About this file

This document is a Limited Sources Justification (LSJ) for a federal contract opportunity. The acquisition is for a new leasing task order with Xerox Corporation (XC) to support the Central Arkansas Veterans Healthcare System (CAVHS) and Community Based Outpatient Clinics (CBOCs) with 408 multifunction devices (MFDs), an onsite XC technician, maintenance, service, parts, and supplies under the Federal Supply Schedule (FSS) contract GS-03F-137DA. The estimated value of the proposed action is $363,325.40 with a base period of two months and three one-month option periods. The justification cites FAR 8.405-6(a)(1)(B) as the authority, stating that XC is the only responsible source for leasing the current equipment and no other suppliers or services will satisfy the agency requirements due to the proprietary hardware, software, and diagnostic tools. The contract will be awarded directly to XC as a sole source. The summary also notes that this is a short-term solution while the agency completes a new competitive solicitation through the Government Publishing Office (GPO) expected to be awarded by November 30, 2024.

(4) Identify the Authority and Supporting Rationale (see below and if applicable, a demonstration of th service.

FAR 8.405-6(a)(1)(B): There is only one responsible source leasing current equipment and no other suppliers or services will satisfy the agency requirements. XC is currently leasing 408 multifunction devices that contains XC proprietary hardware and software that only XC can provide satisfactory maintenance due to proprietary test equipment, tools, and diagnostic software.

(5) Describe Why You Believe the Order Represents the Best Value consistent with FAR 8.404(d) to aid the contracting officer in making this best value determination:

CAVHS has been in the process of obtaining a new multifunction device lease via Government Publishing Office (GPO) for several months. The solicitation was halted by OIT due to the lack of current cyber security requirements in the solicitation. The National OIT team, GPO, and CAVHS have had multiple meeting/calls to review required changes to the solicitation. Due to this delay, the facility needs a sole source/short-term lease agreement to support its XC MFDs until a new contract can be awarded and the new devices installed. GPO expects the new award and devices to be installed no later than 11/30/2024. Seeking another vendor for a short-term lease and changing the MFDs fleet at this time would result in a substantial duplication of costs not expected to be recovered by competitors.

(6) Describe the Market Research Conducted: Contracting Officer issued a Notice of Intent (NOI) 36C25624Q0621 to sole source to XC via sam.gov on March 14, 2024 through March 20, 2024. NOI receive zero response from industry with interest or evidence not to proceed with Sole Source strategy.
