| # | Question | |||
| # | Question | Answer | ||
| 36C25624R0018 0001 | 1 | Is there an incumbent currently performing the work? | ||
| If so, what is the current contract number? | No, there is no current incumbent for this requirement, nor is there any procurement history for this requirement. | |||
| 36C25624R0018 0001 | 2 | Regarding 52.219-14 Limitations on Subcontracting | Percentage of Work Requirement: How does the 50% work requirement apply in a multi-state contract? Are there different considerations given the geographical spread and the need for multiple subcontractors? | The place(s) of performance is completely irrelevent regarding 52.219-14 compliance. There are no variances of consideration given the geographical spread and the potential need for multiple subcontractors. |
See 52.219-14(e)(1): it [you] will not pay more than 50 percent of the amount paid by the Government for contract performance to subcontractors that are not similarly situated entities [under the solicitation NAICS code [621910]]. Any work that a similarly situated entity further subcontracts will count towards the prime contractor's 50 percent subcontract amount that cannot be exceeded.
| 36C25624R0018 0001 | 3 | Regarding 52.219-14 Limitations on Subcontracting | Subcontracting Across States: Are there any specific requirements or limitations on subcontracting services across state lines that we should be aware of? | There are no additional limitations on subcontracting solely because services cross state lines. State lines are not within the scope of subcontracting limitations nor compliance. See Answer to Question #2, above. |
| 36C25624R0018 0001 | 4 | Regarding 52.219-14 Limitations on Subcontracting | How is compliance with this clause measured and monitored, particularly in a project of this scale? | 13 CFR 125.6(f)(4) Contracting Officers may, at their discretion, require the contractor to demonstrate its compliance with the limitations on subcontracting at any time during performance and upon completion of a contract if the information regarding such compliance is not already available to the contracting officer. Evidence of compliance includes, but is not limited to, invoices, copies of subcontracts, or a list of the value of tasks performed. |
Compliance may be monitored via FFATA Subaward Reporting System (FSRS). See FAR clause 52.204-10, Reporting Executive Compensation and First-Tier Subcontract Awards (JUN 2020) (Pub. L. 109-282) (31 U.S.C. 6101 note), which is incorporated into the solicitation by reference via 52.212-5(b)(5).
Compliance may be monitored via FAR clause 52.204-15, Service Contract Reporting Requirements for Indefinite-Delivery Contracts (OCT 2016) (Pub. L. 111-117, section 743 of Div. C), which is incorporated into the solicitation by reference via 52.212-5(b)(8).
36C25624R0018 0001 5 Regarding 52.219-14 Limitations on Subcontracting | What specific reporting or documentation will be required to demonstrate compliance with this clause? Reporting must be done in accordance with FAR clause 52.204-10, Reporting Executive Compensation and First-Tier Subcontract Awards (JUN 2020) (Pub. L. 109-282) (31 U.S.C. 6101 note), which is incorporated into the solicitation by reference via 52.212-5(b)(5).
Reporting must be done in accordance with FAR clause 52.204-15, Service Contract Reporting Requirements for Indefinite-Delivery Contracts (OCT 2016) (Pub. L. 111-117, section 743 of Div. C), which is incorporated into the solicitation by reference via 52.212-5(b)(8).
| 36C25624R0018 0001 | 6 | Please advice if services are required for "Basic Life Support, Emergency Transport" and if so, what would be the required Quantity? | Yes, "Basic Life Support, Emergency Transport" is included, but it was omitted from the Contract Line Item Number (CLIN) Schedule by mistake. Please see revised CLIN schedule. Thank you. | |
| 36C25624R0018 0002 | 7 | According to the Instructions to Offerors pg. 39 sec. 3. Volume 2 - Technical Experience/Capability, it states "If subcontracting is contemplated, only prime contractor information is to be provided." Does that mean that the Prime cannot assume any of the requirements mentioned in Technical Subfactor 1: Licensing/Prior Experience pg. 39 if working with a subcontractor? | ||
| For example, do we as the prime have to employ our own credentialed and licensed EMT's? | "If subcontracting is contemplated, only prime contractor information is to be provided." This statement means we are only asking for (and evaluating) the Offeror/Prime's information. There are unfortunate instances where an unqualified Offeror will submit an offer in response to a solicitation, stating their subcontractor's experience/capabilities as their own without dislosing this tiny detail, hence why the statement is included. Volume 2 subfactors will be used to determine the Offeror’s (aka Prime Contractor) ability to successfully manage the full range of contractual requirements. The statement is pertinent to source selection and responsibility determination processes only. It does not dicatate how you subcontract any work post award whatsoever. | |||
| 36C25624R0018 0002 | 8 | Regarding Attachment D.2 (Critical Care Transport Capabilities Confirmation) |
It states that we must certify we will provide Zoll X Series Monitor Capabilities.
| We only use Zoll X Series on our Air Med Helicopters. Across all of our service areas we only utilize the Medtronic LifePak 15 on our CCT units. Please advise. | The Medtronic LifePak 15 is acceptable. | |
