5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

CardioNet can provide the products and services required. CardioNet is licensed and active in every state and has a current FIPS 140-2 validation. Market research was conducted using Internet, GSA, and VIP database to find an SDVOSB or VOSB contractor. The search did not produce any capable contractors. FPDS-NG resulted in other acquisition requirements for other agencies including the VA being awarded to CardioNet (CardioNet and LifeWatch are owned by BioTel Heart). The GSA contract has expired and the new contract, once awarded, will only include products, not services.

The VIP database query resulted in 102 contractors registered under NAICS 621511, but those contractors do not offer real time ambulatory cardiac monitoring services.

Unusal and Compelling Urgency (FAR 6.302-2) – Accordingly, a situation exists where an unusual and compelling urgency precludes full and open competition and delay in award of a contract would result in serious injury, financial or other, to the Government.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:

Internet searches, phone calls, GSA, FPDS-NG, and the VIP database were utilized to conduct market research and did not produce any capable contractors.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and

Reasonable:

The ambulatory electrocardiogram (EKG) monitoring and data processing is critical for continuous patient care at the PVAHCS. It is imperative that the services continue in order to preserve the critical services required. The equipment and real time monitoring required can be obtained from CardioNet LLC. As a result, this requirement and the estimated cost based on the submitted quote provided has been determined to represent the best value to the government.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons

Market Research Was Not Conducted:

Market research conducted included internet searches and phone calls made to several companies to gather information about the equipment used for ambulatory electrocardiogram (EKG) monitoring. Internet searches, phone calls, GSA, FPDS-NG, and the VIP database were also utilized to conduct market research and did not produce any capable contractors.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition:

None.

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:

CardioNet LLC provided pricing in response to the COR’s initial request.
