c. The VA has mandated electronic invoice submission to the Veterans Affairs Financial Services Center (VAFSC). VAFSC has partnered with Tungsten Network e-Invoicing network, for submissions of all electronic invoices to VA. Tungsten Network electronic invoicing is free to all VA vendors. In order to submit electronic invoices, all VA vendors must register with Tungsten Network by submitting an email to VA.Registration@Tungsten-Network.com or calling 1-877-752-0900 option 2 for Enrollment.

d. Contractor shall submit an electronic invoice by the tenth (10th) of the following month services were performed to the Veterans Affairs Financial Services Center (VAFSC) e-Invoice through the website at https://portal.Tungsten-Network.com/Login.aspx. For questions regarding the submission of VA electronic invoices, Tungsten Network customer service may be contacted at 1-877-489-6135.

e. All invoices shall reference the vendor name and address, customer name, contract number, appropriate obligation/funding order number, description of services provided, quantity, unit price, and total invoice amount (any additional info). Invoices shall also include any payment discount terms.

4. GOVERNMENT INVOICE ADDRESS (See SF1449 Block 18):

a. All invoices from the contractor shall be submitted electronically in accordance with 852.232-72 ELECTRONIC SUBMISSION OF PAYMENT REQUESTS (NOV 2018)

b. Facsimile, e-mail, and scanned documents are not acceptable forms of submission for payment requests.

c. VA’s Electronic Invoice Presentment and Payment System – The Veterans Affairs Financial Services Center (VAFSC) uses a third-party contractor, Tungsten Network e-Invoice, to transition vendors from paper to electronic invoice submission. Please go to this website: http://www.tungsten-network.com/customer-campaigns/veterans-affairs-us/ to begin submitting electronic invoices, free of charge.

d. As of July 1, 2020, the VA10091 form has been eliminated and the VAFSC is requiring our vendors to update and add their information in the Customer Engagement Portal (CEP) at https://www.cep.fsc.va.gov/. This is for new vendors being added to FMS only.

5. ACQUISITION OF COMMERCIAL ITEMS: This Request for Quote (RFQ) solicitation is issued under the authority of FAR Part 12 Acquisition of Commercial Items and FAR Part 13 Simplified Acquisition Procedures. FAR Part 15 will not be used. The procedures in Part 12 used in conjunction with Part 13 allow the Government to procure services resembling those in the commercial marketplace and streamline the procurement process. From this RFQ, the Government intends to award a firm fixed price contract where the contractor provides a price that is not subject to any adjustment on the basis of the contractor’s cost experience in performing the contract.

6. SITE VISIT:

It is strongly suggested and expected that the offeror inspect the campus to be serviced to fully understand the nature of the work and the conditions under which the work is to be performed. In no case shall failure to inspect the campus constitute grounds for a claim after contract award.

SITE VISIT IS SCHEDULED FOR WEDNESDAY SEPTEMBER 15, 2021 AT 10:00 AM LOCAL TIME. ALL INTERESTED PARTIES TO MEET COR RICHARD ICKLER (715-305-5909) AT BUILDING 40 ROOM 111.

PLEASE NOTE: WHILE ON CAMPUS, ALL PERSONS WILL BE REQUIRED TO WEAR MASKS INSIDE ANY VAMC BUILDING AND WHILE TRAVELING IN VEHICLES FOR PURPOSES OF THE SITE VISIT.

7. RFQ QUESTIONS:

In order to maintain integrity of this solicitation and subsequent award date, all offerors are advised that any question and answer requests must be submitted in a written form via e-mail to the Contracting Officer SUSAN.PASHOLK@va.gov no later than MONDAY SEPTEMBER 20, AT 11:00 AM LOCAL TIME. Contracting will issue a consolidated response via solicitation amendment to https://sam.gov Contract Opportunities within 2 business days to all parties

8. CONTRACTING OFFICER AUTHORITY:

The Contracting Officer is the only person authorized to approve changes or modify any of the requirements under this contract. The Contractor shall communicate with the Contracting Officer on all matters pertaining to contract administration. Only the Contracting Officer is authorized to make commitment or issue changes that will affect price, quantity or quality of performance of this contract. In the event the Contractor effects any such change at the direction of any person other than the Contracting Officer, the change shall be considered to have been made without authority and no adjustment will be made in the contract price to cover any increase in cost incurred thereof.

