VHAPM Part 813.106 Page 1 of 2 Original Date: 08/30/17 Revision 01 Eff Date: 04/23/2018
DEPARTMENT OF VETERANS AFFAIRS
Justification for Brand Name Awards IAW FAR 13.106-1 For
Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)
Acquisition Plan Action ID: 36C258-19-AP-1345
1. Contracting Activity: Department of Veterans Affairs, VISN 22-Gilbert Supply Branch 2, Phoenix
Medical Center. Purchase Request: 644-19-3-201-0561
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: Eye lane equipment for the Phoenix VA Health Care System (PVAHCS) due to the expansion and upgrade of the current eye lanes. The purpose of this action is to purchase equipment that will help with the consistency in providing high quality patient care. Providers quickly switch rooms and instruments need to be uniform for ease of use and standardization of testing promoting advanced clinical access with direct scheduling. Furthermore, standardization is important for maintenance (bulbs, fuses, etc) and timely repair given the clinic volume. This will be a Firm Fixed Price Contract.
Estimated Amount: $84,152.46
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: The medical facilities personnel are trained and certified with the current system and are requesting this manufacture brand to be standard. A new vendor would increase annual operational cost to conduct extensive initial training and ongoing competency of products as well as maintaining stock of duplicate inventory of service parts for different vendors. The procurement of any other product will add an unnecessary cost to the government as a complete and functioning eye clinic is in place with the current inventory that has been standardized throughout the facility. The Following is a list of Brand Name Items: Lombart, Topcon, Haag-Streit, Reichert, Keeler.
4. Description of market research conducted and results or statement why it was not conducted:
The methodology used for the above estimate was developed based on market research of several different vendors where market surveys were accomplished over the phone and review of quotes.
The Contract Specialist conducted market research on VIP, GSA Advantage searching for each of the items requested. Also consulted were the Phoenix VA Health Care System ophthalmology equipment staff, and the ophthalmology room activation team who is working with the existing construction project where the eye clinic equipment will later be installed.
The contracting officer has a reasonable expectation that two or more offerors will submit quotes.
Any contract award will be made at a fair and reasonable price determined through competition.
Should competition not exist then other options available under FAR 13.106 will be used to help determine fair and reasonable pricing https://www.acquisition.gov/?q=/browse/far/13
