B.2 PERFORMANCE WORK STATEMENT

Contractor shall furnish all labor, equipment, supervision, management, supplies, transportation, and equipment necessary to perform contractor owned/contractor operated commercial pest, insect and rodent control services required under this contract for the Southern Arizona VA Health Care System (SAVAHCS), located at 3601 South 6th Avenue Tucson, AZ for the development and implementation of a comprehensive Integrated Pest Management Program (IPM). All services are to be performed in accordance with standard industry practices and quality control measures. The pesticide formulations used shall be United States Environmental Protection Agency (EPA) certified and approved for use in the manner applied, and must comply with Federal, State, and Local regulations. The Contractor shall be knowledgeable and certified to apply, maintain, and mix pesticide formulations in accordance with all Federal, State, and Local regulations. All pest management services throughout the period of this contract shall be performed on the premises of the SAVAHCS campus which is estimated to be 116 acres with approximately 978,919 square feet of building space.

Services are required daily Monday – Friday for regular service, and possibly Saturday – Sunday for emergent service. SAVAHCS is required to provide 24-hour support operations essential to patient care. Contractor services turn-around shall be performed accordingly to support the SAVAHCS operations, this includes both a regular spraying schedule during normal business hours, and no later than 24 hours after receiving notice for emergent situations. The contractor shall be flexible to provide services Monday through Sunday (excluding Federal Holidays) to prevent any delay in patient care, and or to address urgent services that require immediate attention that could pose a safety or health risk.

A. General Information:

1. This document contains the technical provisions for pest, insect and rodent control services that are to be provided to the SAVAHCS.

2. The work required by this Performance Work Statement (PWS), consists of furnishing the all labor, supervision, management, management support, supplies, ancillary equipment, vehicles and materials necessary for accomplishment of for the development and implementation of a comprehensive Integrated Pest Management Program (IPM).

3. All workmanship shall be in accordance with practices established by the United States EPA and accepted industry standards. It is intended that services shall include all processes necessary for pest, insect and rodent control reduction, or eliminate from the interior/exterior of listed facilities and all Medical Center grounds, throughout the term of the contract, invertebrate and vertebrate pest including, but not limited to, vermin such as rats and mice; pigeons; insects such as bedbugs, bees, wasps, termites, mosquitoes, roaches, silverfish, gnats, mosquitoes, spiders, crickets and ants; arachnids such as spiders, mites, black widows, tarantulas, scorpions; incidental invaders such as, crickets, earwigs, midges, millipedes, centipedes, ground beetles, clover mites, termites and bats; to the satisfaction of the Contracting Officer Representative (COR) or designee.

4. Bedbugs, bees, wasps and termites will be done on an on-call basis. Bat removal shall be done on a catch and release basis. The contractor shall be knowledgeable with the prevention, treatment and eradication of bed bugs to the satisfaction of the CORs or designee.

5. Any change of function by the Government, which may affect this contract as contemplated by this paragraph, and which requires permanent adjustments in frequency or type of performance, will require a bilateral modification to the contract and approved by a Contracting Officer (CO).

6. Notwithstanding the provisions of the contract covering inspection, acceptance, and any areas found to have been unsatisfactorily treated according to quality and performance standards established in Section Y - Quality Control Program, shall be re-treated at no additional cost to the Government. Such areas shall be identified, for contractor review by the CORs or designee when they are discovered.

7. Scheduled services are to be accomplished subject to urgent pest control situations, which may require alteration of schedules. During urgent pest control situations from the time of notification, the contractor must be on the SAVAHCS premises as soon as possible, but no later than 24 hours from notification from the CORs, CO or designee that a pest control problem exists, and additional attention is required.

8. This specification is intended to produce minimal acceptable level of performance. The Government does recognize the possibility of the Contractor achieving the same or improved results due to innovative approaches, advances in the state-of-the-art materials, equipment and supplies. Accordingly, provision is hereby made for alterations when a Contractor demonstrates the ability to maintain the standards established herein through use of improved techniques, materials, scheduling, etc. All changes are contingent upon the recommendations of the CORs and the approval of the CO by bilateral contract modification.

