STATEMENT OF WORK

Building 163 Continuous Screening Room Fire Suppression

Description: The Central Texas Veterans Health Care System (CTVHCS) requires the service of additional Fire Suppression Sprinkler protection for 4 new rooms being built in the area of Building 163 located at 1901 S. Veterans Memorial Drive, Temple, Texas 76504 Note: C&A requirements do not apply, and a security Accreditation Package is not required.

Note: All work shall be done according to the Infection Control Risk Assessment (ICRA) specified for the respective areas where work is performed. Plastic sheeting and sticky mats.

Scope of Work:

Building 163 Fire Sprinkler Scope

· Add new dry system to provide sprinkler protection to the 4 new rooms being built for the continuous screening area at Bldg. 163.

· Add new dry pipe valve in mechanical room 1D-108G. The system will be supplied by mechanical tee being added to the 4” main located in the P5 and P6 elevator lobby.

· Any and all new pipes 2” and smaller are to be black schedule 40.

· All grooved fittings to be standard painted grooved paintings.

· All threaded fittings are to be black 125lb cast iron.

· All pendent sprinklers are to be dry type on return, semi-recessed, chrome plated with chrome plated plates.

· All material to be as allowed by NFPA 13.

· All hangers are to be as allowed by FNPA 13.

· All work to be done during normal working hours.

· Drum drips will be exposed on the outside of the building and installed as necessary per code.

Fire Alarm Scope:

· Shop drawing for conduit, updating master print, equipment, wire, and installation labor associated with installing 3 ea. IAMS in Mechanical Room 1D108G to monitor 1 ea. tamper switch and 2 ea. pressure switches.

· 1 ea. red visual inside the storage room and 1 ea. red speaker/visual wall mounted on the outside of the storage room.

1. CONTRACTOR RESPONSIBILITIES: Install new fire suppression sprinkler system at desired location in Bldg. 163 The contractor shall provide all personnel, services, vehicles, transportation, tools, equipment, materials, and supplies and any other item(s) necessary to perform and accomplish the task. The contractor shall be familiar with all the terms, conditions, and requirements herein contained. All work must comply with federal, state and local regulations.

2. SCHEDULE OF WORK: The Contractor shall notify the Construction Team Supervisor, Jaime Cruz, Engineering Building 46E, phone: (254) 813-7947 2 days prior to start of work. The Contractor shall schedule and coordinate work through the COR. Notify the COR of any planned outages 3 business days prior. Services shall start within 2 days from the Notice to Proceed (NTP) date and work shall be completed within 15 days from NTP.

3. HOURS OF WORK: The Contractor shall schedule and coordinate work to accommodate the facility not to interrupt patient care. Work shall be performed during regular work hours and weekend hours. The hours of work are 8:00am to 6:00pm on Monday through Friday. Work is to be performed during and after clinic operations until completion unless approved by the COR.

4. WORKMANSHIP: Work shall be accomplished by Technicians skilled in the trade. All work will be conducted to VA standards and follow guidelines set forth. The Contractor shall ensure that proper protection and barriers are installed to protect equipment, walls, floors, and ceilings through the duration of the project.

5. DAILY PROGRESS REPORTS: The Contractor shall notify Construction Team Supervisor, Mr. Jaime Cruz at completion of work for inspection of workmanship and functionality.

6. WORKING CONDITIONS: The building will be occupied, and Government operations will continue a normal basis for the duration of the contract. The Contractor shall take all precautions to ensure that his operations are conducted in a manner so as not to interfere with the normal operation of the Service. The Contractor shall execute work in a safe manner and shall not subject personnel to unsafe conditions. The Contractor shall provide safety barricades, devices, and equipment to protect personnel and property. Take all precautions to protect the building and its occupants during the service period.

7. BADGES: All Contractors are required to notify Mr. Jaime Cruz on arrival to start work. Contractor badges shall always be worn. The Contractor will provide proof of identification of company representing this service.

8. SITE VISIT: The Contractor shall visit the site to determine the full extent of the work.

· Date: July 15th

· Time: 8:00am

· Location: Outside of Building 163 by the old Emergency Department.

9. DISPOSAL: Disposal of materials and trash are the Contractor’s responsibility.

10. CLEAN-UP: All affected areas will be cleaned and inspected prior to completion. The Contractor shall keep the area picked up and free of debris.

11. TEMPORARY FACILITIES: N/A

12. SAFETY AND FIRE: Contractor shall install fire alarm in accordance with local codes and NFPA by licensed technicians.

13. PERMITS: Contractor required to get any permits that may be are required.

14. WARRANTEE: The contractor shall warrantee work to be free of defects and workmanship for a period of 1 year from date of acceptance.

