Answer: Board Certified / Board Eligible Emergency Medicine Physicians who have recent clinical experience, within the last two (2) years practicing in an ED setting.

43. Question: A question regarding the Prior Experience Specialized Standard… we are a locum tenens medical staffing agency with experience providing a pool of Emergency Medicine Physicians to staff emergency departments 24/7 for both government and commercial facilities.

We do not have VA experience within the last 3 years. Would our other experience suffice for the Prior Experience Specialized Standard, or must it unequivocally be VA experience to qualify?

Answer: The response to your question is to please follow the instructions of the solicitation.

Please allow me to expound on the response.

Pardon me if the response is short and not a detailed response that you may be seeking—it is not my intent to be curt.

The reason for the short response is that your question calls for a determination to be made now so that you have assurances that what you want to submit is acceptable despite the specific information requested of the specialized standard.

Therefore it is best that the response to your question is that you should following the instructions of the solicitation.

44. Question: So, to clarify, you want us to include a completed copy of Past Performance with the bid, but then send you the exact same information on a separate document named “Prior Experience”. Do I have an accurate understanding of how you want this done?

Answer: To clarify this for you…the information is not exactly the same and will not be used the same. Please do not get hung up on the “same information”.

Prior experience is asking for “at least 3 years of prior experience in actually providing ER Physician Services for the VA Emergency Department, 24-hours a day, 7-days a week and will be considered for special responsibility purposes”. Reference FAR part 9.104-2(a)

45. Question: The RFP states that, “All Offerors must provide at least 3 years of prior experience in actually providing ER Physician Services for the VA Emergency Department 24-hours a day, 7-days a week and will be considered for special responsibility purposes.”

a. Question: We possess more than 3 years of experience providing ER Physicians to complex hospital environments for the Department of Defense. Will the Government consider/accept/evaluate such Past Performance to meet the above requirement?

Answer: Please re-read the specialized standard carefully and please do not skim. Then consider the “note” following the specialized standard. “Note: Prior experience is not past performance. Prior experience refers to whether an offeror has done similar work before;

whereas, past performance describes how well the offeror has done that work.”

REVISED 52.212-2 ADDENDUM

1. BASIS OF AWARD (Addendum to FAR 52.212-2)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Factor 1 - Contractor's Technical and Management Approach (Technical) Factor 2 - Qualification and Quality of Liaison Physician (Technical) Factor 3 - Past Performance Factor 4 - Price

Technical and past performance, when combined, are significantly more important than price (Refer to Addendum).

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of Provision)

1. BASIS OF AWARD (Addendum to FAR 52.212-2)

a. Award will be made to an offeror on the basis of a best-value trade-off per FAR 15.101-1.

The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer, conforming to the solicitation, will be most advantageous to the Government, price and other factors considered. The Government intends to evaluate without conducting discussions with offerors, or solicit final revised quotes; thus, each initial offer should contain the http://www.sam.gov/ http://www.sam.gov/ mailto:troy.davis@va.gov.N offeror’s best terms from a cost or price and technical standpoint. The following factors (no sub-factors), listed in descending order of importance, will be evaluated:

b. All non-price factors (Factors 1, 2, and 3), when combined, are significantly more important than price (Factor 4) for the purposes of determining the best value to the Government, therefore, the Government may award to other than the lowest priced offeror if it is in the Government’s best interest to do so.

c. Resulting Contract shall be based on the Contractor’s Technical Capabilities to provide the services listed in the Performance Work Statement (factors 1 & 2), their Past Performance (factor 3), and the proposed Price (factor 4).

d. All proposals will be evaluated in accordance with FAR 15.3. The Government intends to award without discussions with offerors, however the Government reserves the right to conduct discussions if it is in its best interest to do so. If discussions are conducted, the Government may establish a competitive range of the most highly rated proposals, unless the range is further reduced for purposes of efficiency pursuant to FAR 15.306(c)(2).

2. EVALUATION FACTORS AND CRITERIA.

Offerors should address in detail their Technical Capabilities by describing their proposed approach to each factor. All factors will be considered based solely on the proposal provided and the contractor’s ability to meet those requirements. Performance and Proposal Risk shall also be evaluated. The bulleted items should not be construed as sub-factors.

Factor 1 – Contractor’s Technical and Management Approach (Technical). The Government will evaluate the offeror's capabilities to provide Emergency Medicine Physician and Mid-Level Services as outlined in the RFP. The services recommended by the offeror will be evaluated in how they satisfy all of the PWS and instructions provided in the RFP. Each required item of the offeror’s Technical and Management Approach (outlined at E.3 Instructions to Offerors) will be rated to the extent in which the proposal demonstrates a clear understanding of the requirements, and the contractor’s ability to meet those requirements.

The Quality Control Plan key areas that proposals shall address are:

• Experience of the Contract Manager administering the Contract, their longevity at the company, and their availability throughout the life of the contract.

• Recruitment and Retention Methodologies to ensure successful Emergency Department

(ED) operations 24/7 to include contingencies for filling shifts on short notice due to unplanned absences.

• Process for the initial submission and ongoing maintenance of provider credentialing and privileging including yearly health requirements.

Factor Evaluation Factors 1 Contractor’s Technical and Management Approach (Technical) 2 Qualification and Quality of Liaison Physician (Technical) 3 Past Performance 4 Price

• Plan for training and oversight of all initial and yearly mandatory training for contract providers including the Computerized Patient Recordkeeping System to ensure accurate patient documentation is completed prior to the end of each shift.

• The Contractor’s Quality Improvement/Quality Assurance Programs to ensure successful

ED operations 24/7, Patient Satisfaction, and Patient Safety.

• Plan for transition of key personnel during the first 90 days of the contract period of performance to ensure successful ED operations 24/7.

Factor 2 – Qualification and Quality of Liaison Physician (Technical). This factor will be evaluated at the factor level and will be used to determine the qualifications and quality of the offered physician as the contact/liaison. In addition to meeting basic qualifications as identified in paragraph 2, Qualifications, of the PWS, the PWS states that the contractor shall designate a physician(s) to serve as a primary point of contact/liaison to provide oversight of the quality of work and performance of contract employees in support of the Emergency Department program. More than one is allowable and encouraged for contingency (short notice) coverage, however, for those physicians, the following additional information is requested and should be noted and may have already been provided as part of key personnel in Factor 1 Contractor’s Technical and Management Approach. Key areas that proposals shall address are:

Physician (contact/liaison):

(*) Relevant experience in clinical oversight of a level II Emergency Department 24/7 with 100% contract providers including managing short notice shift vacancies.

(*) Experience in the daily management of Emergency Department Flow

(*) Past experience serving as an ED subject matter expert
