Introduction:
The Department of Veterans Affairs, Southern Arizona VA Medical Center has a requirement for elevator preventative maintenance services.
Background:
The Southern Arizona VA Health Care System (SAVAHCS) located at 3601 S. 6th Avenue, Tucson, Arizona 85723-0001, has an ongoing requirement for contractor services to provide elevator preventative and dumb waiter maintenance, inspections, and emergency call back services.

The contractor shall furnish all material, labor, equipment, and supervision necessary to provide elevator and dumb waiter preventative maintenance, inspections, and twenty-four (24) hour seven (7) days per week emergency service. During the elevator and dumb waiter inspections, the Contractor shall clean, adjust, and lubricate the equipment, determine the nature and extent of any work required to restore the elevators and dumb waiters to satisfactory service as determined by the SAVAHCS, and if conditions warrant, furnish and install parts listed in paragraph 7.0 below. The contractor's employees shall be manufacture trained and qualified technicians with not less than five (5) years' experience working on elevators and safety devices.
3.0 SCHEDULED MAINTENANCE: The contractor shall perform Preventative Maintenance (PM) Service to ensure that equipment listed in the schedule performs in accordance with applicable conformance standards (Attachment 2). The contractor shall provide and utilize procedures and checklists with worksheet originals indicating work performed and actual values obtained (as applicable) and provide them to the COR or designee at the completion of the PM. The contractor shall provide a written description of the Preventive Maintenance Inspections (PMI). This description shall include an itemized list of the procedures performed, including electrical safety. PM services shall include, but not be limited to the following:
3.1 Preventive maintenance shall be performed at the following frequencies: (see workload data)
a. One (1) hour per week for traction elevators;
b. 1 hour every two weeks for hydraulic elevators;
c. 1 hour per month for dumbwaiters.
3.2 Cleaning, lubricating, inspecting, adjusting, repairing and/or replacing all parts as necessary to keep the equipment in first-class condition and proper working order. This includes all electrical, electronic, mechanical and related software components that are part of the elevator system, except the external CPU's, monitors, keyboards, mouse units, and printers not directly related to proper function of the elevators — e.g., diagnostics, etc.
3.3 Furnishing all lubricant, cleaning materials and parts required.
3.4 Equalizing tension, shortening or renewing of hoisting ropes where necessary.
3.5 Keeping equipment adjusted to the original or currently specified performance standards at all times, including flight time, cycle time, and door cycle times.
3.6 The operational system shall be maintained to applicable standards including any changes or adjustments required to meet varying conditions of hospital occupancy.
3.7 Maintain smooth starting and stopping and accurate leveling at all times.
3.8 Performance Times, Leveling, Contact Speed and Door Operating Times: The control system shall be maintained to provide smooth acceleration and deceleration under varied conditions. The acceptable maximum performance times are as follows, and a written report shall be submitted quarterly by the contractor to the COR or designee confirming that all performance times, leveling accuracy, contact speed and door operating times are operating in accordance with contract requirements.
a. Leveling Accuracy (inch) = .25
b. Door Close Time (seconds) = 4
c. Running Speed (%) = ± 5%
3.9 Any charges for parts, services, manuals, tools, or software required to successfully complete scheduled PM's are included within this contract, and its agreed upon price, unless specifically stated in writing otherwise.
3.10 Contractor shall maintain a log in each machine room. The log shall list the date and time of weekly examinations and all trouble calls. Each call shall be fully described, including the nature of the call, necessary correction performed and/or parts replaced.
3.11 Weekly inspection of elevators and dumbwaiters shall be performed at a time that is mutually agreed upon by government and contractor at time of award.
3.12 Inspections occurring on Federal Holidays will be rescheduled for the following administration duty day.
3.13 Contractor shall coordinate inspection times for specific elevators with the Government in order to minimize the disruption of medical center activities.
