Liqui Tech Copper-Silver Ion Service and Water Sampling
General: Contractor to provide as part of the firm-fixed price Contract/PO all labor, equipment, tools, incidental materials, parts and supplies, supervision, and any other items and services necessary to provide system monitoring and analysis, water testing and periodic maintenance to six (6) LiquiTech copper-silver ion generators, installed on the domestic hot water systems of the South Texas Veterans Health Care System, Audie L. Murphy division. Four of these ionization units are located on the main campus; two are located off-site, within two miles of the main campus.
Description of Work: Copper silver ionization is a dynamic process that provides systemic protection from waterborne pathogens. This is achieved by the controlled release of copper and silver ions into the domestic hot water system. Each unit consists of an electronic controller, an electronic flow meter, a remote supervisory monitoring device and two flow cells containing copper-silver sacrificial bars. The systems require on-going monitoring, water sampling and maintenance to effectively control these pathogens. Each system requires monitoring and analysis, requiring system status reporting, adjustments to system, alarm resolution, copper handheld testing and analysis, copper silver lab testing and analysis, and periodic maintenance to the electronic controller and flow cell. Submittals of proposed systems monitoring, water sampling methodology and maintenance procedures will be required, for approval by VA.
The contractor will provide continuous remote monitoring of each system, reporting system status, adjust the system as needed, and resolve all alarms and analysis of the results from copper handheld testing of the water.
On a monthly basis, the contractor will replace the in-use flow cell with the spare cell, then clean, descale and decalcify the cell that was removed, preparing it for next month's replacement.
On a monthly basis, the contractor will inspect and record each electronic controller's readings and recalibrate the controller as needed so that the system is operating at manufacturer's specifications. The monitoring method and the recording and analysis of these reading will be accomplished in accordance with the manufacturer's recommendation, as outlined in LiquiTech's Installation and Operation manual, section 9.1, Operational Log Sheet.
On a monthly basis, contractor will collect and send to a third-party testing lab, water samples from twenty-six
(26) distal sites for analysis, to include residual levels of copper and silver. The laboratory utilized by the contractor will be qualified for sampling water in a method that provides residual levels of copper and ion. The distal sites will be determined by
VA.
On a monthly basis, the contractor will provide a site visit by an engineer qualified in water treatment and sampling. This may be accomplished at the same time the monthly maintenance is performed.
On an annual basis, contractor will rebuild each flow cell, replacing the silver bars if needed. Contractor will completely disassemble the flow cell, removing the bars from cell, check the bars for wear, replace all electrical wiring, clean and polish each electrode, replace hardware as needed, reinstall electrodes to manufacturer's specification, optimizing electrode positioning for proper ionization, then reassemble and seal flow cell. If the electrode bars no longer meet the manufacturer's specification, the contractor will replace the used electrodes with new bars purchased by contractor from the manufacture. Each cell must be rebuilt and returned to VA is less than 30 days so that it can replace cell that's in-use, which will then be rebuilt by the contractor. As noted above, each system has two copper-silver ionization cells, for a total of 24 rebuilt or replaced flow cell per contract year.
All systems' data, lab results and analysis of these results will be available to VA at all times.

