About this file

This document is Amendment Number 0002 to Solicitation 36C25526Q0498 issued by the Department of Veterans Affairs Network Contracting Office (NCO) 15 in Leavenworth, Kansas. The amendment provides clarification through Questions and Answers regarding Buy American Act and Nonmanufacturer Rule requirements for a forklift supply procurement under NAICS 333924 that is set aside for Service-Disabled Veteran-Owned Small Businesses (SDVOSBs). The solicitation closing date and time remain unchanged at July 31, 2026 at 10:00 AM Central Daylight Time.

The Questions and Answers address two primary compliance issues. First, regarding country of manufacture representation, offerors must identify the actual country of manufacture or final assembly for the forklifts at the time quotation is submitted; representations listing multiple alternative countries are not acceptable. Alternatively, if forklifts meet Buy American Act requirements as domestic end products (manufactured in the United States and meeting applicable domestic-content thresholds), offerors may represent them as such with supporting documentation. Second, concerning the Nonmanufacturer Rule under 13 CFR 121.406, the amendment clarifies that although SBA has issued certain NMR class waivers for NAICS 333924, none apply to the specific forklift product in this solicitation. Therefore, any SDVOSB nonmanufacturer prime must supply the end product of a small-business manufacturer made in the United States to remain compliant, regardless of whether the solicitation contains a separate domestic small-business manufacturer certification clause.

Question 1 – Country of Manufacture / Buy American Representation

An offeror’s authorized dealer has indicated that the forklifts may be manufactured/finally assembled in more than one foreign country (e.g., Vietnam or South Korea), depending on production allocation at the time of manufacture. For purposes of the solicitation’s country-of-manufacture and Buy American Act representations, may the offeror state “Country of Manufacture: Vietnam or South Korea, dependent upon final production/build allocation,” with supporting dealer documentation attached? Or must the offeror identify one specific country of manufacture at the time the quotation is submitted?

Answer 1:

For this solicitation, each offeror must identify the actual country of manufacture/final assembly for the forklifts at the time the quotation is submitted. A representation listing multiple alternative countries such as “Vietnam or South Korea, dependent upon final production/build allocation” is not acceptable because it does not provide a definite country of origin as of the date of offer.

If the forklifts meet the requirements to be considered domestic end products under the Buy American Act (manufactured in the United States and meeting the applicable domestic-content thresholds), the offeror may instead provide supporting documentation and represent the forklifts as domestic end products in its quotation.

Question 2 – Nonmanufacturer Rule / NAICS 333924

This procurement is a supply requirement under NAICS 333924 and is set aside for SDVOSBs.

The solicitation includes VAAR 852.219-76 but does not contain a separate clause that expressly requires a nonmanufacturer to provide the product of a domestic small-business manufacturer. The offeror asks whether an SBA Nonmanufacturer Rule (NMR) class waiver applies to this procurement under NAICS 333924.

Answer 2:

This solicitation is a supply acquisition under NAICS 333924 and is set aside for SDVOSBs.

Under SBA’s Nonmanufacturer Rule, an SDVOSB that is a nonmanufacturer may qualify for award only if it either:

• supplies the end product of a small-business manufacturer made in the United States, or

• supplies the product of a manufacturer where SBA has granted an applicable NMR waiver for the specific class of products.

Although SBA has issued certain NMR class waivers associated with NAICS 333924, none of those waivers cover the specific forklift product described in this solicitation’s statement of work.

Accordingly, no NMR class waiver applies to this forklift requirement, and the NMR applies with no waiver.

The NMR requirements in 13 CFR 121.406 apply regardless of whether the solicitation contains a separate “domestic small-business manufacturer” certification clause. As a result, any SDVOSB nonmanufacturer prime submitting an offer under this solicitation must supply the end product of a small-business manufacturer made in the United States to remain compliant with the NMR.
