About this file
This is a Justification and Approval (J&A) document for other than full and open competition to increase the ceiling on wheelchair and stretcher transportation services contract 36C25722D0049 at the North Texas Veterans Health Care System. The Department of Veterans Affairs Network Contracting Office in San Antonio is requesting the increase under unusual and compelling urgency (FAR 6.302-2) to allow continued 24/7 wheelchair and stretcher patient transportation services at the Dallas VAMC (4500 S Lancaster Rd) and surrounding community clinics.
The incumbent contractor, James E. Bradsher dba Priority Care Transit EMS Central (an SDVOSB), has been determined to be the only responsible source currently established in the local area capable of providing uninterrupted service while a long-term competitive procurement is developed. The J&A allows Option Year 2 to be exercised by December 1, 2024, with the government planning to solicit a competitive follow-on contract within 4-6 months. Market research conducted in September-October 2024 identified other interested contractors, but they would require time to establish local operations, risking a break in critical patient transportation services. The pricing will be determined fair and reasonable through comparison with the existing IDIQ contract rates and Independent Government Estimate.

36C25722D0049 C2 Wheelchair Ambulance Transportation
VHAPG Part 806.3 OFOC Page 2 of 4 Revision: 03 Effective Date: 04/15/24 Acquisition ID#: 36C25722D0049
( ) (6) National Security per 41 USC §3304(a)(6) as implemented by FAR 6.302-6;
( ) (7) Public Interest per 41 USC §3304(a)(7) as implemented by FAR 6.302-7;
Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): This ceiling increase allows NTX VAHCS to continue the use of wheelchair and stretcher services as a method of transportation for critical patient care. Recognizing the needed reviews that are necessary, there is a high risk of a lapse in services. Due to the critical services being provided, a break in service could create mission failure for the NTX VAHCS requirement to provide critical care to patients requiring wheelchair and stretcher patient transportation.
Based upon Unusual and Compelling Urgency per 41 USC §3304(a)(2) as implemented by FAR 6.302-2, it is possible a SDVOSB concern that has been determined to be a responsible source . The incumbent, James E. Bradsher, dba Priority Care Transit EMS Central, an SDVOSB, has been determined to be a responsible source with respect to the performance of this requirement. Using any other contractor could create a break in service, as they will have to establish a base of operations within the area in a short time to ensure continuity of services.
Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Market research was conducted for the current contract’s follow-on in September 2024 to October 2024 to determine sources for the NTX VAMC wheelchair and stretcher patient transportation requirement. During the sources sought notice that was posted on 4 Sept ber 2024, several potential offerors provided capability statements; however, only the incumbent, James E. Bradsher, dba Priority Care Transit EMS Central, is currently established in the area and ready to provide the required services for a incoming option year, as they have the necessary personnel, organization skills, and resources available for continued wheelchair and stretcher patient transportation without interruption to everyday patient care needed. The government intends to solicit a competitive follow-on contract to fulfill a long term resolution within the next 4-6 months.
Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: Prices will be compared to rates found fair and reasonable on Indefinite- Delivery Indefinite-Quantity (IDIQ) contract (36C25722D0049) and the Independent Government Estimate. Prices will be determined fair and reasonable in accordance with FAR 15.404-1(b)(2)(ii).
Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research for the current contract’s follow-on indicates that there are several interested contractors. However, only one is currently established in the local area. The incumbent, James E. Bradsher, dba Priority Care Transit EMS Central, 313 Bluewood Lane, Lake Dallas, Texas 75065, a SDVOSB, can only fulfill this requirement as the logical choice to continue services while the long-term acquisition is completed. James E. Bradsher, has the necessary personnel, organization, skills, and resources established to prevent a break in service. The government intends to solicit a competitive follow-on contract to fulfill a long term resolution within the next 4-6 months.
Any Other Facts Supporting the Use of Other than Full and Open Competition: None.

Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: Given the nature of the authority – which does not require a finding that only one SDVOSB is capable (see FAR 6.302-2 Unusual and compelling urgency) – and the need to ensure no lapse in service in order to avoid a direct negative impact to Veterans health and safety, it is in the Government’s interest to increase the IDIQ ceiling.
A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: At this time, there are no actions that can be taken to remove or overcome barriers that lead to the exception to fair opportunity. The Government will continue to conduct market research to ascertain if there are changes in the marketplace that would enable future action to be competed owever, all future requirements will be competed and handled on a case-by-case basis to determine any future acquisition strategy.
