About this file
This document contains responses to pre-bid questions regarding solicitation number 36C25224Q0084 from the Department of Veterans Affairs for asbestos testing and monitoring services. The scope of work involves monitoring asbestos abatement and demolition activities at a building over an eight day period within a thirty day timeframe in late January through February. One individual from the contractor must hold Wisconsin certification as an asbestos inspector, supervisor, and as a Professional Industrial Hygienist. However, the solicitation allows for a team to meet the requirements as long as the team lead possesses the necessary certification. The contract is considered a service contract with a 50% limitation on subcontracting to non-veteran owned small businesses. No payment or performance bonds are required.
The responses clarify that only PCM air sampling analysis is needed, the current 2011 building hazard report is still valid as the building has remained untouched, and the lead point of contact for coordination is provided. Bidders were also informed that pre-demolition asbestos inspection was considered complete and accurate so no additional sampling would be required.

The solicitation states that the contractor must meet the following minimum qualifications:
“The Testing & Monitoring contractor must provide at least one (1) qualified Professional Industrial Hygienist (PIH) and the necessary support personnel to perform the requirements of this solicitation. The term PIH is a government-specific term meaning an individual who has professional experience as a practicing and certified industrial hygienist. For this contract, it is required that this PIH have a State of Wisconsin certification as an asbestos inspector and supervisor. This must be documented in the proposal (include copy of State Certification). “ This is a very unique and also uncommon combination since it is unusual for an individual person to hold both of these credentials.
Nevertheless, it is common for contractors in Wisconsin to offer this capability from a team of state licensed individuals. For reference, the State of Wisconsin does not require licensed asbestos inspectors and supervisors to by PIHs and the state also does not require state licensed PIHs to be licensed asbestos inspectors or supervisors.
The requirement that one individual be both a Wisconsin certified PIH and also a licensed asbestos inspector and supervisor severely limits competition to a very small pool of persons and contractors. Will you please change this requirement to allow contractors who can provide the equivalent credentials from a team of individuals? This would allow a greater number of firms to submit proposals for this project. For example, the requirement could read as follows:
“The Testing & Monitoring contractor must provide at least one (1) qualified Professional Industrial Hygienist (PIH) and the necessary support personnel to perform the requirements of this solicitation. The term PIH is a government-specific term meaning an individual who has professional experience as a practicing and certified industrial hygienist. For this contract, it is required that the Testing & Monitoring contractor also provide at least one (1) person that holds a State of Wisconsin certification or license as an asbestos inspector and supervisor. This must be documented in the proposal (include copy of State Certification). “
This can be accomplished with a team. Team lead will be State Certified.

The building hazard report provided in the solicitation was prepared nearly thirteen years ago in March 2011. Presumably, much degradation of surveyed materials, renovations and maintenance has occurred during the last 13 years. Thus, for safety reasons, it should be presumed that the situation of the building has changed significantly over the last decade. Can you please provide a current building hazard report to document any changes that may have happened and to describe the present state of the building?
Building has been un-touched for 13 years. The current report is still valid.

In the solicitation, according to the regulations referenced in (13 CFR §125.6), the percent of work required to be performed by the SDVOSB depends on what the contract services are considered by the government. What are the prime contractor's limitations on subcontracting for this solicitation?
Can the VA please clarify that this is considered a solicitation for construction services according to 13 CFR §125.6 and in accordance with 13 CFR §125.6(a)(3), the government cannot pay more than 85% of payments on this contract to a non-Service Disabled Veteran Owned Small Business (SDVOSB) subcontractor? Restricting this project to SDVOSB contractors that directly employee staff with the specified specialized licensing and certification requirements may create a burden and unfairly exclude most SDVOSB contractors that do not have the capacity to employee staff with the specialized licenses and certifications.
Service Contract 50%

Is it acceptable for a certified SDVOSB offeror to provide a team of individuals who meet the required state asbestos inspector, asbestos supervisor and PIH certification requirements? The solicitation states that one person from the contractor must hold all of these licenses, but this narrows the group of offerors severely and limits competition. Would it be acceptable for the asbestos testing and monitoring contractor to provide an OSHA authorized trainer for construction in lieu of a PIH?
This can be accomplished with a team. Team lead will be State Certified.

The building hazard report from 2011, indicated the presence of lead-based paint, and we do know that the demolition contractor is responsible for monitoring this activity.
