1. Introduction and Overview
This requirements list is for a subscription to an online medical drug reference from a contractor that can provide license rights. This subscription is to ensure medical providers have access to a clinical drug reference for situations that are extremely complex and require in depth drug information in a quick and efficient manner. The reference will include comprehensive drug information (monographs, drug interactions, dosing, patient education material, IV compatibility, etc.), but in addition provide significant and in depth clinical information in areas including but not limited to off label drug uses, comprehensive toxicology information, drug safety data sheets (MSDS/SDS), extensive drug excipient information (beyond active ingredient and dyes), concise yet comprehensive and easy to read summary data for primary literature (including important statistical indicators such as p-values), specific drug information allowing different salt forms to be compared for clinical differences/indications, and other various clinical resources as defined in this requirements list.
2. Scope of Work
a. The contractor shall provide all resources necessary and have an established Business Associate Agreement with the Department of Veterans Affairs to meet the requirements.
b. The contractor shall provide uninterrupted access to a licensed electronic drug reference software database for clinical staff at facilities, virtual hubs, call centers, and offices in the VA Desert Pacific Healthcare Network (VISN 22), which include:
Phoenix VA Health Care System New Mexico VA Health Care System Northern Arizona VA Health Care System Southern Arizona VA Health Care System VA Greater Los Angeles Health Care System VA Loma Linda Health Care System VA Long Beach Health Care System VA San Diego Health Care System
3. Requirements
a. License rights to the online medical reference
b. Unlimited and simultaneous user access must be available online 24 hours a day 7 days a week via web from any government owned equipment (authenticated by IP address) as well as remote access for virtual employees such as those in telehealth centers, virtual clinical hubs, and call centers.
c. Application to allow mobile access using various mobile devices (iPad, iPhone, Android, etc.).
d. The electronic reference will use one interface and allow quick searches across all resources simultaneously in one search statement. Users able to go from drug monograph, to toxicology, to SDS, to primary literature summary, to in-depth drug information with one search.
e. In addition to routine and comprehensive drug information (i.e., drug monographs, chemical structure, IV compatibility, adverse drug reactions, drug interactions, drug identification, patient information, etc.), the reference shall provide significant in-depth information in the following areas:
i. Extensive information on off label drug uses and indications. This will include literature that supports and/or does not support the use of a drug.
ii. Comprehensive poison and toxicology information for management of drugs, plants, and other substances that may be encountered by medical staff in Emergency Departments, hospitals, domiciliaries, ambulatory care clinics, or other VA medical settings. Must include patient management and treatment protocols.
iii. Extensive library of Safety Data Sheets (MSDS/SDS). Needs to be more than link to free SDS sheets on internet.
iv. Extensive drug excipient information (beyond active ingredient and dyes) for proprietary and generic equivalent drugs, biopharmaceuticals.
v. Concise yet comprehensive and easy to read written summary of primary literature allowing medical providers the ability to quickly find and assess available literature as it relates to the clinical situation at hand. Primary literature summaries must include important statistical indicators such as p-values.
vi. In-depth drug information easily obtainable through primary literature summary. Users able to access summary and in-depth information without searching again, back-clicking, etc.
vii. Drug information specific to salt form, including ability to compare clinical differences and indications.
viii. Primary drug information database with links to primary and full literature references. All drug dosing content must have links to full references if based on evidence other than the proprietor labeling.
ix. Adverse drug reactions to include case reports and quantifiers such as percentages of patients affected by the interaction.
x. Complementary and alternative medicine, including international coverage with an international directory providing synonyms and therapeutic courses of drugs and drug derivatives.
xi. The contractor is responsible for any travel expenses related to on-site training or other customer service tasks associated with deliverables.
xii. The contractor shall provide product training, online tutorials, and promotional material
xiii. Contractor shall provide technical support numbers. Customer service shall be available to troubleshoot website/connectivity issues via phone, email, etc. The contractor is expected to troubleshoot access as needed.
xiv. The contractor shall have the ability to provide usage statistics on a quarterly basis. The format of the usage statistics is provided either via email or contractor provided login and should include session count, search count and total document retrievals per title.
xv. The contractor shall ensure deliverables are accessible on October 1, 2020 and remain so throughout the contract period.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

C.3 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)
(a) The Government may extend the term of this contract by written notice to the Contractor within 30 Days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 Days days before the contract expires. The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 2 Years.

(b) The Contractor is advised that in performing contract administration functions, the Contracting Officer may use the services of a support contractor(s) to assist in assessing Contractor compliance with the subcontracting commitments incorporated into the contract. To that end, the support contractor(s) may require access to the Contractor's business records or other proprietary data to review such business records regarding contract compliance with this requirement.
(c) All support contractors conducting this review on behalf of VA will be required to sign an “Information Protection and Non-Disclosure and Disclosure of Conflicts of Interest Agreement” to ensure the Contractor's business records or other proprietary data reviewed or obtained in the course of assisting the Contracting Officer in assessing the Contractor for compliance are protected to ensure information or data is not improperly disclosed or other impropriety occurs.

E.2 52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO SURVEILLANCE SERVICES OR EQUIPMENT (DEC 2019) The Offeror shall not complete the representation in this provision if the Offeror has represented that it “does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument” in the provision at 52.204-26, Covered Telecommunications Equipment or Services—Representation, or in paragraph (v) of the provision at 52.212-3, Offeror Representations and Certifications—Commercial Items.
(a) Definitions. As used in this provision— Covered telecommunications equipment or services, critical technology, and substantial or essential component have the meanings provided in clause 52.204–25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition. Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115–232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Contractors are not prohibited from providing—
(1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for “covered telecommunications equipment or services”.
(d) Representation. The Offeror represents that it [ ] will, [ ] will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation.
(e) Disclosures. If the Offeror has represented in paragraph (d) of this provision that it “will” provide covered telecommunications equipment or services, the Offeror shall provide the following information as part of the offer—
(1) A description of all covered telecommunications equipment and services offered (include brand; model number, such as original equipment manufacturer (OEM) number, manufacturer part number, or wholesaler number; and item description, as applicable);
(2) Explanation of the proposed use of covered telecommunications equipment and services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b) of this provision;
(3) For services, the entity providing the covered telecommunications services (include entity name, unique entity identifier, and Commercial and Government Entity (CAGE) code, if known); and
(4) For equipment, the entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the OEM or a distributor, if known).

E.3 52.212-1 INSTRUCTIONS TO OFFERORS—COMMERCIAL ITEMS (OCT 2018)
(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.
(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show—
(1) The solicitation number;
(2) The time specified in the solicitation for receipt of offers;
(3) The name, address, and telephone number of the offeror;
(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;
(5) Terms of any express warranty;
(6) Price and any discount terms;
(7) "Remit to" address, if different than mailing address;
(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);
(9) Acknowledgment of Solicitation Amendments;
(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and
(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.
(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.
(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.
(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with subpart 4.10 of the Federal Acquisition Regulation), or alternative commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.
(f) Late submissions, modifications, revisions, and withdrawals of offers.
(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.
(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is "late" and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and—
(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or
(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or
(C) If this solicitation is a request for proposals, it was the only proposal received.