B. Contractor Qualifications:

1. The Contractor shall have experience in providing comprehensive IPM services.

2. The Contractor shall have a manager who is on-call and can be physically present during prescribed work hours if needed. The manager is solely responsible to supervise the provision of these IPM services to the SAVAHCS and serves as the primary point of contact with the Government. The Contractor shall designate a qualified alternate to substitute for the manager in his absence or during periods of work performed after normal work hours. The Contractor’s IPM service must meet the following requirements:

3. Certified by EPA or graduate of an independently controlled management-training program emphasizing pest management and compliance with Federal, State, and Local regulations. The formal course must have been previously established.

4. The manager shall have one year of specialized experience in this capacity. This specialized experience may be substituted for certification.

5. The CO, CORs or designee must be provided with the name, address and telephone number where the manager is to be reached during normal business hours and off duty hours within 15 days after award. The same information will be provided for a qualified alternate when the manager is not available.

6. The Contractor is responsible for the effective implementation of a Quality Control Program and shall be responsive to the requirements of the Government’s Quality Assurance Plan conducted by the CORs or designee.

C. Personnel Training Qualifications and Requirements:

1. Employment: The manager and designated alternate must be able to read, write, speak and understand the English language.

2. The Contractor shall provide sufficient and trained personnel, who are paid at the prevailing rate, as necessary to perform the services required by this contract and shall meet all variations, shift schedules, and changes as may be required to assure prompt response to the requirements of contract.

3. Certification and Training Requirements: Contractor must ensure personnel are trained, compliant and qualified in the following areas according to VHA Directive 1850.02, Pest Management Operations:

4. Public Health Pest Control: Applicators must demonstrate practical knowledge of vector-disease transmission as it relates to, and influences, application programs. A wide variety of pests are involved, and it is essential that they be known and recognized, and the appropriate life cycles and habitats be understood as a basis for control strategy. These applicators must have practical knowledge of a great variety of environments ranging from streams to those conditions found in buildings.

5. Industrial, Institutional, Structural, Health Related Pest Control: Applicators must demonstrate a practical knowledge of a wide variety of pests, including their life cycles, types of formulations appropriate for their control, and methods of application that avoid contamination of food, damage and contamination of habitat, and exposure of people and pets. Since exposure to humans, including babies, children, pregnant women, and elderly people, is frequently a potential problem, applicators must demonstrate practical knowledge of the specific factors, which may lead to a hazardous condition, including continuous exposure in the various situations, encountered in this category. Because health-related pest control may involve outdoor applications, applicators must also demonstrate practical knowledge of environmental conditions, particularly those related to this activity.

6. Federal, State, and local laws and regulations governing pest management activities. Pest management operations must meet all Federal requirements as identified in Public Law (Pub. L.) 92-516, Federal Insecticide, Fungicide and Rodenticide Act, dated November 28, 1975, as amended, and Executive Order 12088 (Federal Compliance with Pollution Control Standards) and appropriate OSHA standards regarding hazard communication, personal protective equipment, and exposure standards.

7. Proper storage, handling, and disposal of all pesticides and pesticide containers as required by Code of Federal Regulations (CFR), Title 40. Protection of Environment, Chapter I. Environmental Protection Agency (EPA), Subchapter E Pesticide Programs, Part 165 Pesticide Management and Disposal, Subparts C and D and 40 CFR Parts 262 and 273

8. As a minimum requirement, applicators must demonstrate skills, knowledge, and abilities that meet Federal, state, and local requirements. Skills, knowledge, and abilities according to VHA Directive 1850.02, Pest Management Operations that include, the following:

i. Recognizing common pests to be controlled and the damage caused by them.

ii. Reading and understanding the label and labeling information to include:

iii. The common name of pesticides applied;

iv. Pest(s) to be controlled;

v. Timing and methods of application;

vi. Safety precautions; and

vii. Any specific disposal procedures.

9. Applying pesticides in accordance with label instructions and warnings. This includes the preparation of the proper concentration of pesticide to be used under particular circumstances and taking into account such factors as the area to be covered and the quantity dispersed in a given period of application.