Hours of Performance: Hours of work for technical support, training, and maintenance are defined as Monday through Friday from 8:00 a.m. to 5:00 p.m., excluding federal holidays or as otherwise arranged with the Contracting Officer Technical Representative (COTR). The ten holidays observed by the Federal Government are New Year's Day, Martin Luther King Day, and President's Day, Memorial Day, Independence Day, Labor Day, Columbus Day, Veteran's Day, Thanksgiving Day, and Christmas Day. Also, any other day declared by the President of the United States to be a national holiday.
Check in Requirements: The Contractor will not need to obtain a badge or sign in.
Period of Performance: Period of performance shall be for one (1) base year from 1 July 2020 – 30 June 2021 and four (4) optional years.
Place of Performance: The contractor shall furnish all necessary equipment, labor and material to provide monthly LiquiTech maintenance water sampling for the Department of Veterans Affairs (VA), South Texas Veterans Health Care System (STVHCS). Services will be provided at the following locations:
• Audie L. Murphy, 7400 Merton Minter, San Antonio, TX 78229.
• Polytrauma Rehabilitation Program (PTRP) Facility, 4949 Gus Eckhert, San Antonio, TX 78240
• Fisher House, 7485 Wurzbach Rd, San Antonio, TX 78229.
Contracting Officer Technical Representatives: Prior to contract award, the Contracting Officer shall designate a VA Medical Center employee as the COR. All work coordination shall be made through the COR. The Contractor shall be provided a copy of the letter of delegation authorizing the COR at the commencement of the term of the contract. No other person shall be authorized to act in such capacity unless appointed in writing by the Contracting Officer.
Confidentiality and Non-Disclosure: The preliminary and final deliverables, and all associated working papers, application source code, and other material deemed relevant by VA which have been generated by the contractor in the performance of this task order, are the exclusive property of the U.S. Government and shall be submitted to the CO at the conclusion of the task order.
The CO will be the sole authorized official to release, verbally or in writing, any data, draft deliverables, final deliverables, or any other written or printed materials pertaining to this task order. No information shall be released by the contractor. Any request for information relating to this task order, presented to the contractor, shall be submitted to the CO for response.
Information technology security requirements: The contractor, their personnel, and their subcontractors shall be subject to the Federal laws, regulations, standards, and VA Directives and Handbooks regarding information and information system security as delineated in this contract. The contractor shall comply with all Federal laws and regulations the VA has developed when VA sensitive information is accessed, used, stored, generated, transmitted, or exchanged by and between VA and a contractor. The information made available to the contractor by VA for the performance of this contract will be used only for the purposes of performance under this contract. The certification and accreditation requirements do not apply to this requirement and a security accreditation package is not required.
Information Systems Officer, Information Protection: The contractor will have access to VA Desktop computers and access to online resources belonging to the government while conducting services.
Privacy Officer: The contractor will not have access to Patient Health Information (PHI) nor will they have the capability of accessing patient information during the services provided to the VA.
Safety Requirements: In the performance of this contract, the Contractor shall take such safety precautions as the Contracting Officer may determine to be reasonably necessary to protect the lives and health of occupants of the building. The Contracting Officer shall notify the Contractor of any safety issues and the action necessary to correct these issues. Such notice, when served to the Contractor or his representative at the work site shall be deemed sufficient for the corrective actions to be taken. If the Contractor fails or refuses to comply promptly, the Contracting Officer may issue an order stopping all or part of the work, and hold the Contractor in default.
Records Manager: There will be no federal records created, maintained, used or dispositional with this contract; regardless of format [paper, electronic, etc.] or mode of transmission [e-mail, fax, etc.].

C.1 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)
The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days of contract expiration.

C.2 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR
2000)
(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days of contract expiration; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed five (5) years.

FEDERAL HIRES
The information provided in this clause is for informational purposes only and is not a wage determination. This is not an all-inclusive list, but only a representative list of federal service employees that could be employed under this contract. This clause also states the wages and fringe benefits payable to each if they were employed subject to the provisions of 5 U.S.C. 5341 or 5332 (i.e., GS/WG federal employee). It is the contractor’s responsibility to determine the human capital required to execute the terms of the contract. Likewise, contractors are responsible for confirming with DOL that they are using the appropriate wage determination for the employees they use in the performance of this contract and it is the contractor’s responsibility to ensure employees are paid in accordance with the appropriate classification as determined by DOL.

C.7 SUPPLEMENTAL INSURANCE REQUIREMENTS
In accordance with FAR 28.307-2 and FAR 52.228-5, the following minimum coverage shall apply to this contract:
(a) Workers' compensation and employer’s liability: Contractors are required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 is required, except in States with exclusive or monopolistic funds that do not permit workers' compensation to be written by private carriers.
(b) General Liability: $500,000.00 per occurrences.
(c) Automobile liability: $200,000.00 per person; $500,000.00 per occurrence and $20,000.00 property damage.
(d) The successful bidder must present to the Contracting Officer, prior to award, evidence of general liability insurance without any exclusionary clauses for asbestos that would void the general liability coverage.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

E.1 52.204-24 REPRESENTATION REGARDING CERTAIN
TELECOMMUNICATIONS AND VIDEO SURVEILLANCE SERVICES OR
EQUIPMENT (DEC 2019)
The Offeror shall not complete the representation in this provision if the Offeror has represented that it “does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument” in the provision at 52.204-26, Covered Telecommunications Equipment or Services—Representation, or in paragraph (v) of the provision at 52.212-3, Offeror Representations and Certifications—Commercial Items.
(a) Definitions. As used in this provision—
Covered telecommunications equipment or services, critical technology, and substantial or essential component have the meanings provided in clause 52.204–25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition. Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115–232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Contractors are not prohibited from providing—
(1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for “covered telecommunications equipment or services”.
(d) Representation. The Offeror represents that it [ ] will, [ ] will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation.
(e) Disclosures. If the Offeror has represented in paragraph (d) of this provision that it “will” provide covered telecommunications equipment or services, the Offeror shall provide the following information as part of the offer— https://www.sam.gov/
(1) A description of all covered telecommunications equipment and services offered (include brand; model number, such as original equipment manufacturer (OEM) number, manufacturer part number, or wholesaler number; and item description, as applicable);
(2) Explanation of the proposed use of covered telecommunications equipment and services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b) of this provision;
(3) For services, the entity providing the covered telecommunications services (include entity name, unique entity identifier, and Commercial and Government Entity (CAGE) code, if known);
and
(4) For equipment, the entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the OEM or a distributor, if known).