3.14 The COR or appointed Government representative shall accompany the elevator safety inspector during the annual elevator inspections and performance of tests required by ASME A 17.1. The contractor shall perform all required tests per the current edition of ASME A17.1, ASME A17.2 and ASME A17.3, including the three (3) year load tests, and the five (5) year tests. The test(s) shall be performed under the direction of an appointed elevator inspector having area jurisdiction and appointed under separate contract by the SAVAHCS. The Contractor will furnish all labor and materials required to conduct the tests.
a. The Contractor will furnish all necessary equipment and weights and means of transportation throughout the facility to the various locations, as directed by the inspector.
b. The Contractor will ensure that its materials and equipment will not block corridor space. At no time will any materials or equipment be stored in such a manner that would prevent the Medical Center staff from responding to patient emergencies.
c. All tests will be performed in the presence of the elevator inspector. All tests will be performed between the hours of 8:00 a.m. and 4:30 p.m., Monday through Friday, unless changed by the COR.
d. The COR will notify the elevator maintenance contractor of the dates the above tests will be performed within five (5) business days of receipt of notice that the inspection/test to be performed.
4.0 SERVICE MANUALS/TOOLSÆQUIPMENT: The SAVAHCS shall not provide tools, (test) equipment, service manuals or service diagnostic software to the contractor. The contractor shall obtain, have on file, and make available to its FSE's all operational and technical documentation (such as: operational and service manuals, schematics, and parts lists) which are necessary to meet the performance requirements of this contract. The location and listing of the service data manuals, by name, and/or the manuals themselves shall be provided to the CO or COR upon request.
5.0 CLEANING, LUBRICATION AND ADJUSTMENT SERVICES: When, and as required, motors, generators, controllers, valves, pumps, tanks, jack units, relay panels, selectors, leveling devices, operating devices, signal devices, switches on car and in hoist way, hoist way door and car door or gate operating device, interlocks and contacts, guide shoes, guide grooves in hoist way and car door sills, hangers for all doors and/or gates, signal system, car safety devices, governors, tension frames and sheaves in pit shall be cleaned, lubricated and adjusted. Hoist motor and generator brushes shall be cleaned, lubricated and adjusted. Hoist motor and generator brushes shall be checked for wear at least every two weeks. Accumulated carbon dust shall be removed from commutators, brush rigs and windings at the same time. Cleaning and refinishing of interior of cars and exterior hoist way frames and doors are excluded. Underground portions of the hydraulic jack unit are excluded.
5.1 CLEANING SERVICES: Guide rails, overhead sheaves and beams, counterweight frames, tops of cars, bottoms of platforms, elevator pits, and machine room floors shall be brushed clean and rubbish removed at least once a month. A complete cleaning of the entire installation including all machine room equipment, hoist way equipment, machine room floors and walls, hoist way walls, supporting structures, etc. shall be accomplished once per year. The Contractor shall furnish all necessary cleaning supplies, vacuum cleaners, etc.
5.2 LUBRICATION SERVICES: All sheave, machine, and motor bearing and hoisting ropes shall be lubricated, machine stuffing box and bearing on motor-operated brakes shall be repacked and gear cases and guide lubricators shall be refilled when required. Hydraulic fluid sufficient to maintain the best operating levels shall be furnished on all hydraulic elevators.
5.3 ADJUSTMENT SERVICES: All hoisting ropes shall be examined, and the tension equalized. Whenever necessary to insure maintenance of adequate safety factors, all hoisting ropes and governor ropes shall be replaced. The exterior of the machinery and any other parts of the equipment subject to rust shall always be kept properly painted and presentable. The motor windings shall be kept free of rust and carbon dust. Guide shoe rollers and gibes shall be renewed as required to insure smooth, stable, and satisfactory operation. All electrical wiring and conductors extending to elevators and dumbwaiters from circuit breakers and main line switches in machine rooms and from outlets in the hoist ways shall be repaired and/or replaced when required. Circuit breakers or main line switches, together with fuses for same, are excluded.
