VA will have the right to inspection of the housing program and all appurtenances by an authorized representative(s) designated by the contracting officer.

b) Prior to the award of a contract a multidisciplinary VA team consisting of a social worker, nurse, and engineering safety officer, patient safety and dietician will conduct a survey of the housing program.

c) The safety officer will inspect the facility for conformity to the current life safety code and submit the findings to the COR. The other members of the team will focus on assessment of the quality of life within the housing program giving particular attention to the following indicators:

1. General observation of residents indicates that they maintain an acceptable level of personal hygiene and grooming.

3. Access to organized activity programs during waking hours (including evenings) reflecting a high level of activity in the facility or in the linked facilities; for example, group counseling, physical activities, assistance with health and personal hygiene.

If deficiencies are noted during the initial inspection, the facility will be given a reasonable time (usually not more than 30 days unless otherwise stated) to take corrective action and to notify the contracting officer that the corrections have been made. A contract will not be awarded until deficiencies are corrected. If deficiencies are found in subsequent inspections, the contractor will be allowed 10 days to correct the deficiency.

The VA will monitor the contractor's program and inspect the contractor's facility to ensure compliance with this agreement. Any unsatisfactory conditions noted during an inspection of contract facility will be reported, in writing, to the VA contracting officer through Medical Center Director. If corrections are not made in a timely manner, the VA may transfer any and all beneficiaries from the contractor's care to a more suitable environment.

Subsequent inspection of the housing program must be made every year by a multidisciplinary team including such hospital personnel as the director considers necessary to assure that the facility provided quality care in a safe environment.

D. OTHER REQUIREMENTS

1. The contractor shall notify the authorizing VA medical center immediately when a medical or mental health emergency occurs requiring hospitalization of any patient receiving care at VA expense. Unless an emergency exists that threatens life or limb, it is agreed that the veterans shall be admitted to the nearest VA facility if within 50 miles. If hospitalization of a non-emergency nature is required, it is agreed that admission to a VA medical center will be accomplished consistent with VA eligibility criteria as determined by medical administration service.

2. In the event a beneficiary receiving care under this contract dies, the housing program will promptly notify the VA office authorizing admission and immediately assemble, inventory and safeguard the Veteran's personal effects. The funds, deposits and effects left by VA patients upon the premises of the housing program shall be delivered by the housing program to the person or persons entitled thereto under the laws currently governing the housing program for making disposition of funds and effects left by patients unless the beneficiary dies without leaving a will, heirs, or next of kin capable of inheriting.

Should a Veteran referred to a housing program absent him/herself in an unauthorized manner, payment of service for that veteran to the contract facility would be continued for a maximum period of (2) days provided there is an active outreach program on the part of the contract facility staff to return the veteran to the residential care program and a strong likelihood that the patient will return. Management of program dropout will be an element of the quality assurance review of this program.

4. Site visits may include either a thorough audit or a spot check of records to ensure contractor invoices accurately reflect the veteran's length of stay.

5. The contractor shall maintain an individual clinical record on each veteran to outplace under this contract. The contractor must comply with the requirements of the "Confidentiality of Certain medical records" (38 U.S.C. 4132) and the "Confidentiality of Alcohol and Drug abuse patients Records" (42 CFR, Part II) when appropriate and shall be part of the contract (See note below). All case records will be maintained with such security and confidentiality as required and will be made available on the need-to-know basis to appropriate VA staff members involved with the therapeutic and rehabilitative program of the Veterans concerned. In addition to reasons for referral, the clinical record maintained by the contract facility will include:

a. All essential identifying data relevant to the resident and his/her family including a socio-cultural vocational assessment.

(5) Overpayments. If the Contractor becomes aware of a duplicate contract financing or invoice payment or that the Government has otherwise overpaid on a contract financing or invoice payment, the Contractor shall—

Subject to the terms of this contract, the Contractor shall be paid a percentage of the contract price reflecting the percentage of the work performed prior to the notice of termination, plus reasonable charges the Contractor can demonstrate to the satisfaction of the Government using its standard record keeping system, have resulted from the termination. The Contractor shall not be required to comply with the cost accounting standards or contract cost principles for this purpose. This paragraph does not give the Government any right to audit the Contractor's records. The Contractor shall not be paid for any work performed or costs incurred which reasonably could have been avoided.

(m) Termination for cause. The Government may terminate this contract, or any part hereof, for cause in the event of any default by the Contractor, or if the Contractor fails to comply with any contract terms and conditions, or fails to provide the Government, upon request, with adequate assurances of future performance. In the event of termination for cause, the Government shall not be liable to the Contractor for any amount for supplies or services not accepted, and the Contractor shall be liable to the Government for any and all rights and remedies provided by law. If it is determined that the Government improperly terminated this contract for default, such termination shall be deemed a termination for convenience.

(n) Title. Unless specified elsewhere in this contract, title to items furnished under this contract shall pass to the Government upon acceptance, regardless of when or where the Government takes physical possession.

(o) Warranty. The Contractor warrants and implies that the items delivered hereunder are merchantable and fit for use for the particular purpose described in this contract.

(p) Limitation of liability. Except as otherwise provided by an express warranty, the Contractor will not be liable to the Government for consequential damages resulting from any defect or deficiencies in accepted items.
