About this file

This is a Special Notice of Intent to Award a Sole Source Contract from the Department of Veterans Affairs (VA), Network Contracting Office 17 (NCO 17), on behalf of VISN 17 Center of Excellence in Waco, Texas. The VA intends to award a Firm Fixed Price purchase order to Agilent Technologies, Inc. for the acquisition of one Agilent Seahorse XF Pro Analyzer (Stock No. S7855A/SYS-SE-XFPRO), including software, consumables, and a 5-year extended warranty. The response deadline is July 7, 2026, at 10:00 AM Central Time, with a 10-calendar-day response window from the June 24, 2026 posting date. The place of performance is VISN 17 Center of Excellence at 4800 Memorial Drive, Building 93, Waco, TX 76711, with one-time delivery on an as-soon-as-possible basis. The estimated acquisition value is below the simplified acquisition threshold, and the contract is classified under NAICS Code 334516 (Analytical Laboratory Instrument Manufacturing).

The VA has justified the sole source award under FAR 13.106-1(b) based on the Seahorse XF Pro Analyzer's unique technology as the only commercially available platform capable of simultaneously measuring oxygen consumption rate (OCR) and proton efflux rate (PER) in live cells in real time using a sealed microchamber design. The justification also cites proprietary software (Wave Pro Controller and Seahorse Analytics), exclusive consumables, authorized service restrictions limiting installation and training to licensed Agilent technicians, federal procurement precedent from agencies including the National Institutes of Environmental Health Sciences and National Cancer Institute, and market research confirming no commercially available equivalents exist. All responsible sources are encouraged to submit written capability statements or quotations addressing the technical specifications by the July 7, 2026 deadline to ognian.ivanov@va.gov. Offerors must be registered in the System for Award Management (SAM) at submission and award time. The Contracting Officer is Ognian D. Ivanov, located at 5441 Babcock Road, Suite 302, San Antonio, TX 78240.

SOLE SOURCE AUTHORITY AND JUSTIFICATION

This acquisition is conducted under the authority of Federal Acquisition Regulation (FAR) 13.106-1(b), Soliciting from a Single Source. The estimated value of this acquisition is below the simplified acquisition threshold. The VA has determined that only Agilent Technologies, Inc. can meet the Government's requirements based on the following:

1. Unique Technology – The Agilent Seahorse XF Pro Analyzer is the only commercially available platform capable of simultaneously measuring both oxygen consumption rate (OCR) and proton efflux rate (PER) in live cells in real time using a sealed microchamber and solid-state fluorophore sensor cartridge design. No other manufacturer produces a functionally equivalent system.

2. Proprietary Software and Consumables – The requirement includes Wave Pro Controller software, Seahorse Analytics platform, and integration with Agilent BioTek Cytation imaging systems — all proprietary components exclusive to the Agilent Seahorse ecosystem. These cannot be sourced from alternative vendors.

3. Authorized Service Restriction – Per the Statement of Work, only licensed Agilent Technologies technicians are authorized to install, service, and provide training on this instrumentation. No other vendor is qualified or authorized to perform these functions.

4. Federal Procurement Precedent – Multiple federal agencies — including the National Institutes of Environmental Health Sciences (NIEHS), National Cancer Institute (NCI), U.S. Army DEVCOM-SC, and VA VISN 21 — have each independently documented Agilent Technologies, Inc. as the sole source for Seahorse XF Analyzer platforms and confirmed that no commercially available equivalent exists.

5. Market Research – Market research conducted by NCO 17 confirmed that no other vendor manufactures a live-cell metabolic analysis instrument meeting all technical specifications outlined in the Statement of Work dated June 2026.

OPPORTUNITY FOR COMPETITION / RESPONSE INSTRUCTIONS

This notice is not a request for competitive proposals or quotations. However, all responsible sources that believe they can satisfy this requirement in its entirety are encouraged to submit a written capability statement or quotation to the Contracting Officer no later than July 7, 2026, at 4:00 PM Central Time.

Responses must be submitted in writing and must contain sufficient detail to allow the Government to determine whether the offeror can fully meet the technical requirements specified in the Statement of Work. Capability statements must address each technical specification, including simultaneous OCR/PER measurement, 96-well microplate format, automated compound injection, proprietary software integration, and authorized installation and service capability.

Offerors must be actively registered in the System for Award Management (SAM) at www.sam.gov at the time of response submission and at the time of any potential award. No telephone responses will be accepted. A determination by the Government not to compete this requirement based on responses to this notice is solely within the discretion of the Government.

If no responsive capability statements or quotations are received by the response deadline, the VA intends to proceed with award to Agilent Technologies, Inc.