6.0 MATERIALS TO BE FURNISHED: The Contractor shall furnish all lubricants, hydraulic fluid, cleaning supplies, parts and tools necessary to perform the work described above. All lubricants shall be recommended by the manufacturer of the equipment.
7.0 PARTS TO BE FURNISHED AND INSTALLED OR REPAIRED: The Contractor shall furnish and install or repair when and as necessary, machine, hydraulic pumps, motor generators, controllers, selectors, worms, gears, thrusts, windings, commutators, hydraulic pumps, "VEE" belts and pulleys, hydraulic valve components and coils, circuits, magnet frames, hoist and governor ropes, relays, contactors, control fuses, resistors, cams, car door and hoist way door hangers, tracks and door guides, door operating devices, door gibes, interlocks and contacts, car gates, safety devices, governors, car and hoist way lighting, car flooring, push bottoms, annunciators, hall lanterns and indicators, lamp replacement in signal systems and all other elevator signal and accessory equipment complete. Contractor shall furnish, install or repair parts and/or make renewals as necessitated by reason of normal use, misuse, equipment malfunction, and wear and tear by all parties.
8.0 VANDALISM: Repair caused by proven vandalism will be billed at cost and reimbursed by the SAVAHCS. Approval by the COR of all vandalism repairs is required prior to the work being done. The Contractor shall provide the COR with a detailed cost report of the work to be done. The COR will receive the detailed cost report prior to authorizing the work and the billing will be on a separate detailed invoice. Vandalism is defined as an intentional act to damage, deface or destroy.
9.0 EMERGENCY CALLBACK SERVICE: Prompt emergency callback and repair service shall be provided within two hours in response to requests by telephone or otherwise from the COR or designee, in case of a shut down or if emergency trouble should develop between regular inspections. This callback and repair service shall be rendered at any hour of the day and is included in the rates established in the price schedule, excluding mechanic overtime hourly rates. Emergencies are defined as any malfunction in elevator service rendering more than one elevator car inoperable or any unsafe or hazardous condition.
10.0 REPORT OF SERVICES: Upon completion of the services, the Contractor's FSE shall report to the COR or designee and a written report of services performed shall be furnished to the COR or designee. Such reports shall advise of any repairs or repair parts required to be furnished under the contract that are necessary to maintain the equipment in proper operating condition. The report shall detail the work performed, and include action taken to correct malfunctions and the parts used.
11.0 RECORDS: The Contractor shall maintain a complete orderly and chronological file including drawings, complete parts lists, and copies of all reports as required by these specifications. A record of all difficulties experienced during preventive maintenance and/or emergency callback services, and the corrective measures taken to eliminate these difficulties. This file shall be available for inspection upon request, and a copy of this complete file will be furnished to the SAVAHCS during the last month of the contract period. The Contractor shall be required to maintain current drawings and schematics of the elevator systems, including wiring diagrams. A copy of these drawings, schematics, and wiring diagrams will be maintained and left at the end of this contract in the appropriate elevator rooms. Any documents required that are missing shall be furnished by the Contractor at his expense.
11.1 The documentation shall include detailed descriptions of the scheduled and unscheduled maintenance and repair procedures performed, including replaced parts, required to maintain the equipment in accordance with the manufacturer's specifications. Such documentation shall meet the guidelines as set forth in the conformance standards section. In addition, each ESR shall, at a minimum, document the following data legibly and in complete detail:
a. Name of contractor.
b. Name of FSE who performed services.
c. Contractor service ESR number/log number.
d. Date, time (starting and ending), equipment downtime, and hours on-site for service call.
e. Description of problem reported by COR/user (if applicable).
f. Identification of equipment to be serviced: inventory ID number, manufacturer's name, device name, model number, serial number, and any other manufacturer's identification numbers.
g. Itemized description of the service performed including: labor and travel, parts (with part numbers) and materials and circuit location of problem/corrective action. All modifications of the electrical wiring shall be indicated on SAVAHCS 's master printer copies.
h. Signatures: FSE performing services described and SAVAHCS employee who witnessed service described.