10. Recognizing local environmental situations that must be considered during application to avoid contamination of special facilities, especially those particular areas in medical research facilities (chemical laboratories, animal research units, etc.).

11. Reducing the potential for pesticide resistance by rotating pesticides, which involves alternating among pesticide classes with different modes of action to delay the onset of or mitigate existing pest resistance. NOTE: It is strongly recommended that non-chemical methods (e.g., sanitation or elimination of breeding areas) be explored prior to the consideration of chemical applications.

12. Recognizing common poisoning symptoms and the procedures to follow in case of a pesticide accident.

13. No contractor personnel may be assigned to work under the contract until the training and certification has been achieved. Documentation verifying personnel training and certification shall be maintained by the Contractor. When the Government exercises one or more of the option years to the contract, the Contractor shall provide, to the CORs or designee documentation that personnel have had required training and certifications.

14. Other training will include but not limited to the following topics:

i. Individual duties and responsibilities.

ii. Procedures for replenishing supplies and obtaining equipment repair.

iii. Role of Contractor personnel and their impact on patient care.

iv. Techniques or methods for measuring the quality of work performance.

v. Care and maintenance of Contractor and Government-furnished property.

vi. A general orientation with procedures and policies.

vii. Hazard communication, including location and access to the Safety Data Sheets (SDS).

viii. Compliance with Occupational Safety and Health Administration (OSHA)’s, which covers Universal precautions and use of PPE (Personal Protective Equipment).

ix. Contractor must have practical knowledge of the importance and employment of such nonchemical control methods as sanitation, waste disposal, and drainage

x. Safety or protective clothing or equipment shall be provided and maintained by the contractor at the Contractor’s own expense.

xi. Personal Hygiene. Contractor personnel shall be clean and neat in appearance.

15. Exposure to Hazardous Working Conditions. Contractor personnel are required to perform work under potentially hazardous conditions. Contractor personnel shall be informed of potentially hazardous situations by Contractor, trained by Contractor in techniques required to recognize and deal with potentially hazardous situations in a manner which will minimize personal risk, and required to adhere to standard techniques for personal whom become injured or ill on the job at no cost to the Government.

16. Physical Examinations: The contractor will be responsible for any physical examinations and emergency medical care of personnel.

17. Contractor’s personnel who acquire a communicable illness must not perform service under the contract and must be free of illness before returning to work.

18. Miscellaneous: The Contractor is responsible for compliance with all appropriate JC, FDA, VA, and other regulatory agencies record keeping requirements.

19. Government Representative. The CORs is responsible for providing technical assistance to the CO in administration of the contract. This responsibility involves quality assurance inspection, surveillance reporting and monthly certification of the Contractor’s performance by the CORs or designee. The CO will furnish the name of the CORs prior to the start date of the contract. The Contractor shall be advised of the extent of the authority of the CORs. Each phase of the services rendered under this contract is subject to Government inspection during both the Contractor’s operation and after completion of tasks. The Government’s program is not a substitute for quality control by the Contractor.

D. Performance Evaluation Meetings:

1. The Contractor shall meet with the CORs or designee quarterly, unless more often is deemed necessary by the CORs or designee.

2. The issuance of a Contract Discrepancy Report (CDR) may be cause for the scheduling of additional meeting(s) between the contractor and the CORs or designee. A mutual effort will be made to resolve all problems identified. The CORs or designee will prepare written minutes of these meetings. Should the contractor not concur with the minutes, a written statement will be presented to the CO, and the manager will be notified of the decision in writing by the CO.

3. Correspondence. All correspondence relative to this contract shall bear the VA contract number, title, and name of the VA medical center, and shall be addressed to the CORs with a copy to the CO.

E. Damage and Equipment Loss:

1. All tasks accomplished by Contractor’s personnel shall be performed to preclude damage or disfigurement of Government-owned furnishings, fixtures, equipment, and architectural or building structures. The Contractor shall verbally report immediately to the CORs or designee, any damage or disfigurement to these items when caused by Contractor’s personnel. A follow-up written report will be given to the CORs and a copy forwarded to CO.

