VHAPM Part 813.106 Page 1 of 2 Original Date: 08/30/17 Revision 01 Eff Date: 04/23/2018
DEPARTMENT OF VETERANS AFFAIRS
Justification for Single Source Awards IAW FAR 13.106-1 For
Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)
Acquisition Plan Action ID:____36C252-19-AP-2040________
1. Contracting Activity: Department of Veterans Affairs, VISN 12, Zablocki Medical Center
NCO 12 Construction Team 695-19-2-6985-0036
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:
Provide labor, materials, equipment, qualified technicians and supervision, Quality Control representative, test equipment and other items designated in the Statement of Work in accordance with the specifications and maps to complete Project # 695-19-130: Repair Campus Phone Lines at Clement J. Zablocki VA Medical Center, 5000 West National Avenue Milwaukee, WI. The project includes repair and replacement of phone lines in the steam tunnel. The IGE for this project is $197,484.83.
For this new requirement, NCO 12 proposes to establish a firm fixed price contract with Veterans Electric, LLC, (Duns: 829612667), a Vendor Information Pages (VIP) verified Service Disabled Veteran Owned Small Business (SDVOSB) under the Statutory Authority Permitting Other than Full and Open Competition per FAR 6.302-5, VAAR 819.7007, P. L. 109-461 (per Class Deviation 07/25/2016) by a Request for Proposal RFP under FAR Part 15.
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:
Not Applicable. Statutory authority is prescribed under 38 U.S.C 8127, & 41 U.S.C. 3304(a)(5).
Governing regulations are FAR 6.302-5 & VAAR 819.7007 (per Class Deviation 07/25/2016).
4. Description of market research conducted and results or statement why it was not conducted:
Market Research was not initially conducted. This project was originally solicited as an RFP under the Milwaukee Construction JOC IDIQ. After several attempts to negotiate pricing to meet the RSMeans requirements for the base JOC, the non-pre-priced (NPP) items exceeded the allowable limits (NPP items were 54.5% of the overall proposal). The costs associated with the non-pre-priced items was due to the required cable, labor for installation to include all splicing and terminations;
this was due to the contractor stating the required cable was not found in RSMeans, possibly due to the cable being outdated. The Contracting Officer determined it would not be in the best interest of the government to pursue adding the cable and labor requirements as pre-priced items to the base JOC IDIQ through modification, as the cable would probably not be used again in future projects.
Further, it was brought to the attention of the CO that the required cable for the project was available in a limited amount direct from the manufacturer. If the cable length is sold to another party prior to VA awarding the contract for this project, the cable will have to be special ordered with a length requirement that exceeds the requirement of this project, resulting in a higher cost to the VA. The CO determined a sole-source contract to Veterans Electric, LLC was the most efficient
VHAPM Part 813.106 Page 2 of 2 Original Date: 08/30/17 Revision 01 Eff Date: 04/23/2018 method to limit additional procurement time for the project, which is in the best interest of the patients and staff at the Zablocki VA Medical Center.
The CO conducted market research on 3/18/2019, by searching the VIP, SAM and SBA web sites.
Each site allows for targeted searching of registered companies through specific criteria. The conditions used in the search included the NAICS code 238210 (Electrical Contractors and Other Wiring Installation Contractors), socio-economic status and the location (see chart below).

For this new requirement, NCO 12 proposes to establish a sole-source firm fixed price (FFP) contract with Veterans Electric, LLC, (Duns: 829612667), a Vendor Information Pages (VIP) verified Service Disabled Veteran Owned Small Business (SDVOSB) under the Statutory Authority granted to VA in 38 U.S.C. 8127 (Public Law 109-461 or the Veterans Benefits, Health Care and Information Technology Act of 2006). The CO has determined a sole-source FFP contract is the most efficient method to limit additional procurement time for the project, which is in the best interest of the patients and staff at the Zablocki VA Medical Center.
5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