NOTE: any additional charges claimed must be approved by the CO before service is completed.
12.0 ADDITIONAL CHARGES: There shall be no additional charges for time spent at the site (during, or after normal hours of coverage) awaiting the arrival of additional FSE or delivery of parts.
13.0 REPORTING REQUIRED SERVICES BEYOND THE CONTRACT SCOPE:
The contractor shall immediately, but no later than twenty-four (24) consecutive hours after discovery, notify the CO or COR (in writing) of the existence of the development of any defects in, or repairs required, to the scheduled equipment which the Contractor considers not covered under the terms of the contract. The Contractor shall furnish the CO or COR, with a written estimate of the cost to make the necessary repairs.
14.0 CONDITION OF EQUIPMENT: The contractor accepts responsibility for the equipment described in the price schedule in "as is" condition. Failure to inspect the equipment prior to contract award shall not relieve the contractor from performance of the requirements of this contract.
15.0 COMPETENCY OF PERSONNEL SERVICING EQUIPMENT:
15.1The Contractor shall have an established business, with an office and full-time staff. The staff includes a "fully qualified" FSE and a "fully qualified" FSE who shall serve as the backup.
15.2"Fully Qualified" is based upon training and on experience in the field. For training the FSE(s) has successfully completed a formalized training program, for the equipment identified in the schedule. The contractor shall provide proof of FSE successful completion of a recognized elevator mechanic training program. For field experience, with respect to scheduled and unscheduled preventive and remedial maintenance, on older model elevators of the type at this facility.
15.3 The FSE(s) shall be authorized by the Contractor to perform the maintenance services. All work shall be performed by "fully qualified" and competent FSEs. The contractor shall provide documentation of the competency of their personnel and a list of credentials of approved FSEs for each make and model the contractor services at the SAVAHCS. The contractor shall provide copies of the FSE training certificates and/or credentials for any personnel who are servicing or installing any SAVAHCS equipment. The FSE / Certified Elevator Mechanic must have at a minimum Five (5) years of experience in the maintenance and repair of elevators, one year of which must have been at the journey-level.
The contractor shall provide a copy of the FSE resume. The CO or COR specifically reserves the right to reject any of the contractor's personnel and refuse them permission to work on the SAVAHCS equipment.
15.4 If subcontractor(s) are used, they must be approved by the CO; the contractor shall submit any proposed change in subcontractor(s) to the CO for approval/disapproval.
16.0 TEST EQUIPMENT: Prior to commencement of work on this contract, the contractor shall provide the SAVAHCS with a copy of the current calibration certification of all test equipment, which is to be used by the contractor in performance of the contract. This certification shall also be provided on a periodic basis when requested by the SAVAHCS. Test equipment calibration shall be traceable to a national standard.
17.0 CONTRACT ADMINISTRATION DATA: The contracting officer is the only person authorized to approve changes or modify any of the requirements under this contract. Only the contracting officer is authorized to make commitments or issue changes which will affect price, quantity, or quality of performance of this contract. In the event the contractor effects any such change at the direction of any person other than the contracting officer, the change shall be considered to have been made with authority and no adjustment will be made in the contract price to cover any increase in costs incurred as a result thereof.

20.0 Quality Assurance: The government shall evaluate the contractor's performance under this contract in accordance with the Performance Metrics (Attachment A). The Performance Metrics is primarily focused on what the Government must do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the method of surveillance, and the minimum acceptable performance threshold(s).
20.1 Quality Control: The contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with accepted commercial practices and this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor's quality control program is the means by which he assures himself that his work complies with the requirements of the contract. A proposed Quality Control Plan shall be submitted within the contractor's proposal.
