Other Than Full and Open Competition (>SAT)
Acquisition Plan Action ID: 36C252-25-AP-2845
Contracting Activity: Department of Veterans Affairs, VISN 12, Great Lakes Acquisition Center on behalf of the Illiana Health Care System, 1900 E. Main Street, Danville, IL 61832-5100. Purchase request, 550-261-2957-0001.
Nature and/or Description of the Action Being Processed: This acquisition pertains to a new requirement for fire suppression and firefighter services, in compliance with FAR 13.5 which outlines Simplified Procedures for Certain Commercial Items. Specifically, it falls under FAR 13.501, which details Special Documentation Requirements. While acquisitions conducted under Simplified Acquisition Procedures are exempt from the provisions of FAR Part 6, they still require justification formatted according to FAR 6.303-2. The resulting contract will be awarded as a single award to the City of Danville Fire Department for a firm fixed -price contract.
Description of Supplies/Services Required to Meet the Agency’s Needs: Services will include fire response, fire suppression, and emergency services to include confined space entry rescue, decontamination and hazardous material spill response for the Illiana Health Care System and Danville National Cemetery. Statutory Authority Permitting Other than Full and Open Competition:
Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per 41 USC §3304(a)(1) as implemented by FAR 6.302-1;
5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):
In accordance with VA Directive 7718, paragraph 6. (1), Criteria and Requirements for Non- VA Fire Departments, “a fire station must be within 3.5 miles travel distance of the entrance to the VA medical facility.” Furthermore, the fire department must be full-time with paid firefighting personnel. The City of Danville Fire Department is the only municipality that meets these criteria.
Municipalities and other governmental or political subdivisions have a legal duty to extinguish fires within their boundaries, to include rendering rescue, providing aid and assistance in relation to such emergencies.
The VA facility in Danville is not within Danville’s corporate limits, which would be protected by the City of Danville Fire Department. Illinois General Assembly municipal code 65 ILCS 5/11-6-1.1, Firefighting services outside corporate limits. “A municipality may choose to provide firefighting services to property outside its corporate limits. The corporate authorities of each municipality may fix, charge, and collect firefighting service fees not exceeding the actual cost of the service for all firefighting services rendered by the municipality against persons, businesses, and other entities that be levied to reimburse the municipality for extraordinary expenses of materials used in rendering the services.” The City of Danville Fire Department has agreed to provide service and is in compliance with VA Directive 7718.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: The marketplace was surveyed through the utilization of a notice of intent to sole source (36C25225Q0584). The notice was posted to Contract Opportunities on SAM.gov from 7/11/2025-7/18/2025. The notice clearly identified the firefighting/fire suppression requirements for the VA grounds in accordance with VHA Directive 7718. Although market research indicated that only one source could perform the service, the notice gave transparency and an opportunity for any business size a chance to offer an outline of their capabilities identifying their ability to meet the VA requirements.
Upon expiration of the notice, no responses were received.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The Contracting Officer determines that the anticipated prices will be fair and reasonable based on prior acquisition history, the IGE for a basis of independent verification and current market rates; including the U.S Bureau of Labor Statistics Consumer Price Index and inflation rates.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Searches were conducted amongst schedule holders, VetCert, Small Business Administration (SBA), SBA Dynamic Small Business Search Website (DSBS), historical contracts, and Contract Opportunities through the Notice of Intent to Sole Source, 36C25225Q0584.
The search results of the Interagency Contract Directory Portal revealed four matches however, none of them were municipalities that met the strict location and safety criteria required for this procurement.
The search of VetCert revealed 27 matches, however, none of the matches provided firefighting services nor do they meet the requirements set forth in VHA Directive 7718.
The SBA Dynamic Small Business Search Website (DSBS) did not yield any results.
The search of historical contracts (36C25221C0002) was procured as a sole source to the City of Danville Fire Department.
The notice of intent to sole source did not receive any show of interest from the marketplace.

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: The government will continue to conduct market research to ascertain if there were any changes in the marketplace that would enable future actions to be competed.
For instance, a municipality within the travel distance that is or becomes a full-time fire station with full-time professional firefighters.
12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
