5. Davis Bacon Act Wage Determination# TX20200243, Modification 2, Building, Revised August 28, 2020 is now attached to Section D of the solicitation.
6. A copy of the administration page and the pricing are attached in Word format.
7. The following answers are provided for questions received from vendors and now are incorporated into the solicitation:
1. Question: I was reaching out to see if we can please receive a bid package for this project.
Answer: The solicitation is available for viewing in its entirety Contract Opportunities at https://beta.sam.gov/opp/499b449a257b4086b1a515688d4da5a6/view?keywords=denton&sor t=-relevance&index=&is_active=true&page=1.
2. Question: As requested, could the government please explain why this CBOC procurement is not set aside for SDVOSB? On or around 2-25-2019 this opportunity was released by Mr. Noel Ramirez as a SDVOSB set-aside (see attached), then for some unknow reason the solicitation was cancelled due to protest or some other political issue unknow to us. At a later date, Mr.
Ramirez re-issued a SS looking for responses from SDVOBs who were interested in this procurement (see attached). Clinovators responded to the market research and I am sure other SDVOSB’s responded as well. That said, under Kingdomware I am not sure how the government could advertise this CBOC as full and open. Can you please clarify?
Answer:
a. The government’s market research indicates that the procurement strategy for this requirement would be to allow for full and open competition.
b. Assuming SS means Sources Sought, the Sources Sought Notice was issued as a part of market research to identify potential sources for the requirement. The Sources Sought Notice is not an actual solicitation.
c. The Kingdomware decision indicates that “VA shall award contracts based upon competition restricted to SDVOSBs or VOSBs when a contracting officer has a https://beta.sam.gov/opp/499b449a257b4086b1a515688d4da5a6/view?keywords=denton&sort=-relevance&index&is_active=true&page=1 https://beta.sam.gov/opp/499b449a257b4086b1a515688d4da5a6/view?keywords=denton&sort=-relevance&index&is_active=true&page=1 reasonable expectation, based on market research, that two or more firms listed as verified in Vendor Information Pages database are likely to submit offers and an award can be made at a fair and reasonable price that offers best value to the United States.”
All of these elements must be true for the Government to restrict competition to SDVOSBs or VOSBs. Based on market research, the Contracting Officer does not have a reasonable expectation that two or more capable SDVOSBs or VOSBs would submit a proposal and that award can be made at a fair and reasonable price for this requirement.
3. Question: Thank you for the Denton CBOC RFP and performance work statement and amendment. What is the due date for questions to the VA?
Answer: The Government did not provide the Denton CBOC RFP and performance work statement and amendment directly to any party, verbally or in writing. The notice and actual solicitation were solely published for viewing in its entirety on Contract Opportunities at https://beta.sam.gov/opp/499b449a257b4086b1a515688d4da5a6/view?keywords=denton&sor t=-relevance&index=&is_active=true&page=1. The due date for all questions and answers was 4PM, CST June 19, 2020.
4. Question: Upon award of the new contract, will the new contractor inherit the patient’s last Primary Care vesting visit and be allowed to bill for that patient up until their next anniversary date?
Answer: Yes.
5. Question: In Section 4.6.3.1 it states that that the contractor shall provide all medications need for administration at the Clinic, including necessary vaccines To ensure we have accurate information to price our proposal, please provide the number of Vaccines, by type as shown in the list below, that was provided to the Denton CBOC Enrolled Veterans in the last 12 months.

As such, please confirm that FAR 52.222-6 applies to any of that work set forth in the Solicitation and that Davis Bacon Act wages should be used for pricing work under Section 4.9.
Please also expressly identify the portion of the work for which the requirements of FAR 52.222- 6 applies, when FAR 52.222-6 will be incorporated into the Solicitation, and which wage determination(s) will be incorporated into the Solicitation so offerors can have the a common basis for pricing the portion of work subject to FAR 52.222-6.
Answer: In accordance with FAR 22.407(a), FAR 52.222-6 through 52.222-15 will be incorporated into the solicitation and added to Section C, Contract Clauses. These clauses are applicable solely to the portion of the solicitation for PACT and a barrier free design compliance.

55. Question: Typically, the RFP section state “Setback distance from the face of the Building's exterior to the protected/defended perimeter (i.e., any potential point of explosion). This means the distance from the Building to the curb or other boundary protected by bollards, planters or other street furniture. Such potential points of explosion may be, but are not limited to, such areas that could be accessible by any motorized vehicle (i.e., street, alley, sidewalk, driveway, parking lot).”
What is the setback distance of the site to the bollards required for physical security? Typically, it is 25 feet, but most clinics in shopping center etc. … do not have spaces that conform to this requirement?
Answer: Either a 25-foot standoff or bollards, planters or other street furniture to impede risk of areas that could be accessible by any motorized vehicle.