2. When the Contractor has caused damage or loss of government property, or performance is determined to be unsatisfactory; the CORs will issue a CDR. The Contractor will reply in writing, to the CORs within 10 working days, stating the reason for the unsatisfactory condition, the corrective measures which have been taken, and preventive procedures initiated.

3. Any damage caused to Government property during the Contractor’s performance of work under the contract shall be repaired or replaced to preexisting conditions at Contractor’s own expense.

F. Pest Material Restrictions:

1. All pesticides and traps shall be approved by the CORs designee prior to performance of the contract. Unused portions of pesticides shall be removed within a time limit set forth by the CORs or designee.

2. The contractor shall be required to furnish the SAVHACS prior to initial application of pesticides and rodent control chemicals, the:

I. Brand/trade name (if any);

II. Chemical names of the chemicals used; and

III. A Label Showing the Contents, a Safety Data Sheet, the use strength of the chemicals as applied and the antidote thereto.

3. Contractor will furnish the above information each time he proposes to change chemicals or products used in the performance of this contract.

4. All products must be approved by the SAVAHCS prior to the treatment in the event of infestation or and/or contact with material by humans.

5. All pesticides used by the Contractor must be registered with the United States Environmental Protection Agency (EPA), State and Local jurisdiction.

G. Pest Material Storage:

1. No pest control materials or equipment shall be stored or kept at any of the installations when the operator is not working, without the expressed written approval of the CORs or designee.

H. Required Contractor Reporting:

1. Contractor personnel will check in at the beginning of their scheduled work shift and out at the end of their work shift. This will be done thru the CORs or designee, Environmental Management Service Office Building 38 basement, Room A5, A10, 11A, or their designated specified location. They shall be required to provide copies of their corporate license before service can be rendered. These copies will be kept on file in the EMS administrative offices.

2. Upon checking in at the office, a tentative itinerary for the tour of duty will be provided directly to the CORs or designee, Environmental Management Service for approval.

3. The contractor will fill out the forms furnished by the office which shows where pesticides was applied, the name of the pesticide used. These forms will be filled out and signed by the contractor designated representative after each visit to the installation.

I. Interference with Normal Facility Functions:

1. Contractor personnel are required to stop pest control applications or inspections for infestation, momentarily, so as not to interfere with the normal functioning of the facility, including utility services, fire protection systems, and passage of facility patients, personnel, equipment, and carts when it is necessary for them to work on station during normal business hours

J. Disposal of Hazardous Waste:

1. The contractor shall not dispose of any excess pesticide containers or any other materials contaminating pesticides at any location of the SAVAHCS Medical Center facility premises except as specified by the CORs or designee, Environmental Management Service.

K. Normal Business Hours:

1. Normal business hours are 8:00 a.m. to 4:30 p.m., Monday through Friday, excluding federal holidays

2. Contractor must comply with Federal, State, and Local regulations. During the months of February through November inclusive, the exterior perimeter of all buildings listed under Requirements and all trash dumpsters and the trash compactor will be treated with residual pesticides deemed most appropriate to address identified pest problem and approved by the CORs or designee.

3. Phase-out Plan. The Contractor shall have a phase out plan. This plan shall describe the Contractor’s methods and procedures to ensure smooth and uninterrupted service at contract expiration date for a period not to exceed 90 days. The Contractor shall fully cooperate with the successor Contractor and the Government so as not to interfere with their work or duties.

4. Circumstances to be reported. The Contractor shall report any circumstances, which may affect the performance of the work and unhealthy or hazardous conditions or any delays or interference with work. Such reports shall be made immediately upon discovery by the Contractor to the CORs by phone and a follow- up email.

L. Definitions/Acronyms: Definitions used throughout this Performance Work Statement shall have the following meanings as set forth below:

1. CDR (Contract Discrepancy Report). Government formal documentation of Contractor’s failure to provide services as required under the terms of the contract. The CDR requires the Contractor to explain in writing why performance was unsatisfactory, how performance will be returned to satisfactory levels, and how recurrence of the problem will be prevented in the future.

2. Contractor. An individual, partnership, or organization having a contractual relationship with the Government for provision of service.

