VHAPM Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source Attachment 1: Single Source Justification for SAP under the SAT
VHAPM Part 813.106 Page 1 of 1 Original Date: 08/30/17 Revision 01 Eff Date: 04/23/2018
DEPARTMENT OF VETERANS AFFAIRS
Justification for Single Source Awards IAW FAR 13.106 1 For
Over Micro Purchase Threshold but Not Exceeding the SAT ($250K)
Acquisition Plan Action ID:__VA256 18 AP 7897____________________
1. Contracting Activity: Department of Veterans Affairs, VISN 16, Houston Medical Center & NCO 16 Contracting Supply Team A, 2237# 580 18 3 314 0127, estimated $152,539.73.
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: Stryker Core 2 System for scheduled Dental, ENT, Neuro, Spine and Endoscopic procedures in the Dental OR.
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: Currently, the Houston VA Hospital owns and uses a Stryker Brand Core 2 System. All the instruments owned and used by the Houston VA hospital are also Stryker Brand.
According to Stryker Inc, the Stryker Brand instruments can only be used on a Stryker brand core system. The instrument will not perform correctly if connected to any other core system brand that might be available in the market. It would be extremely expensive to procure new instruments, a new core dental system of another brand, and train all the hospital technicians and dentists in a new system. At the same time all the existing instruments would need to be discarded, wasting funds as the instruments still have many years of viable use. Also, the patient care will be delayed if a complete new system and instruments is procured. It would not practical and the best course of action to change the procurement requirement.
4. Description of market research conducted and results or statement why it was not conducted: a Request for Information 36C25618Q9713 was posted on FBO trying to identify any company capable of providing a similar equipment compatible with the owned Stryker brand instruments. Only 2 SDVOSB vendors responded offering exact match Stryker Core System. They are authorized Stryker SDVOSB partners. No other information was obtained. Based on Market Research, RFI, and information obtained from the manufacturer regarding the need for the instruments and the Core System being Stryker brand for better performance, durability, and warranty compliance, the requirement is considered a brand name need.
5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106 1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
