X X X December 14, 2020 at 2:00pm CST The purpose of this modification is to update Section E.6 FAR 52.212-2(a) and (b) to remove any ambiguity in the solicitation regarding 852.215-70(c) SDVOSB and VOSB Evaluation Factors as well as the Government's price reasonableness determination. It clarifies that prices in the lower tiers will not be used to determine price reasonableness in either the SDVOSB or VOSB tiers and removes any ambiguity regarding a prudent person.

Proposals remain due on December 14, 2020 at 2:00pm CST.

E.6 52.212-2 EVALUATION—COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation is the lowest price technically acceptable offer. The following factors shall be used to evaluate offers:

(1) Technical Capability

- Company Experience

- Management Plan
- Quality Control Plan
(2) Price

Consideration for VAAR 852.215-70(c) and VAAR 852.219-72 evaluation factors will be provided in the form of a tie breaker in the event of a pricing tie among technically acceptable proposals in the event that an award cannot be made in Tier 1 (SDVOSB) or Tier 2 (VOSB) and evaluation has moved to Tier 3 (small business concerns) or Tier 4 (unrestricted). This applies only to non-veteran offerors.

(b) Evaluation Approach.

Technical Capability: Offerors will be evaluated on its demonstration to meet the Government’s minimum requirements as set forth in the Technical Proposal outlined in Addendum to FAR 52.212-1 Instructions to Offerors – Commercial Items.

Price: The Offeror's Total Evaluated Price (TEP) will be determined by multiplying each price proposed in the schedule by the applicable estimated quantity and adding all these products together. The Offeror’s TEP will be evaluated by the Contracting Officer for reasonableness. The Government may determine that an offer is unacceptable if annual prices are significantly unbalanced. The individual prices proposed in the schedule may also be evaluated for reasonableness. Reasonableness may be based on the proposed price compared to historical prices for similar efforts, comparison to the Independent Government Estimate (IGE), or price competition obtained by the other Offeror’s proposals in the same tier submitted in response to this RFP.

(c) Options & Ordering Periods. For the purposes of the award of this Contract, the Government intends to evaluate the option to extend services, provided under FAR 52.217-8, as follows: The evaluation will consider the possibility that the option can be exercised in increments of one to six months, but for no more than a total of six months at the end of the life of the contract. The evaluation will assume that the prices for any option exercised under FAR 52.217-8 will be at the same rates as those in effect under the contract in the last ordering period. The evaluation will therefore assume that the addition of the price or prices of any possible extension or extensions under FAR 52.217-8 to the total price for the basic requirement and the total price for the priced options has the same effect on the total price of all proposals relative to each other, and will not affect the ranking of proposals based on price, unless, after reviewing the proposals, the Government determines that there is a basis for finding otherwise. This evaluation will not obligate the Government to exercise any option under FAR 52.217-8.

(d) The Government may make an award based on initial proposals without discussions.

This procurement is set-aside based on an order of priority as established in 38 U.S.C. 8127.

TIERED EVALUATIONS INCLUDING LARGE BUSINESS CONCERNS: All proposals under this solicitation will be subject to a tiered evaluation that include the following tiers: (1) SDVOSB concerns, (2) VOSB concerns, (3) small business concerns, with HUBZone small business concerns and 8(a) participants having priority; and (4) full and open competition (unrestricted), which includes large businesses (other than small business concerns). If award cannot be made in any of these tiers, the solicitation will be cancelled and the requirement may be resolicited.

To be considered for award, ALL concerns in the tiers listed above must submit a COMPLETE PROPOSAL by the date and time specified in this solicitation.