3. CO (Contracting Officer). The person with the authority to enter into, administer, and/or terminate contracts and make related determinations and findings.

4. COR (Contracting Officer’s Representative). Any person or persons authorized to act for the Contracting Officer within authority limits. (Lead/Facility)

5. Manager. Contractor’s representative having supervisory responsibility and authority for total performance of work under the contract.

6. Cure Notice. A formal notification to Contractor to correct a deficient situation or risk termination of contract.

7. Defect. Each instance of noncompliance with a contract requirement. A defect may be caused by either nonperformance or poor performance.

8. Department of Veterans Affairs. Government agency requiring services under the terms of the contract.

9. Urgent. An unforeseen combination of circumstances, or the resulting state, which requires immediate action. The CORs or designee shall declare an urgent circumstance.

10. Federal Holidays. The date of observance by the Federal Government of the following holidays: New Year’s Day (1 January), King’s Birthday (3rd Monday in January), Washington’s Birthday (3rd Monday in February), Memorial Day (Last Monday in May), Independence Day (4th of July), Labor Day (1st Monday in September), Columbus Day (2nd Monday in October), Veteran’s Day (11 November), Thanksgiving Day (4th Thursday in November), and Christmas Day (25 December). When such holiday falls on first non-workday, the preceding workday will be considered a holiday. When such holiday falls on the second non-workday, the next workday will be considered a holiday.

11. Government. The United States Government, Headquarters, VA, VAMC, SAVAHCS, and the term used to refer to the officials designated to administer the contract or their designated representatives.

12. Headquarter. Veterans Affairs Central Office.

13. Medical Center Director (s). The person with final responsibility for the mission of the Medical Center. A Medical Center Director may have final authority over more than one Medical Center.

14. Must. This word is used relating to the Contractor and specifies that the provision is binding.

15. Personal Property. All Government property, except real property and expendable property.

16. Procedures Manual. A Contractor’s written document describing in detail the methods normally used to accomplish tasks required by the contract, proper operation of equipment, and normal fire/ safety precautions.

17. PWS (Performance Work Statement). A document that describes accurately the essential technical requirements for services, including the standards used to determine whether the requirements have been met.

18. Quality Assurance. Those actions taken by the government to check goods or services to determine that they meet the requirements of the PWS.

19. Quality Assurance Evaluator. Government employee(s) assigned to monitor and evaluate the quality and compliance with the Performance Work Statement requirements.

20. Quality Control. Those actions taken by the Contractor to control the production of goods or services so that they will meet the requirements of the PWS.

21. Satisfactory Performance. Within limits of the AQL, adherence to the requirements of the PWS.

22. Service. A job performed to the standard and within the acceptable quality level. The Contractor must do the specific job, meet the standard, and meet the acceptable quality level before performance is acceptable and the Contractor is paid.

23. Shall. This word is used relating to the Contractor and specifies that the provision is binding.

24. Standard. A Government acknowledged measure of comparison.

25. Start Date. The date work under the contract is scheduled to begin.

26. Surveillance Plan. An organized written document used for quality assurance surveillance.

27. Task and Frequency Chart. Displays the required tasks and the minimum frequencies of performance.

28. JC (Joint Commission). A national organization dedicated to improving the care, safety, and treatment of patients in health care facilities.

29. SAVAHCS. Southern Arizona VA Health Care System

30. Unsatisfactory Performance. Failure to meet the AQL.

31. VA (Department of Veterans Affairs). The Government agency requiring services under the terms of the contract.

32. VAMC. Veterans Affairs Medical Center

33. Will. This word is used relating to the Government and specifies that the provision is binding.

N. Government Furnished Property and Services:

1. The Government will provide forms, publications and services specifically identified in this contract as Government furnished.

2. The Government will provide restroom and hand washing facilities for Contractor employees to wash their hands following exposure to chemicals while at the Medical Facility.

3. The Government will provide facility passes for Contractor’s employees as necessary to fulfill provisions of this contract.

O. Contractor Furnished Items:

1. Materials. Contractor shall furnish all materials necessary to perform the tasks specified in the contract except to the extent specified in Section 3.