Conformance Standards:
Contract service shall ensure that the equipment functions in conformance with the latest published edition of the applicable standards, such as: NFPA-99, UL, OSHA, VA, CDRH, etc. and the “Manufacturer's Performance standards/ specifications” as used when the equipment was originally procured and that any upgrades/updates will meet the stated standards/specifications. All maintenance and repair on included equipment shall conform to the following; ASME A17.1 Safety Codes for Elevators and Escalators, Latest Edition; ASME A17.2 Inspector's Manual for Elevators and Escalators, Latest Edition; and ASNI/NFPA 70 National Electrical Code, Latest Edition; and Manufacturer's requirements and specifications.
Hours of Coverage:
A. Normal hours of coverage are Monday through Friday from 8:00 am to 4:30 pm, excluding holidays. All regular service/repairs shall be performed during normal hours of coverage unless requested or approved by the COR or his/her designee. Unscheduled maintenance hours of coverage are twenty-four (24) hours per day, seven days per week when more than one elevator is inoperable.
B. Preventive maintenance will be performed as scheduled by the Contracting Officers Representative (COR) or their designee. Preventive maintenance will be performed during normal hours of coverage.
C. Work performed outside the normal hours of coverage must be approved by the COR or his/her designee. Funding for services that are outside the normal coverage hours or on holidays must be approved prior to any service being allowed.
NOTE: Hardware/software update/upgrade installations will be scheduled and performed during normal hours of coverage at no additional charge to the government.

Identification, Parking, Smoking, and VA Regulations:
The contractor's FSEs shall always wear visible identification while on the premises of the SAVAHCS. It is the responsibility of the contractor to park in the appropriate designated parking areas. Information on parking is available from the VA Police and Security Service. The SAVAHCS shall not invalidate or make reimbursement for parking violations of the contractor under any conditions. Smoking is prohibited inside any buildings at the SAVAHCS. Possession of weapons is prohibited. Enclosed containers, including tool kits, shall be subject to search. Violations of VA regulations may result in citation answerable in the United States (Federal) District Court, not a local district, state, or municipal court.
Information Security:
In accordance with Appendix A, Handbook 6500.6 Checklist blocks 7, the C&A requirements do not apply to this requirement, and Security Accreditation Package is not required. The nature of this requirement is technical; however, there is no information to be protected.

C.1 52.203-16 PREVENTING PERSONAL CONFLICTS OF INTEREST DEC 2011
(a) Definitions. As used in this clause— "Acquisition function closely associated with inherently governmental functions" means supporting or providing advice or recommendations with regard to the following activities of a Federal agency:
(1) Planning acquisitions.
(2) Determining what supplies or services are to be acquired by the Government, including developing statements of work.
(3) Developing or approving any contractual documents, to include documents defining requirements, incentive plans, and evaluation criteria.
(4) Evaluating contract proposals.
(5) Awarding Government contracts.
(6) Administering contracts (including ordering changes or giving technical direction in contract performance or contract quantities, evaluating contractor performance, and accepting or rejecting contractor products or services).
(7) Terminating contracts.
(8) Determining whether contract costs are reasonable, allocable, and allowable.
"Covered employee" means an individual who performs an acquisition function closely associated with inherently governmental functions and is—
(1) An employee of the contractor; or
(2) A subcontractor that is a self-employed individual treated as a covered employee of the contractor because there is no employer to whom such an individual could submit the required disclosures.
"Non-public information" means any Government or third-party information that—
(1) Is exempt from disclosure under the Freedom of Information Act (5 U.S.C. 552) or otherwise protected from disclosure by statute, Executive order, or regulation; or
(2) Has not been disseminated to the general public and the Government has not yet determined whether the information can or will be made available to the public.
"Personal conflict of interest" means a situation in which a covered employee has a financial interest, personal activity, or relationship that could impair the employee's ability to act impartially and in the best interest of the Government when performing under the contract. (A de minimis interest that would not "impair the employee's ability to act impartially and in the best interest of the Government" is not covered under this definition.)
