About this file

This document is a Justification and Approval (J&A) for Other Than Full and Open Competition for the Department of Veterans Affairs. The sole source procurement is for emergency construction services to repair steam leak damage in the sub-basement of Building 2 at the North Texas Health Care System (NTHCS) in Dallas. The contract will be awarded to JADA Contacting & Construction LLC, a Service-Disabled Veteran-Owned Small Business (SDVOSB), for a firm-fixed price of $287,712.70 with a 30-day performance period. The urgent nature of the repairs stems from significant insulation and equipment damage that poses health and safety risks to veterans, patients, and staff, necessitating immediate action to prevent further deterioration and potential mold growth.

The procurement is being conducted under the statutory authority of "Unusual and Compelling Urgency" (41 USC §3304(a)(2)), with market research confirming JADA Contacting as the most suitable local contractor capable of swift mobilization. The contract will be awarded without competitive bidding due to the emergency conditions, and the contractor has demonstrated the ability to immediately respond and repair the damage. The North Texas VA Medical Center's Maintenance and Operations Chief certified the requirement as a bona fide need, and the procurement has received necessary approvals from the Contacting Officer and the Chief of the Construction Branch.