9. IDENTIFICATION, PARKING, SMOKING AND VA REGULATIONS:

a. All VA property is considered Federal property and all Federal laws are applicable.

b. It is the responsibility of the Contractor to park in the appropriate designated parking areas. Information on parking is available from the VA Police Section. The VA will not invalidate or make reimbursement for parking violations of the Contractor under any conditions.

c. All VA facilities are drug free. Possession of drugs, to include Marijuana and all Marijuana bi-products are prohibited. Enclosed containers, including tool kits, shall be subject to search. Violations of VA regulations may result in citation answerable in the United States (Federal) District Court, not a local district, state, or municipal court.

d. All contractor personnel are required to adhere to all VA rules and regulations.

e. Smoking is prohibited on the entire campus, both inside and outside the VA Facility

f. Possession of weapons is prohibited. Enclosed containers, including tool kits, shall be subject to search. Violations of VA regulations may result in citation answerable in the United States (Federal) District Court, not a local district, state, or municipal court.

g. VHA DIRECTIVE 1192: This Veterans Health Administration (VHA) directive establishes policy and provides guidance for the prevention of seasonal influenza in VHA facilities through the vaccination or masking of health care personnel (HCP). AUTHORITY: Title 38 United States Code (U.S.C.) 7301(b), 7318(b). Contractor is responsible in ensuring that all aspects of this directive are implemented, including providing face masks and influenza vaccines for all employees working at a VA facility.

10. SECURITY & PRIVACY CONTROL:

The Authorization & Accreditation (A&A) requirements of VHA Handbook 6500.6 do not apply to this requirement, therefore, a Security Accreditation Package is not required. No A&A or MOU/ISA is required. Sensitive information exposure as part of this contract involves applicable security controls within the facility as part of the VA Information Security If there are any questions related to privacy, please have a member of your staff contact the VA Privacy Service at (202) 461-6309. If there are any questions related to the information security, please have a member of your staff contact the Office of Cyber Security at (304) 262-7733.

Visitor Passes:

Issuance of visitor passes is the responsibility and at the discretion of each Facility Director. Visitor passes may be issued to individuals requiring short-term access to a VA facility for a period not to exceed 15 days in a 365-day period. Visitor passes are issued on a daily basis and expire at the end of the day of issuance. Visitor passes are issued following, at a minimum, review of one valid and current State or Federal government issued photo ID. Visitors must be escorted in areas restricted to the general public.

11. FACILITY CHECK IN/OUT REQUIREMENTS:

A. Upon arrival at the facility, all Contractor FST’s (Field Service Technician(s)) shall obtain contractor ID badges from the COR. Identification shall be worn visible always by the Contractor and all FST’s while on premises. Contractor shall coordinate with COR to acquire said identification badges.

B. During normal working hours of operation, Monday through Friday, the contractor shall check in with the COR/Tomah VAMC (Veterans Affairs Medical Center) POC (Point of Contact), whether in person or with a phone call, when arriving to perform work and check out, in the same manner, with the COR/Tomah VAMC POC when work/workday is complete.

C. During other than normal hours of operation, the contractor shall sign in and out with the Fire Department located on the east end of B36.

MED GAS & VACUUM TESTING SERVICES

STATEMENT OF WORK

Contractor shall provide all equipment, material, labor, tools, travel costs and supervision, necessary perform annual testing, adjusting, calibrating and repair/replacement of the medical gas and vacuum systems, located at the Tomah Veterans Affairs (VA) Medical Center, according to the following statement of work.

1. SCOPE

A. See Attachment A – Schedule of Equipment, for listing of all equipment and devices that shall be tested, calibrated, and certified annually. Quantity of each item to be serviced per this contract shall not exceed 15% of the quantities per the original contract.