(1) Among the sources of personal conflicts of interest are—
(i) Financial interests of the covered employee, of close family members, or of other members of the covered employee's household;
(ii) Other employment or financial relationships (including seeking or negotiating for prospective employment or business); and
(iii) Gifts, including travel.
(2) For example, financial interests referred to in paragraph (1) of this definition may arise from—
(i) Compensation, including wages, salaries, commissions, professional fees, or fees for business referrals;
(ii) Consulting relationships (including commercial and professional consulting and service arrangements, scientific and technical advisory board memberships, or serving as an expert witness in litigation);
(iii) Services provided in exchange for honorariums or travel expense reimbursements;
(iv) Research funding or other forms of research support;
(v) Investment in the form of stock or bond ownership or partnership interest (excluding diversified mutual fund investments);
(vi) Real estate investments;
(vii) Patents, copyrights, and other intellectual property interests; or
(viii) Business ownership and investment interests.
(b) Requirements. The Contractor shall—
(1) Have procedures in place to screen covered employees for potential personal conflicts of interest, by—
(i) Obtaining and maintaining from each covered employee, when the employee is initially assigned to the task under the contract, a disclosure of interests that might be affected by the task to which the employee has been assigned, as follows:
(A) Financial interests of the covered employee, of close family members, or of other members of the covered employee's household.
(B) Other employment or financial relationships of the covered employee (including seeking or negotiating for prospective employment or business).
(C) Gifts, including travel; and
(ii) Requiring each covered employee to update the disclosure statement whenever the employee's personal or financial circumstances change in such a way that a new personal conflict of interest might occur because of the task the covered employee is performing.
(2) For each covered employee—
(i) Prevent personal conflicts of interest, including not assigning or allowing a covered employee to perform any task under the contract for which the Contractor has identified a personal conflict of interest for the employee that the Contractor or employee cannot satisfactorily prevent or mitigate in consultation with the contracting agency;
(ii) Prohibit use of non-public information accessed through performance of a Government contract for personal gain; and
(iii) Obtain a signed non-disclosure agreement to prohibit disclosure of non-public information accessed through performance of a Government contract.
(3) Inform covered employees of their obligation—
(i) To disclose and prevent personal conflicts of interest;
(ii) Not to use non-public information accessed through performance of a Government contract for personal gain; and
(iii) To avoid even the appearance of personal conflicts of interest;
(4) Maintain effective oversight to verify compliance with personal conflict-of-interest safeguards;
(5) Take appropriate disciplinary action in the case of covered employees who fail to comply with policies established pursuant to this clause; and
(6) Report to the Contracting Officer any personal conflict-of-interest violation by a covered employee as soon as it is identified. This report shall include a description of the violation and the proposed actions to be taken by the Contractor in response to the violation. Provide follow-up reports of corrective actions taken, as necessary. Personal conflict-of-interest violations include—
(i) Failure by a covered employee to disclose a personal conflict of interest;
(ii) Use by a covered employee of non-public information accessed through performance of a Government contract for personal gain; and
(iii) Failure of a covered employee to comply with the terms of a non-disclosure agreement.
(c) Mitigation or waiver. (1) In exceptional circumstances, if the Contractor cannot satisfactorily prevent a personal conflict of interest as required by paragraph (b)(2)(i) of this clause, the Contractor may submit a request through the Contracting Officer to the Head of the Contracting Activity for—
(i) Agreement to a plan to mitigate the personal conflict of interest; or
(ii) A waiver of the requirement.
(2) The Contractor shall include in the request any proposed mitigation of the personal conflict of interest.
(3) The Contractor shall—
(i) Comply, and require compliance by the covered employee, with any conditions imposed by the Government as necessary to mitigate the personal conflict of interest; or
(ii) Remove the Contractor employee or subcontractor employee from performance of the contract or terminate the applicable subcontract.