2. The Contractor shall secure all materials and supplies that comply with Local, State and Federal environmental laws.

3. Vehicles. The Contractor shall provide all required vehicles, vehicle fuels, lubricants, and repairs necessary to perform services under this contract. All vehicles to be used under this contract must be maintained in a safe and serviceable condition during duration of this contract. In addition, the vehicles must be kept clean (exterior and interior) with no unsightly residue of dirt, mud, trash, and other debris. Vehicle efficiency is solely the responsibility of Contractor and Contractor shall not be relieved of his contract responsibilities due to vehicle breakdown or failure of vehicles to operate.

P. Specific Tasks:

1. All pest management services throughout the period of this contract shall be performed on the premises of the SAVAHCS located at 3601 S. 6th Avenue, Tucson, AZ 85723. SAVAHCS has an estimated 116 acres with approximately 978,919 square feet of building space.

2. The contractor shall be knowledgeable with the prevention, treatment and eradication shall include all processes necessary for pest, insect and rodent control reduction, or eliminate from the interior/exterior of listed facilities and all Medical Center grounds, throughout the term of the contract to the satisfaction of the CORs or designee including invertebrate and vertebrate pest, including but not limited to the following. All service related to the prevention, treatment and eradication will be paid as part of the monthly base costs.

3. Vermin such as rats and mice;

4. Birds/mammals such as pigeons, and bats; Bat removal shall be done on a catch and release basis.

5. Insects such as bedbugs, bees, wasps, termites, mosquitoes, roaches, silverfish, gnats, mosquitoes, spiders, crickets, ants, and bed bugs;

6. Arachnids such as spiders, mites, black widows, tarantulas, scorpions;

7. Incidental invaders such as, crickets, earwigs, midges, millipedes, centipedes, ground beetles, clover mites, termites and bats;

8. ‘Urgent treatment’ for bedbugs, bees, wasps, bats or termites, etc. will be coordinated on an on-call basis, using the appropriate CLIN number with the required service. The decision to call the manager for an urgent treatment will be determined by the CORs or designee.

9. On-call bedbug inspection due to a suspected observation will be considered part of the monthly base costs. However, if treatment is required this will be paid to the contractor at the on-call pricing.

10. Bee Abatement Program as described in section 5.6 will be considered part of the monthly base costs. However, if bee or wasp activity is deemed “dangerous” by the CORs or designee and on-call services are requested, then this will be paid to the contractor at the on-call pricing.

11. Termite prevention and treatment will be considered part of the monthly base costs. However, if there is observed termite activity including evidence of swarms, mud tubes, etc. and is considered an urgent by the CORs or designee with on-call services are requested, then this will be paid to the contractor at the on-call pricing.

12. All workmanship shall be in accordance with practices established by the United States EPA and accepted industry standards.

Q. Inspection and Treatment of Buildings:

1. It is estimated that at least one (1) visit per week will be necessary to perform the required services in most areas. All services (expect urgent) related to the prevention, treatment and eradication for these buildings will be paid as part of the monthly base costs. All buildings on the premises will be Inspected and treated as needed to the satisfaction of the CORs or designee. Should the Government add or delete buildings during the performance, the CO shall negotiate with the contractor for increase or decrease of pricing. The Government reserves the right to add and delete facilities as the area expands geographically. Any changes to the contract will be done as a bilateral modification and approved by a Contracting Officer.

2. Buildings List:

3. NOTE: Inspection and treatment of Buildings 10, 56, and, 78 Animal Research areas may be serviced around the exterior of the buildings after 4:30 p.m.

4. One (1) visit per week is necessary in the Nutrition and Food Service / Canteen Service (Food Production areas) - Building No. 3 Patient Dining & Canteen. All services (expect urgent) related to the prevention, treatment and eradication for these buildings will be paid as part of the monthly base costs.

5. Inspection and treatment of the Nutrition and Food Service / Canteen Service (Food Production areas) may be serviced between the hours of 6:30 p.m. and 11:00 p.m.