1) Testing shall meet or exceed the following most current standards:

a) International Organization for Standardization (ISO) 7396 – Medical Gas Pipeline Systems, ISO 9170 – Terminal Units for Medical Gas Pipeline Systems, ISO 10524 – Pressure Regulators for Use with Medical Gases, ISO 15001 – Anesthetic and Respiratory Equipment (Compatibility with Oxygen), ISO 15002 - Flow-Metering Devices for Connection to Terminal Units of Medical Gas Pipeline Systems and ISO 21969 - High-pressure Flexible Connections for use with Medical Gas Systems.

b) National Fire Protection Association (NFPA) 99 – Healthcare Code

c) NFPA 55 - Compressed Gases and Cryogenic Fluids Code

d) Centers for Medicare & Medicaid Services (CMS) American Society for Sanitary Engineering (ASSE)-6000 - Professional Qualifications Standard for Medical Gas Systems Personnel

e) Underwriters Laboratory (UL) 2601-1 - Standard for Safety Medical Electrical Equipment

f) Joint Commission

g) United States Pharmacopeia (USP) and the National Formulary (NF)

h) Compressed Gas Association (CGA)

i) Occupational Safety and Health Administration (OSHA)

j) All Local, State, National and VA Standards.

k) Contractor shall reference the latest versions of each Standard indicated above.

B. In addition to the devices and equipment listed in Attachment A above, the following shall be tested, calibrated, and certified annually:

1) Gas quality testing.

2) All source/source valves and zone valves.

3) Bulk Oxygen sensors, Low O2 Reserve.

C. Contractor shall repair if possible, replace if necessary, all sensors and alarm points, patient terminals, gauges, and labeling that is directly associated with the medical gas and vacuum system covered herein. All parts repaired or replaced per the terms defined herein, shall be covered under warranty for a period of twelve (12) months after repair or replacement is completed.

D. Contractor shall provide service and preventative maintenance on all medical air compressors, medical vacuum pumps and medical air compressor dryers indicated on Attachment A – Schedule of Equipment, and as follows in Table 1.

1) All parts shall be Original Equipment Manufacturer (OEM) parts. Oil shall be OEM synthetic.

E. Any changes to this Statement of Work (SOW) shall be authorized and approved only through written modification of this contract from the CO in coordination with the COR. Costs incurred by the contractor through the actions of parties other than the Contracting Officer shall be borne by the contractor.

F. Notwithstanding, the Contractor shall perform no additional work without the prior written authorization of the Contracting Officer. Any additional work, which may be performed by the Contractor without this approval, will be performed by the Contractor at no additional cost to the Government.

G. Within fourteen (14) days of the award of this contract, the Contractor and the Government shall agree upon a date for work to take place.

2. SERVICE HOURS AND FEDERAL HOLIDAYS

A. Normal hours of coverage are Monday through Friday from 7:30 am to 4:30 pm, excluding holidays. All work shall be performed during normal hours of coverage unless otherwise requested or approved by the COR or their designee.

B. All contract work shall be on a date and time mutually agreed upon between the Contractor and the COR.

C. National Holidays observed by the VAMC are:

3. GENERAL INFORMATION

A. Compliance with General Safety Regulations:

1) The Contractor shall coordinate all dates for service and testing with contract COR.

2) The contractor’s FST (Field Service Technician) shall contact the COR/POC prior to performing service at this location and shall communicate to the COR of their presence on the Tomah VA Medical Center campus.

3) Contractor shall be responsible to replace any items damaged by the contractor, sub-contractor, their employees or equipment at no extra charge to the Government.

4) Contractor personnel shall conduct their work in a manner that does not interfere with the normal functions of the facility and will stop work if asked by the CO/COR as required if interruptions do occur.

4. CONTRACTING OFFICER’S REPRESENTATIVE (COR)

A. Scheduling of work shall be arranged with at least one, or all the Point of Contacts below and in the following order; contract COR (Contracting Officers Representative) or contract ACOR (Alternate Contracting Officers Representative).

