VHAPM Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source Attachment 1: Single Source Justification for SAP under $150K

VHAPM Part 813.106 Page 1 of 1 Original Date: 08/30/17

DEPARTMENT OF VETERANS AFFAIRS

Justification for Single Source Awards IAW FAR 13.106‐1 For

Over Micro‐Purchase Threshold but Not Exceeding the SAT ($150K)

Acquisition Plan Action ID: VA255‐18‐AP‐2230/589‐18‐2‐5621‐5845

1. Contracting Activity: Department of Veterans Affairs, VISN 15 Harry S. Truman Memorial Veterans

Hospital. NCO‐15 Leavenworth, KS. 66048. NCO‐15 Leavenworth, KS. 66048

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

This procurement is for the purchase of DREAMSTATION AUTO CPAP WITH HUMIDIFIER and accessories for the Harry S. Truman Memorial Veterans’ Hospital.

3. Unique characteristics that limit availability to only One Brand, with the reason no other supplies or services can be used:

The DREAMSTATION AUTO CPAP WITH HUMIDIFIER and accessories are currently issued to veterans requiring treatment. The Harry S. Truman Memorial Veterans’ Hospital must have these items in stock and must be available for new issues as well as replacement items for Veterans requiring parts or experiencing equipment issues. Acquiring new CPAP “Brand” and accessories will require replacing the existing CPAPS and accessories that have been issued to Veterans, and will incur significant replacement cost. Acquiring different brands will also require additional storage space and affect the inventory management process.

Substituting with other brands than that specially prescribed is beyond the role, competency, and professional functions of the Contract Specialist and Contracting Officer.

4. Description of market research conducted and results or statement why it was not conducted:

No SBA Waiver exist for this requirement. No SDVOSB/VOSB can provide the brand specific items.

Due to Non‐Manufacturer Rule (NMR) this requirement cannot be set aside for SDVOSB, but can be set aside for Small Business on the Open Market. NMR does not apply to Small Business Set Aside under SAT as per SBA NMR Exception.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106‐1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
