x The purpose of this amendment is to answer additional questions received, include a new bid schedule, and include PDF CAD drawings as rquested.

The proposal due date is extended till 8/5/2019 at 1:00 PM MT to donna.gillette@va.gov.

1. Per Amendment #2 RFI Responses, an exception to Buy American will be requested for the absorption chiller. Will an absorption chiller manufactured in China be acceptable if it meets specification requirements? Yes, they are part of the WTO

2. Per Amendment #2 RFI Response #131 – In the effort of preventing a sole-source for the chillers, what other manufacturer can provide the “Free Cooling” Cycle on the centrifugal chillers? Only one manufacturer has published this feature on water-cooled centrifugal chillers. Has a sole-source exception been provided? Would free-cooling through the plate heat exchanger be an acceptable alternative? Due to space constraints and the energy requirements, a plate and frame in addition to the chiller is not an acceptable alternative.

3. Per Amendment #2 RFI Response #131 – In the effort of preventing a sole-source for the chillers, what other manufacturer can provide a non-magnetic-bearing centrifugal chiller utilizing R-514a or R-123 refrigerant? Has a sole-source exception been provided? Would R-134a be an acceptable refrigerant in the centrifugal chillers? The phase out list for refrigerants includes R-514A, R-123 and R-134A therefore they are not acceptable.

7. Numerous CAD/.dwg drawings were issued with Amendment #2. One of our subcontractors that can open the files indicated that there are new drawing sheets included, sheets not included with the original solicitation. Please issues all sheets that are to be included with this solicitation in .pdf format so we can all open the files.

8. Amendment #2 indicates Chillers CAD 5 and Tower CAD 4 will only be available by request CD. Please send me a copy of the CD.

9. Several subcontractors have contacted me, requesting additional time to prepare their proposal. Amendment #2 pulled the bid date back from August 8, 2019, as specified in Amendment #1. This caught them by surprise and I have received several email declining to bid. Please consider extending the bid date at least another week.

10. Contractors need to submit for the absorption chillers as the below note requires, if we fail to get any compliant offers or your bid is the best option then we will process the determination.

****Note as per 52.225-9 Buy American-Construction Material, which is in the solicitation.

(c) Request for determination of inapplicability of the Buy American statute.

(1)

(i) Any Contractor request to use foreign construction material in accordance with paragraph (b)(3) of this clause shall include adequate information for Government evaluation of the request, including--

(A) A description of the foreign and domestic construction materials;

(B) Unit of measure;

(C) Quantity;

(D) Price;

(E) Time of delivery or availability;

(F) Location of the construction project;

(G) Name and address of the proposed supplier; and

(H) A detailed justification of the reason for use of foreign construction materials cited in accordance with paragraph (b)(3) of this clause.

(ii) A request based on unreasonable cost shall include a reasonable survey of the market and a completed price comparison table in the format in paragraph (d) of this clause.

(iii) The price of construction material shall include all delivery costs to the construction site and any applicable duty (whether a duty-free certificate may be issued).

(iv) Any Contractor request for a determination submitted after contract award shall explain why the Contractor could not reasonably foresee the need for such determination and could not have requested the determination before contract award. If the Contractor does not submit a satisfactory explanation, the Contracting Officer need not decide.

(2) If the Government determines after contract award that an exception to the Buy American statute applies and the Contracting Officer and the Contractor negotiate adequate consideration, the Contracting Officer will modify the contract to allow use of the foreign construction material. However, when the basis for the exception is the unreasonable price of a domestic construction material, adequate consideration is not less than the differential established in paragraph (b)(3)(i) of this clause.

(3) Unless the Government determines that an exception to the Buy American statute applies, use of foreign construction material is noncompliant with the Buy American statute.

(d) Data. To permit evaluation of requests under paragraph (c) of this clause based on unreasonable cost, the Contractor shall include the following information and any applicable supporting data based on the survey of suppliers:

Bid Schedule Option 1

The government's payment for the items listed in the pricing schedule shall constitute full compensation to the contractor for furnishing all plant, labor, tools, parts, equipment, appliances, transportation, parking, materials and incidentals needed to perform all operations required to complete the work in conformity, and if applicable with any and all drawings and specifications for VA Project 575-16-104 & 575-18-109: Replace Cooling Towers and Restore Cooling Capacity project at the Grand Junction VAMC. The contractor shall include prices for all items listed in the pricing schedule and include all costs associated for work in the specifications, whether specifically listed in the pricing schedule. Work will be accomplished at the Grand Junction VAMC at 2121 North Ave, Grand Junction, CO 81501. ***The projects will remain independent, but construction will be accomplished under a single contract, and work on each is expected to be done concurrently.
