This request does not constitute a solicitation for proposals or the authority to enter into negotiations to award a contract. No funds have been authorized, appropriated, or received for this effort.
The information provided may be used by the Department of Veterans Affairs in developing its acquisition approach, statement of work/statement of objectives and performance specifications. Interested parties are responsible for adequately marking proprietary or competition sensitive information contained in their response. The Government does not intend to award a contract on the basis of this Sources Sought Notice or to otherwise pay for the information submitted in response to this Sources Sought Notice.
The purpose of this sources sought announcement is for market research to make appropriate acquisition decisions and to gain knowledge of potential qualified Service Disabled Veteran Owned Small Businesses, Veteran Owned Small Businesses, 8(a), HubZone and other Small Businesses interested and capable of providing the services described below.
Documentation of technical expertise must be presented in sufficient detail for the Government to determine that your company possesses the necessary functional area expertise and experience to compete for this acquisition. Responses to this notice shall include the following: (a) company name (b) address (c) point of contact (d) phone, fax, and email (e) DUNS number (f) Cage Code (g) Tax ID Number (h) Type of small business, e.g. Services Disabled Veteran Owned small Business, Veteran-owned small business, 8(a), HUBZone, Women Owned Small Business, Small disadvantaged business, or Small Business HUBZone business and (i) must provide a capability statement that addresses the organizations qualifications and ability to perform as a contractor for the work described below.
The VA Heartland Network 15, Contracting Office located at 3450 South 4th Street, Leavenworth, KS, 66048-5055 is seeking a potential qualified contractor to provide services for bulk cable television services, which includes a base year with four (4) option year renewals for the Wichita VA Medical Center.

The North American Industry Classification System Code (NAICS Code) is 517919 All Other Telecommunications, size standard $32.5 Million. Based on this information, please indicate whether your company would be a Large or Small Business and have a socio-economic designation as a small business, VOSB or SDVOSB.
Important information: The Government is not obligated to nor will it pay for or reimburse any costs associated with responding to this sources sought synopsis request. This notice shall not be construed as a commitment by the Government to issue a solicitation or ultimately award a contract, nor does it restrict the Government to a particular acquisition approach. The Government will in no way be bound to this information if any solicitation is issued. Currently a total set-aside for Service Disabled Veteran Owned Small Business firms is anticipated based on the Veterans Administration requirement with Public Law 109-461, Section 8127 Veterans Benefit Act.
However, if response by Service Disabled Veteran Owned Small Business firms proves inadequate, an alternate set-aside or full and open will be considered. Any response to this source selection from interested parties must be received by April 3, 2019 at 12:00 P.M. CST.

Draft Statement Of Work Cable Television Service Contractor shall provide to the Robert J. Dole Veterans Affairs Medical Center, 5500 E. Kellogg Dr., Wichita, KS, 67218, and monthly bulk cable television service. A representative of the Contractor and the Government's Contracting Officer's Representative (COR) can survey the site for an audit of cable drops, if it is deemed by the Contractor and COR to be necessary. Bidder installs all required equipment and equipment upgrades necessary to deliver Cable programs, at no charge to user of vendor equipment. Programming must be comparable to existing Contractor's Limited Expanded Service. This contract includes a base year with four (4) option year renewals.
DAMAGE: Contractor shall repair any damage to the premises caused by the Contractor, its employees or agents. Contractor shall hold harmless and indemnify the Government from and against any and all losses or damages resulting from the Contractor's installation, maintenance, service, removal or operation of the equipment or any other equipment of the Contractor's, except loss or damage arising from negligent or intentional act or omission of the Government.
Subject to the limitations of liability law, and to the fullest extent permitted by law, Contractor shall indemnify and hold harmless the Government, their agents, and employees from and against any and all claims, damages, losses. and expenses (including, but not limited to, attorneys' fees) for bodily injury, sickness, disease, death, or injury to persons or destruction of tangible property caused by any negligent act or omission of Contractor, any Subcontractor, or anyone directly or indirectly employed by either Contractor or a Subcontractor for whose acts any of them may be liable.
Government will repair any damage to the equipment caused by the Government, its agents, or any patients on the premises. The Government will hold harmless and indemnify the Contractor from and against any and all damages arising from or with respect to the following:
a. Any negligence or intentional act or omission of Government or its agents or employees, or any patients on the premises.
b. Any claims, demand, legal proceeding or similar action instituted by any person or entity' providing multichannel video programming or other services similar in nature to the services provided to the premises as of or prior to the beginning date of the contract or its successor or assignee.
INSURANCE: Contractor shall maintain general liability and property damage liability insurance relating to its activities hereunder.
EQUIPMENT: Contractor may install, maintain, service, operate and upgrade on the premises, coaxial cable and/or fiber optic line, internal wiring, amplifiers, converters, and any other equipment necessary for the services. The equipment will, at all times, be owned by, and remain the property of the Contractor, whether or not attached to or incorporated into the premises, regardless whether or not said equipment is attached to or incorporated into the premises, and the Government will not have or obtain right, title, or interest therein.
The equipment does not constitute a fixture of the premises. The Government will not permit any third patty to attach to or use in any manner the equipment or any portion thereof. The Government will have no obligation to service or maintain the equipment. Contractor shall have the right to use other telecommunications equipment or wiring on the premises, regardless of ownership, for the delivery of the services. The Government shall provide, without charge, adequate space and electricity for the equipment.
CONVERTER BOXES: Contractor shall place converter boxes at identified sites. Government shall be responsible for any loss or damage to these boxes.
TERMINATION: This agreement may be terminated prior to the expiration of its term by either party upon thirty (30) days prior written notice to the other, in the event either patty is in breach of this contract.
PAYMENT:
a. Billing is to be monthly. Invoices are to be fully itemized, clearly listing date of service covered by invoice, current Purchase Order number, origin and destination points, and individual and total dollar amounts. Invoices are to be listed in date of order.
b. On November 27, 2012 the VA published a final rule in the Federal Register requiring vendors to submit invoices electronically to the FSC. This rule became effective December 27, 2012. As of April 10, 2013 the FSC is no longer accepting mailed or fax invoices from your company. Please submit your invoice in an electronic format directly to the FSC. (Rule in the Federal Register:

c. Vendors have a choice on how to electronically invoice the FSC:
· The FSC uses a third-party contractor, 0B 1 0, to transition vendors from paper to electronic invoice submission. Please see OBIO contact information below to begin submitting electronic invoices, free of charge.
· A system that conforms to the X 12 electronic data interchange (EDI) formats established by the Accredited Standards Center chartered by the American National Standards Institute. The X 12 EDI Web site http://www.x 1 2.org.
