About this file
This document is an amendment to a solicitation for medical cylinder gases for the West Texas VA Healthcare System. The purpose of the amendment is to provide answers to questions submitted by offerors. Key details include:
The solicitation is for a Base Plus 4 option year contract to provide medical cylinder gases that conform to United States Pharmacopeia and FDA regulations. The solicitation has a NAICS code of 325210 (Industrial Gas Manufacturing), indicating it is a supply contract. The Government confirms the contractor must comply with Texas Board of Pharmacy licensing requirements. The solicitation will be evaluated on a Lowest Price Technically Acceptable (LPTA) basis, rather than Best Value. The amendment addresses questions related to cylinder inventory, delivery procedures, maintenance requirements, and insurance coverage. Several requirements, such as cylinder manifold systems and contractor records, have been removed based on the questions.

Questions and Answers:
1. Is there a specific purpose for having the Unit of Issue for Cylinder Fills as “EA” instead of “CY?” No specific purpose can use CY if preferred for verbiage. Line items have been revised from “EA” to “CY”.
2. How many VA-Owned Oxygen Size E Cylinders does the VAMC have on its property books? 140 VA-Owned cylinders
3. How are the (5) CBOCs in the HCS supplied with Cylinder Gases being they are not included in this RFQ (possibly VA internal transport)? Contracted Courier transports full/empty cylinders during business hours of 8-4:30pm CT.
4. On average, how many of each VA-Owned Cylinder Oxygen Size E does the VAMC keep on hand at any time? On average 90-95 cylinders
5. Being that the NAICS for this RFQ is 325210 (Industrial Gas manufacturing), please confirm whether this is a Service Contract or a Supply Contract? Service
6. Licensing: Please confirm that the GOV is affirming that the SDVOB Offeror must comply with State of Texas Board of Pharmacy requirements as these are in fact “applicable the contractor?” Licensing is a requirement.
7. Can the GOV please provide examples of “Unscheduled” & “Scheduled” Maintenance as stated in the RFQ? This can be removed, will not require cylinder maintenance.
8. What are the procedures to account for Loss of Use (LOU) costs for Contractor- Owned cylinders lost while in the VA’s possession? PG 11 of 86 in the SOW (Section 8.8) provides language stating that the GOV will pay the replacement value of lost Contractor-Owned cylinders, but it does not state HOW this will be accomplished (e.g., paid for via separate purchase order?).
CO response: if contractor own equipment is in VA’s possession and equipment becomes damage VA will seek to remedy the cost through justification and new PO to pay for the equipment.
9. CYLINDER MANIFOLD SYSTEMS Will the GOV please remove this language as this is highly nonstandard and vendors cannot perform this function due to liability reasons (damaging manifold or entering facility and possibly interacting with patients)? Can be removed.
10. Liability Insurance: How is the GOV going to validate that offerors are properly insured for NAICS 325120/221210 – the actual requirement for this work to comply with the RFQ and not just the $1M dollar value threshold? How do offerors portray to the GOV/Evaluation Committee that they have the correct type of Liability Insurance, and does this credential need to be affirmed at the time of bid submission (if not, an awarded firm could be turned down or not be able to afford this coverage in the amounts the GOV requires, respective to NAICS 325120)? Can be removed.
11. Contractor Records Can the GOV please provide examples of “records” that the Contractor is required to maintain? Can be removed.
12. LPTA Evaluation: What is the GOV’s rationale for evaluating by Lowest Priced Technically Acceptable for a critical veteran hospital function for supply of Medical Oxygen (which is categorized by the FDA as a prescription drug) and not by “best value?” “Best Value” or “Most Advantageous” to ensure the VA receives the best possible offer/service and not just to the offeror with the lowest price who meets the minimum technical requirement. In accordance with FAR 15.101-2, the Government has a high degree of confidence that reviewing the technical proposals of all offerors would not result in the identification of characteristics that would provide value or benefit to the agency. Therefore, LPTA is appropriate.