6. Inspection and treatment of the canteen storage, offices, store, and cafeteria areas may only be serviced between the hours 3:00 p.m. and no later 3:30 p.m.

R. Visit Requirements:

1. The contractor will schedule all work with the CORs or designee.

2. The contractor shall provide copies of the applicators Arizona Department of Agriculture license and these copies will be kept on file in the EMS administrative offices.

3. Upon arrival, the contractor shall contact the CORs or designee regarding areas to be inspected/treated according to VHA Directive 1850.02, Pest Management Operations.

4. The contractor will be escorted by the CORs or designee during each visit or inspection.

5. The contractor shall Identify and discuss specific problem areas in the facility and the most appropriate treatment to be used. Preventive pesticide treatment must be approved by the CORs or designee on a case-by case basis.

6. The contractor shall Identify facility features or personnel practices, which are contributing to pest infestation.

7. The contractor shall discuss the effectiveness of previous efforts.

8. The contractor will use all safety equipment required by the label and SDS for the product being applied.

9. Provide CORs or designee with SDS and a current copy of the label for each pesticide proposed for use prior to any application.

10. Each pest management activity will be properly invoiced or receipted. A record of each pesticide application including specific information is required to be kept by VHA Directive a1850.02(1), and the State of Arizona Department of Agriculture regulations. The invoice or receipt shall include:

i. Name of the applicator and the applicator's certification number;

ii. Name and permit number of the pesticide seller;

iii. Name of the pesticide applied and its EPA registration number;

iv. Specific identification of pest;

v. Date and time of application, as well as specific location;

vi. Name of regulated grower (if applicable);

vii. Method of application;

viii. Item treated;

ix. Rate per item treated;

x. Total volume used in the application;

11. Application site location by county, range, township, and section, or by physical address. Square footage of applications larger in size than spot application (defined as a surface treatment to an area of no more than two square feet); and

12. Wind direction and speed and temperature, if outside (when applicable). Specific locations of reported activity.

13. Observe all safety precautions throughout the facilities. Certain areas may have restricted entry or require special precautions for contractor personnel. All restrictions and procedures for special areas will be communicated to contractor by the CORs or designee.

14. Inspections and treatments of buildings and grounds are to be made after normal duty hours of 8:00 a.m. to 4:30 p.m., Monday through Friday excluding Federal holidays unless specifically approved by the Contracting Officer, CORs. All visits must be made at a time satisfactory to the CORs or designee.

15. In addition to the estimated visits, the contractor shall be required to visit the facility as soon as possible for emergent (during regular business hours), but no later than 24 hours after receiving notice from the CORs or Contracting Officer, that a pest control problem exists, and additional attention is required.

S. Residual Treatment Requirements:

1. During regularly schedule visits, the Contractor shall apply appropriate pesticides and obtain approval regarding type of pesticide from the CORs or designee prior to dispensing, but not in areas where food is exposed. The formulations used shall be EPA registered for use in the manner applied.

T. Special Provisions:

1. All contractor personnel performing pesticide applications of these areas below shall adhere to the following provisions:

2. Food Handling Areas: Treatment of these areas is limited to only times when food is not being held, processed, prepared, served, and while occupied by facility employees.

3. Elevators: The contractor personnel shall at no time enter the facility elevators which are occupied by food service equipment while in the possession or application equipment.

4. Patient Occupied Areas: The contractor shall submit a list of pesticides for intended use in these areas for approval by the Chief, Environmental Management Service prior to any application. The planned use of pesticides with a low volatility and as odor – free as possible to keep odor levels from affecting patients, visitors, or staff in these areas.

5. Critical Areas: The contractor shall submit a list of pesticides for intended use in the areas below for approval by the Chief, Environmental Management Service prior to any application. The planned use of pesticides in these areas requires recognition of the attendant hazards to occupants, supplies, equipment, and surfaces. No submission can be made at any time without approval from the CORs or designee, Environmental Management Service. Including the following locations:

i. Operating Rooms

ii. Intensive Care Rooms

iii. Respiratory Care Areas

iv. Any Patient Treatment Rooms or Bedrooms

v. Dietetics and Canteen Food Preparation Areas

U. Bee Abatement Program:

1. Installation of bee traps at the SAVAHCS will be provided by the contractor to include a total number of traps determined between the contractor and the CORs or designee.