15. QUALITY ASSURANCE: Mr. Jaime Cruz will inspect all work at completion.

16. SERVICE REPORTS: Service Report and TAB will be provided at the completion of the project.

1. In addition to the days designated as holidays, the Government observes the following days:

It is understood and agreed between the Government and the Contractor that observance of such days by Government personnel shall not otherwise be a reason for an additional period of performance, or entitlement of compensation. In the event the Contractor's personnel work during the holiday, they may be reimbursed by the Contractor, however, no form of holiday or other premium compensation will be reimbursed either as a direct or indirect cost, other than their normal compensation for the time worked.

1. Payment to be made monthly, in arrears, following satisfactory performance by Contractor’s personnel and upon receipt of a properly prepared invoice.

2.2 52.216-1 TYPE OF CONTRACT (APR 1984)

2.3 52.222-5 CONSTRUCTION WAGE RATE REQUIREMENTS—SECONDARY SITE OF THE WORK (MAY 2014) (a)(1) The offeror shall notify the Government if the offeror intends to perform work at any secondary site of the work, as defined in paragraph (a)(1)(ii) of the FAR clause at 52.222-6, Construction Wage Rate Requirements, of this solicitation.

(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.

(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.

(2) The due date for receipt of offers will not be extended as a result of an offeror's request for a wage determination for a secondary site of the work.

2.4 52.225-10 NOTICE OF BUY AMERICAN REQUIREMENT—CONSTRUCTION MATERIALS (MAY 2014)

(a) Definitions. "Commercially available off-the-shelf (COTS) item," "construction material," "domestic construction material," and "foreign construction material," as used in this provision, are defined in the clause of this solicitation entitled "Buy American—Construction Materials" (Federal Acquisition Regulation (FAR) clause 52.225-9).

(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.

(c) Evaluation of offers.

(1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(3)(i) of the clause at FAR 52.225-9.

(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.

(d) Alternate offers.

(1) When an offer includes foreign solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.

(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of the clause at FAR 52.225-9 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.

(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of the clause at FAR 52.225-9 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested—

(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or

(ii) May be accepted if revised during negotiations.

3.2 52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO SURVEILLANCE SERVICES OR EQUIPMENT (DEC 2019) The Offeror shall not complete the representation in this provision if the Offeror has represented that it “does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument” in the provision at 52.204-26, Covered Telecommunications Equipment or Services—Representation, or in paragraph (v) of the provision at 52.212-3, Offeror Representations and Certifications—Commercial Items.

(a) Definitions. As used in this provision— Covered telecommunications equipment or services, critical technology, and substantial or essential component have the meanings provided in clause 52.204–25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition. Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115–232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. 4.2 52.222-36 EQUAL OPPORTUNITY FOR WORKERS WITH DISABILITIES (JUL 2014)

4.3 52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984) ALTERNATE I (APR 1984) The Contractor shall be required to (a) commence work under this contract within 2 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 15 days after receipt of award. 4.4 52.228-13 ALTERNATIVE PAYMENT PROTECTIONS (JULY 2000)

(a) The Contractor shall submit one of the following payment protections:

(b) The amount of the payment protection shall be 100 percent of the contract price.

(c) The submission of the payment protection is required within 2 days of contract award.

(d) The payment protection shall provide protection for the full contract performance period plus a one-year period.

(e) Except for escrow agreements and payment bonds, which provide their own protection procedures, the Contracting Officer is authorized to access funds under the payment protection when it has been alleged in writing by a supplier of labor or material that a nonpayment has occurred, and to withhold such funds pending resolution by administrative or judicial proceedings or mutual agreement of the parties.

(f) When a tripartite escrow agreement is used, the Contractor shall utilize only suppliers of labor and material that signed the escrow agreement.

4.5 52.219-28 POST-AWARD SMALL BUSINESS PROGRAM REREPRESENTATION (MAR 2020)

(a) Definitions. As used in this clause— Long-term contract means a contract of more than five years in duration, including options. However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority.

Small business concern means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (d) of this clause. Such a concern is "not dominant in its field of operation" when it does not exercise a controlling or major influence on a national basis in a kind of business activity in which a number of business concerns are primarily engaged. In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity.

(b) If the Contractor represented that it was any of the small business concerns identified in 19.000(a)(3) prior to award of this contract, the Contractor shall rerepresent its size and socioeconomic status according to paragraph (f) of this clause or, if applicable, paragraph (h) of this clause, upon occurrence of any of the following:

(1) Within 30 days after execution of a novation agreement or within 30 days after modification of the contract to include this clause, if the novation agreement was executed prior to inclusion of this clause in the contract.

(2) Within 30 days after a merger or acquisition that does not require a novation or within 30 days after modification of the contract to include this clause, if the merger or acquisition occurred prior to inclusion of this clause in the contract.

(3) For long-term contracts—

(i) Within 60 to 120 days prior to the end of the fifth year of the contract; and