5. COMPETENCIES AND QUALIFICATIONS OF PERSONNEL SERVICING EQUIPMENT:

All work shall be performed by personnel with American Society of Sanitary Engineering (ASSE) -6000 Series Certifications.

6. ORIENTATION FOR CONTRACTOR EMPLOYEES:

A. Contractor shall attend an orientation meeting as arranged by the Contracting Officer's Representative (COR). The VA will schedule this meeting and it will include discussion of the following topics: (VA will provide information to the contractor regarding these topics and will document the meeting)

· Fire and Safety

· Infection control

· Disaster procedures - Other B. The Contractor shall be responsible to ensure that Contractor employees coming to the work site will receive the information required above.

7. CONTRACT DELIVERABLES

Contractor shall provide, to the COR after completion of work, at the minimum, the following deliverables:

A. All service and inspection reports upon completion of scheduled maintenance. Report shall include overall summary of work performed, individual tests performed and a listing of all code requirement testing, inspections and calibrations performed.

B. All repairs or replacements needing attention, and consequently, execution for repair or replacement, not covered under this statement of work, shall be listed in the report. All listings shall be differentiated as either “required” or “recommended”.

C. All reports shall be provided to the contract COR no later than ten (10) business days after completion of required annual testing, as described in Section 1 of this statement of work.

D. Any system deficiency found that would cause, or have the potential to cause, serious injury (Life Safety), shall immediately be reported to the contract COR.

8. RISK CONTROL

A. The Contractor shall take all necessary precautions to protect government property and shall repair any damage caused by their efforts.

B. All work affecting patients shall be coordinated in advance by the Government and the Contractor to have minimal impact on the patients.

9. COVID-19 REQUIREMENTS

A. Tomah VA Medical Center guidelines and policy related to work on a CLC unit or an area where CLC Veterans are cared for.

1) Each contract will require approval of front office and IC prior to contractors entering a CLC

2) If approval is granted contractors must meet the following criteria

3) Covid-19 testing shall be in accordance with current CLC testing guidelines.

4) Entrance screening to include symptom questions and temperature, a sticker will be provided after screening occurs

5) Guidance on the appropriate PPE needed for the job being performed will be provided by Infection Control upon approval

6) Contractors are expected to provide their own PPE. Face masks and face shields are required for all work. Technical description and specifications of PPE must be sent to Project COR for approval prior to start of work. In limited circumstances, the facility may be able to supply PPE.

7) If a respirator is needed, proof of fit testing is required, contractor must wear the respirator identified on the fit testing form.

8) Contractors are expected to follow all guidelines established by VHA and Infection Control related to:

a. Proper social distancing.

b. The cleaning and disinfection of frequently touched objects, including but not limited to, shared tools, machines, vehicles, ladders, portable toilets, etc.

c. Limiting whenever possible tool sharing.

d. Proper hand hygiene.

e. Encourage sick workers to stay home.

f. Encourage workers who are well with sick family members to follow CDC guidance related to quarantine and isolation. More information can be found at: https://www.cdc.gov/coronavirus/2019-ncov/if-you-are- sick/quarantine.html B. See below for Tomah VA Medical Center guidelines and policy related to work entrance to the Tomah VA Medical Center for work performance.

1) Vendor staff entering the Tomah VA Medical Center will have to have pass through screening and their temperature shall be taken, daily, along with answering Covid-19 symptom questions. Proof of normal temperature check will be provided to the Vendor each day in the form of a sticker and shall be worn visibly all that day.

2) Facemasks/face shields shall always be worn while performing work in Non-CLC working environments. See above for all requirements related to work performance in CLC areas.

11. PERIOD OF PERFORMANCE

A. Support and service, as defined in this SOW, is to occur as scheduled and as required during the period of performance.

B. Work shall be completed in a timely manner and a performance schedule shall be coordinated with the Government upon contract award.

C.3 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 calendar days before contract performance period ends. The “specified” rates under this clause will be those rates in effect under the contract each time an option is exercised under this clause.

