JUSTIFICATION FOR LIMITING SOURCES (LSJ) – FEDERAL SUPPLY SCHEDULE DELIVERY ORDER

This document is a Justification for Limiting Sources filed by the Department of Veterans Affairs, Veterans Integrated Service Network (VISN) 10, Louis Stokes Cleveland VAMC (CLE VAMC) Network Contracting Office (NCO) 10, under Acquisition Plan Action ID 36C250-26-AP-1907. The contracting officer intends to award a firm-fixed-price delivery order to Olympus America, Inc., a large business, against FSS Contract Number 36F79721D0168 (expires December 31, 2026). The procurement requires a video system center comprising 5 units of CV-1500, 8 units of OEV321UH UHD monitors, and 6 units of AC-300MD power components, with an estimated dollar value of $261,114.00 and a required delivery date of 30 days after receipt of order (ARO). The justification is submitted under GSAR 538.7104-3(b)(1)(ii), citing the exception that only one source is capable of providing the supplies at the required level of quality because the supplies are unique or highly specialized.

The rationale for sole-source limitation is based on the technical requirement for Original Equipment Manufacturer (OEM) Olympus products designed to function as an integrated system with existing Olympus endoscopy platforms currently deployed at CLE VAMC. Market research conducted through GSA eLibrary, the VA National Acquisition Center (NAC), SEWP, FPDS, SAM.gov, and the Small Business Search (SBS) database identified no alternative vendors capable of providing compatible equipment either on an FSS contract or in the open market. Alternative manufacturers' equipment would require replacement of current infrastructure, additional interfaces, clinical staff retraining, and potential workflow disruption. A Notice of Intent to Sole Source (RFI 36C25026Q0284) was posted on SAM.gov on February 17, 2026, with a response date of February 10, 2026, yielding no responses. The document will be posted on e-Buy as required by GSAR 538.7104, as the estimated value exceeds $25,000.

Act of 2002 (PL 107-107) and implemented by GSAR 538.7104-3. Mark the applicable exception:

Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized;

GSAR 538.7104-3(b)(1)(ii));

6. Rationale/explanation to support cited authority: Olympus America, Inc. is the only vendor capable of providing the required video system center components at the level of quality and compatibility required to meet the Cleveland VAMC’s clinical needs, both under the Federal Supply Schedule (FSS) and in the open market. The CV-1500 Video System Center, OEV321UH UHD monitors, and AC-300MD power components are Original Equipment Manufacturer (OEM) products designed to function as an integrated system with existing Olympus endoscopy platforms currently deployed at CLE VAMC.

The Medical Service requires equipment that is fully compatible with the existing Olympus-based endoscopy infrastructure to ensure continuity of care, maintain clinical image quality standards, and avoid disruption to established procedures and workflows. Market research determined that alternative manufacturers’ video system centers are not compatible with the existing Olympus systems and would require replacement of current equipment, additional interfaces, retraining of clinical staff, and potential workflow interruption. As such, these alternatives would not meet the Government’s minimum requirements.

Market research conducted through GSA eLibrary, the VA National Acquisition Center (NAC), SEWP, FPDS, SAM.gov, and the Small Business Search (SBS) database did not identify any other vendors—either on an FSS contract or in the open market—authorized or capable of providing the required Olympus video system center equipment. Olympus America, Inc.

confirmed that it supplies this equipment directly as the OEM and does not utilize authorized distributors for these products.

A Notice of Intent to Sole Source, RFI 36C25026Q0284, was posted on SAM.gov, Contract Opportunities on February 17, 2026 with a response date of February 10, 2026 with no responses.

Accordingly, only Olympus America, Inc. is capable of providing the required supplies at the level of quality, compatibility, and support necessary to meet the Government’s minimum requirements, and limiting sources is justified in accordance with GSAR 538.7104-3(b)(1)(ii).

7. BRAND NAME ONLY This buy is estimated to exceed $25,000 and this documentation will be posted along with the RFQ on e-Buy, as required by GSAR 538.7104.

8. Note that this determination satisfies the requirements of GSAR 538.7104. In accordance with RFO 6 and GSAR 506.303, the requirement to prepare a justification under FAR Part 6 does not apply to orders placed against Federal Supply Schedule contracts.