2. A general property inspection, prior to trap placement will be performed with the appointed contact individual. Trap placement and relocation needs to be at the discretion of CORs with specific bee abatement knowledge.

3. Monthly maintenance visits to inspect and maintain traps with bee removal and will include the inspection and as-needed treatment of trash bins.

4. The buckets will be installed on many of the building roofs and in locations away from the public areas. Placement of the bee traps must be made with prior approval and agreement of the CORs or designee.

5. Service for bee traps will consist of a monthly visual inspection of all bee traps either on the building roofs or other locations. During the monthly inspection, traps with bee activity will be treated, cleaned and replaced as needed. Prior to monthly visits any sightings by designated staff of bee activity will be reported to the CORs or designee. These reports will be handled at the time of regular visits.

6. If bee activity would be deemed “dangerous” this will be immediately reported to the CORs or designee, and a decision to call the manager for an urgent treatment will be determined for this service and shall be coordinated on an on-call basis, using the appropriate CLIN number with the required service.

7. An effective, approved “spray” product is not currently available that will repel bees from trash bins, “spraying” trash bins with pesticide will not stop bees from foraging to these sites. The most effective control method is “frequent emptying of trash bins along with frequent washing to remove attractants.” Inspections of these areas and trash bins will be performed and needed applications for ‘gathering’ bees can be performed.

8. At the time of regular visits, general inspection is performed for conditions conducive to bee activity (i.e., leaky faucets, standing water, flowering plants at entry ways, etc.). These problems will be reported to the CORs or designee.

V. Applicable Regulations, Manuals, Specifications and Technical Exhibits:

1. Applicable Regulations, Manuals and Specifications - Documents applicable to the PWS are listed below. These documents are mandatory. At the start of the contract the Government shall provide one copy of all mandatory regulations, manuals and specifications listed below to the Contractor after award. Supplements and amendments thereto, shall be updated and shall be in full force and effective immediately upon receipt by the Contractor. The policies and procedures of mandatory directives shall be adhered to always. It is the Contractor’s responsibility to ensure that all mandatory publications are adhered to and up to date:

i. All Pesticide Laws and Regulations – EPA

ii. Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA)

iii. Pesticide Registration Improvement Act of 2003 (PRIA)

iv. Clean Water Act – EPA

W. Technical Exhibits:

1. Contractor Furnished Reports.

2. Damage to Government property or equipment.

3. EPA or CORs approved pesticide application report.

4. Detailed monthly statement of charges as stated in the Contract Terms and Conditions FAR Section 52.212-4.

X. Contractors Quality Control Program (QCP):

1. Quality Control Plan: The contractor shall develop and maintain a quality control plan to establish and maintain quality control to ensure all contract requirements are met. The contractor’s QCP shall include the following: An inspection plan covering all services. The inspection plan must specify the areas to be inspected on either a scheduled or unscheduled basis and how often inspections will be accomplished and documented, and the title of the individual(s) who will perform the inspection.

2. On-site records of all inspections conducted by the contractor noting necessary corrective action taking. The Government reserves the right to request copies of any and/or each inspection.

3. The methods for identifying and preventing deficiencies in the quality of service performed, before the level of performance becomes unacceptable and organizational functions noting intermediate supervisory responsibilities and overall management responsibilities for ensuring total acceptable performance.

4. The contractor shall maintain records of certifications and ongoing training of each employee performing services under this contract.

5. The contractor shall maintain on-site records of any complaints or problems. With procedures taken to allow for corrections and/or elimination before effects caused interruption of performance of contract.

6. The contractor shall participate in scheduled and/or non-scheduled conference calls with the VA representatives to provide a report of on-going operational issues.

7. The contractor shall have a system that verifies the certification of individuals providing pest services to SAVAHCS. The contractor will make this available for review by the VA.

8. If a treatment is inadequate (as per specifications), the contractor shall return within 2 hours after receipt of notification by the COR to retreat previously treated area(s) at no additional cost to the government.
