This is a Justification and Approval for Other than Full and Open Competition. The purchase request numbers are TBD.

2. Nature and/or Description of the Action Being Processed: This procurement is for External Clinical Consultation Services for the CHVC and GAVC in accordance with FAR 13.5 Simplified Procedures for Certain Commercial Items and specifically FAR 13.501 Special Documentation Requirements. Where acquisitions conducted under Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6, but still require a justification using format of FAR6.303-2.

This is a justification and approval request to award a follow-on contract on a sole source basis to Lorri L. Glass, Ph.D. for External Clinical Consulting Services. The awarded contract will be firm-fixed price requirements.

3. Description of Services Required Meeting the Agency’s Needs: This requirement must be filled with an independently licensed and certified Ph.D., LCSW with experience providing VHA mental health services. The External Clinical Consultant is responsible for providing each vet center’s clinical staff with professional consultations. These consultations review previous mental healthcare and services provided to our combat Veterans, their families and other eligible Veterans. This ensures Vets receive optimal treatment and adequate guidance. These External Clinical Consultant Services are also used as quality control measures at each vet center site. The contractor will provide these services at each vet center site for two hours each scheduled service date, for two scheduled service dates per month.

VHA Handbook 1500.01 and Department of Veterans Affairs Policy Memorandum Number 7-3, External Clinical Consultants both require all vet centers to utilize at least one external clinical consultant for a minimum of one hour per week (or two hours bi-weekly). The performance period is April1, 2020 through March 31,2025. The value of the procurement is $72,000 for the base year plus four one-year option years.

4. Statutory Authority Permitting Other than Full and Open Competition: The authority for applying the Simplified Procedures for Certain Commercial Items of FAR 13.5 is 41 U.S.C. 1901 and is implemented by restricting competition on this procurement via FAR 13.106- 1(b)(1)(i).

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above: Dr. Lorri Glass, Ph.D., LCSW has extensive experience performing this requirement for the Vet Centers. No other contractors could be located during market research.

Dr. Glass has favorably adjudicated special agreement checks.

6. Description of Efforts Made to Ensure that Offers are Solicited from as Many Potential Sources as Many Potential Sources as Deemed Practicable: Market research was performed by the Contracting Officer’s Representative (COR) and a Contract Specialist. An Intent to Sole Source Notice, Number 36C25220Q0301, was posted to FBO.gov on February 11, 2020. No interested parties have responded to the posting.

7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The intent is to award the contract at the established $125.00 per hour in Contract VA69D-14-C-0377. Pricing will be compared to the government estimate, market research, and prior contracts for the same service prior to award. The anticipated cost will be considered fair and reasonable based upon market research and the Independent Government Cost Estimate (IGCE).

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: In accordance with the Veterans First Contracting Program (Rule of Two) and FAR Part 10, market research was conducted through a Vendor Information Pages (VIP) search using NAICS Code “621330”, Key Words: “Readjustment Veteran Counseling”, and States Searched – Not Strict: “Illinois Indiana”. The report yielded 15 Service Disabled Veteran-Owned Small Businesses (SDVOSB) and/or Veteran-Owned Small Businesses (VOSB). After viewing each website: 6 vendors do not provide the required services, 6 vendor’s websites do not include coverage in Illinois and/or Indiana. An email generally outlining this requirement was sent to the three remaining vendors. EGA Associates, LLC was interested; however, could not offer a single clinician to provide these services. Two providers, Federal Guardian LLC and Holowis Health Organization, did not respond.

SBA Small Dynamic Business searches were completed utilizing “Readjustment Veteran Counseling”, NACIS “621330”and ran for each state. No vendors were reported.

A GSA elibrary search was conducted using: 621 I “Professional and Allied Healthcare Staffing Services”, 621-018 “Physician-Psychologist”, with these filters: Clinical and Small Business. The report revealed 32 contractors with GSA/FSS contracts. Research into the 32 contractors revealed the schedules did not list education requirements.

An Intent to Sole Source Notice was published on FBO.gov on February 11, 2020. No responses were received.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition: Based on market research and an Intent to Sole Source posting, the Contracting Officer did not identify any additional sources that could provide these services.

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: The Contract Specialist received inquiries from companies that were interested in the procurement. The work statement was shared with them and it was determined that they could not meet the requirements of the work statement.

11. A Statement of the Actions, ifany, the Agency May Take to Remove or Overcome any Barriers to Competition before Making Subsequent Acquisitions for Services Required: Market research will be conducted for future acquisitions for these services. A sources sought notice will be posted in an attempt to foster competition.
