VHAPM Part 813.106 Page 1 of 1 Original Date: 08/30/17
DEPARTMENT OF VETERANS AFFAIRS
Justification for Single Source Awards IAW FAR 13.106-1 For
Over Micro-Purchase Threshold but Not Exceeding the SAT ($150K)
Acquisition Plan Action ID: VA257-18-AP-4604
1. Contracting Activity: Department of Veterans Affairs, Network Contracting Office (NCO 17), VISN 17, North Texas Veterans Healthcare System, Surgical Service.
Purchase Request No. 549-18-2-084-0074
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:
The North Texas Veterans Healthcare System Surgical Services has a need for Neuromed Biotronic NeuroNetwork Monitoring Services to be provided to Veteran beneficiaries. This is a short-term requirement to provide continued neurological monitoring services for surgical procedures. Services are required for a six (6) month period, April 1, 2018 through September 30, 2018. Total estimated contract value $ 102,550.00.
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:
This requirement is being procured in accordance with FAR Part 6.302-2, Unusual and Compelling Urgency, from NuVasive Clinical Services Monitoring, Inc. Due to the need to continue to provide neurological monitoring services for surgical procedures it is in the Government’s best interest to procure these services from NuVasive Clinical Services Monitoring, Inc. NuVasive Clinical Services Monitoring, Inc. is currently providing the required services under contract, which expires March 31, 2018. The need to procure these services from NuVasive Clinical Services Monitoring, Inc. would ensure that surgical procedures for Veteran patients requiring neurological monitoring are not delayed. The services required by this procurement are essential to direct patient care and therefore, must be continued without interruption. The existing contract will expire March 31, 2018; therefore, it is essential to continue to provide the neurological monitoring services through a short term contract for the period April 1, 2018 through September 30, 2018, until the long term contract is awarded.
Pricing is determined to be fair and reasonable as the pricing is the same the expiring contract. Pricing has been at these same rates all five (5) years of the expiring contract.
It is anticipated that the long term contract will be awarded no later than November 1, 2018.
4. Description of market research conducted and results or statement why it was not conducted:
Due to the urgency of this requirement market research is not required to be conducted.
5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
