Other Than Full and Open Competition (>SAT)

1. Contracting Activity: Department of Veterans Affairs, Network Contracting Office 22-Gilbert, The

Southern Arizona VA Healthcare System (SAVAHCS), 3601 S. 6th Avenue, Tucson 85723.

2. Nature and/or Description of the Action Being Processed: This procurement is for an on-site Maintenance Technician II in accordance with FAR 6.303-1. The contractor, Stanley Convergent Security Solutions Inc. was originally awarded the contract to design, engineer, and install the current physical security system. Contract 36C25818C0048 awarded 04/20/2018 is a base plus four

(4) years. This procurement will be a firm-fixed price contract to Stanley Convergent Security Solutions, Inc.

3. Description of Supplies/Services Required to Meet the Agency’s Needs: The contractor shall provide SAVAHCS an on-site maintenance technician for all components of the physical security system currently designed, engineered, and installed by Stanley Convergent Security System. The on-site personnel support will include preventive, remedial, and emergency corrective maintenance actions for the existing enterprise security system. This is to include all associated software, peripheral equipment such as card readers, REX motion detectors, door contracts and electronic door hardware. The technical specialist would be required to work two days (8 hours each) per week between 8am – 5pm, Monday thru Friday. This base plus four (4) year contract has a total estimated cost of $462,783.36.

Hours include technician trip charges and travel time between sites. The hours are based on previous support supplied by Stanley Convergent. The above prices are discounted off the Stanley CSS GSA Labor schedule.

4. Statutory Authority Permitting Other than Full and Open Competition:

( X ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1;

FAR13.5 Simplified Procedures for Certain Commercial Items: The authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. 1901 and is implemented by for restricting competition on this procurement via FAR 13.106-1(b)(2).

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority: Although the individual components and software are not proprietary in nature, how they have been integrated and programmed has been tailored specifically by Stanley Security Solutions, Inc. to meet SAVAHCS needs. To ensure the system interoperates correctly requires engineers that are certified on all systems (Lenel Physical Access Control System, and Lighthouse Physical Information Management System) and having system knowledge to program them correctly. Improper programming from a third party without the proper knowledge of system operation could lead to system degradation and require the government to call Stanley Convergence to correct at additional cost. The security system equipment is currently under warranty and any change/replacement parts not used by Stanly Convergence would void that warranty.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Market Research was limited to researching the original Homeland Security task order (GS-07F-298S/HHSP233201500230G) and local contract (36C25818C0048). Tom Dymacek, Senior Federal Account Manager at Stanley Convergent Security Solutions, Inc. discussed how the system was designed and programmed and the ramifications that may occur, and have occurred at other VA Medical Centers when third parties were awarded contracts to service and maintain the system. No further research was conducted due to the system’s complexity, SAVAHCS overall security, and the consequences that may occur if a third-party contractor lacking system knowledge and certifications were awarded the contract.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The price quote from Stanley Convergent Security Solutions, Inc. for Maintenance Technician II is fair and reasonable based on DOL Wage Determination and Stanly CSS Labor Schedule – GS-07F-9298S. See chart below to see comparisons between GS-07F-9298S and quote dated 10/29/2018 from Stanley CSS.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons

Market Research Was Not Conducted: As described in Section 6 above, Market Research was limited to the system’s complexity, SAVAHCS overall security, and the consequences that may occur if a third-party contractor lacking system knowledge and certifications were awarded the contract.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition: The security system must be compliant with Homeland Security Directive 12 that requires all federal agency systems be enabled to use PIV credentials IAW the National Institute of Standards and Technology guidelines. A third-party vendor may not be certified to ensure the current security system stays in compliance.

The current system controls all entry control points (buildings, doors, and gates), intrusion detection systems, and computer access on station that serves up to 3,100 full time employees, and up to 1,500 contractors, visitors, volunteers, and students. Therefore, it is in the best interest of the government to award Stanley Convergent Security Solutions a sole-source firm fixed price contract to provide an on-site maintenance technician.

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: There were no other sources sought due to the system’s complexity and the negative impact to SAVAHCS’ overall security.

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to

Competition before Making subsequent acquisitions for the supplies or services required:

There are no actions planned due to the Stanley Convergent Security Solutions Inc. awarded contract 36C25818C0048. This contract provides software support for the Physical Access Control/Physical Information System (PACS/PSIM) and a third-party vendor would disrupt this support. Furthermore, a sole source to an SDVOSB is not possible at this point as there could be a negative impact on contract 36C25818C0048 and would void the warranty provided on the current equipment installed.

12.
