B.3 52.212-2 EVALUATION—COMMERCIAL ITEMS (OCT 2014)
a) The Government will award a contract/s resulting from this solicitation to the responsible offeror/s whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The government reserves the right to award on a line item basis based on price. The following factors shall be used to evaluate offers:
1. Price - Price will be evaluated on a line Item basis by extended prices (unit quantity multiplied by unit price).
2. Technical Capability.
2 (a). Evaluation of the demonstration of the ability to deliver radiopharmaceutical STAT orders to the hospital within one (1) hour of the order being placed.
2 (b) Contractor must provide copies of certifications and licenses identifying the ability to provide radiopharmaceuticals in the state of New Mexico.
Award will be made on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-cost factors. Technical proposals shall be evaluated by the Technical Evaluation Team to ensure offerors meet the minimum mandatory factors and standards established for this solicitation. Technical proposals will be evaluated using an "acceptable" or "unacceptable" rating. An acceptable rating indicates the offeror passes (or meets) minimum mandatory requirement. An unacceptable rating indicates the offeror fails to meet minimum mandatory requirement. A rating of unacceptable for any factor will result in an overall rating of "unacceptable" for the technical factor. Proposals receiving a rating of "unacceptable" will be excluded from competition. Only those proposals determined to be technically acceptable shall receive further consideration for award.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