(d) Subcontract flowdown. The Contractor shall include the substance of this clause, including this paragraph (d), in subcontracts—
(1) That exceed $150,000; and
(2) In which subcontractor employees will perform acquisition functions closely associated with inherently governmental functions (i.e., instead of performance only by a self-employed individual).

C.2 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)
The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days.

C.3 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)
(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed five (5) years and six months.

C.4 SUPPLEMENTAL INSURANCE REQUIREMENTS
In accordance with FAR 28.307-2 and FAR 52.228-5, the following minimum coverage shall apply to this contract:
(a) Workers' compensation and employers liability: Contractors are required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 is required, except in States with exclusive or monopolistic funds that do not permit workers' compensation to be written by private carriers.
(b) General Liability: $500,000.00 per occurrences.
(c) Automobile liability: $200,000.00 per person; $500,000.00 per occurrence and $20,000.00 property damage.
(d) The successful bidder must present to the Contracting Officer, prior to award, evidence of general liability insurance without any exclusionary clauses for asbestos that would void the general liability coverage.
(End of Clause) C.5 VAAR 852.219-11 VA NOTICE OF TOTAL VETERAN-OWNED SMALL BUSINESS SET-ASIDE (JUL 2016)(DEVIATION)
(a) Definition. For the Department of Veterans Affairs, “Veteran-owned small business or VOSB.”—
(1) Means a small business concern—
(i) Not less than 51 percent of which is owned by one or more veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans;
(ii) The management and daily business operations of which are controlled by one or more veterans;
(iii) The business meets Federal small business size standards for the applicable North American Industry Classification System (NAICS) code identified in the solicitation document;
(iv) The business has been verified for ownership and control pursuant to 38 CFR 74 and is so listed in the Vendor Information Pages database, (https://www.vip.vetbiz.gov): and
(v) The business will comply with subcontracting limitations in 13 CFR 125.6, as applicable
(2) “Veteran” is defined in 38 U.S.C. 101(2).
(b) General.
(1) Offers are solicited only from verified veteran-owned small business concerns. All service-disabled veteran-owned small businesses are also determined to be veteran-owned small businesses if they meet the criteria identified in paragraph (a)(1) of this section. Offers received from concerns that are not veteran-owned small business concerns shall not be considered.
(2) Any award resulting from this solicitation shall be made to a verified veteran-owned small business concern.
(c) Agreement. A veteran-owned small business concern agrees that in the performance of the contract, the concern will comply with the limitation on subcontracting requirements in 13 CFR §125.6.
(d) A joint venture may be considered a veteran-owned small business concern if the joint venture complies with the requirements in 13 CFR 125.15, provided that any reference therein to SDVO SBC is to be construed to apply to a VA verified SDVOSB and/or VOSB as appropriate.
(e) Any veteran-owned small business concern (non-manufacturer) must meet the requirements in 19.102(f) of the Federal Acquisition Regulation to receive a benefit under this program.
(End of Clause) C.6 VAAR 852.219-74 LIMITATIONS ON SUBCONTRACTING—MONITORING AND COMPLIANCE (JUL 2018)
(a) This solicitation includes VAAR 852.219-11 VA Notice of Total Veteran-Owned Small Business Set-Aside.
(b) Accordingly, any contract resulting from this solicitation is subject to the limitation on subcontracting requirements in 13 CFR 125.6, or the limitations on subcontracting requirements in the FAR clause, as applicable. The Contractor is advised that in performing contract administration functions, the Contracting Officer may use the services of a support contractor(s) retained by VA to assist in assessing the Contractor's compliance with the limitations on subcontracting or percentage of work performance requirements specified in the clause. (c) All support contractors conducting this review on behalf of VA will be required to sign an “Information Protection and Non-Disclosure and Disclosure of Conflicts of Interest Agreement” to ensure the Contractor's business records or other proprietary data reviewed or obtained in the course of assisting the Contracting Officer in assessing the Contractor for compliance are protected to ensure information or data is not improperly disclosed or other impropriety occurs.