C.4 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 30 calendar days prior to the contract expiration; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 30 calendar days before contract performance period ends. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed FIVE (5) years and six (6) months.

C.5 52.219-14 LIMITATIONS ON SUBCONTRATING (DEVIATION 2019-01)

(a) This clause does not apply to the unrestricted portion of a partial set-aside.

(b) Applicability. This clause applies only to—

(1) Contracts that have been set aside for small business concerns or 8(a) participants;

(2) Part or parts of a multiple-award contract that have been set aside for small business concerns or 8(a) participants;

(3) Orders set aside for small business concerns or 8(a) participants under multiple-award contracts as described in 8.405-5 and 16.505(b)(2)(i)(F); and

(4) Orders issued directly to small business concerns or 8(a) participants under multiple-award contracts as described in 19.504(c)(1)(ii).

(c) Limitations on subcontracting. By submission of an offer and execution of a contract, the Contractor agrees that in performance of the contract in the case of a contract for—

(1) Services (except construction). At least 50 percent of the cost of contract performance incurred for personnel shall be expended for employees of the concern.

(2) Supplies (other than procurement from a nonmanufacturer of such supplies). The concern shall perform work for at least 50 percent of the cost of manufacturing the supplies, not including the cost of materials.

(3) General construction. The concern will perform at least 15 percent of the cost of the contract, not including the cost of materials, with its own employees.

(4) Construction by special trade contractors. The concern will perform at least 25 percent of the cost of the contract, not including the cost of materials, with its own employees.

(d) The Contractor shall comply with the limitations on subcontracting as follows:

(1) For contracts, in accordance with paragraph (b)(1) and (2) of this clause— [Contracting Officer check as appropriate.] _ By the end of the base term of the contract and then by the end of each subsequent option period; or _ By the end of the performance period for each order issued under the contract.

C.6 52.237-2 PROTECTION OF GOVERNMENT BUILDINGS, EQUIPMENT, AND VEGETATION (APR 1984) The Contractor shall use reasonable care to avoid damaging existing buildings, equipment, and vegetation on the Government installation. If the Contractor’s failure to use reasonable care causes damage to any of this property, the Contractor shall replace or repair the damage at no expense to the Government as the Contracting Officer directs. If the Contractor fails or refuses to make such repair or replacement, the Contractor shall be liable for the cost, which may be deducted from the contract price.

C.8 VAAR 852.219-74 LIMITATIONS ON SUBCONTRACTING – MONITORING AND COMPLIANCE (JUL 2018 DEVIATION)

(a) This solicitation includes 852.219-6 Notice of Total Small Business Set-Aside

(b) Accordingly, any contract resulting from this solicitation is subject to the limitation on subcontracting requirements in 13 CFR 125.6. The Contractor is advised that in performing contract administration functions, the Contracting Officer may use the services of a support contractor(s) retained by VA to assist in assessing the Contractor’s compliance with the limitations on subcontracting or percentage of work performance requirements specified in the clause. To that end, the support contractor(s) may require access to Contractor’s offices where the Contractor’s business records or other proprietary data are retained and to review such business records regarding the Contractor’s compliance with this requirement.

(c) All support contractors conducting this review on behalf of VA will be required to sign an “Information Protection and Non-Disclosure and Disclosure of Conflicts of Interest Agreement” to ensure the Contractor’s business records or other proprietary data reviewed or obtained in the course of assisting the Contracting Officer in assessing the Contractor for compliance are protected to ensure information or data is not improperly disclosed or other impropriety occurs.

(d) Furthermore, if VA determines any services the support contractor(s) will perform in assessing compliance are advisory and assistance services as defined in FAR 2.101, Definitions, the support contractor(s) must also enter into an agreement with the Contractor to protect proprietary information as required by FAR 9.505-4, Obtaining access to proprietary information, paragraph (b). The Contractor is required to cooperate fully and make available any records as may be required to enable the Contracting Officer to assess the Contractor’s compliance with the limitations on subcontracting or percentage of work performance requirement.
