4. Discussions: The Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). The Government reserves the right to conduct discussions if it deems it necessary.

EVALUATION FACTORS FOR AWARD

1. Evaluation Factors:

The following evaluation factors will be used to evaluate each proposal. Award will be made to the offeror proposing the most advantageous combination to the Government based upon an integrated assessment of the factors described below.

This is a competitive best value source selection in which past performance is equal in importance to price. By submission of its offer the offeror accedes to all solicitation requirements, including all terms and conditions, representations and certifications, and any technical requirements. Failure to meet a requirement may result in an offer being determined ineligible for award.

Factor 1: Price Proposal

Factor 2: Past Performance

2. Factor 1 - Price Proposal:

Multiple coefficients will be used for the pricing of this acquisition. The Government will evaluate offers for potential award purposes using the pricing information submitted via the Price Evaluation Worksheet Attachment. Each offerors price proposal will be evaluated for completeness, balance, and fair & reasonableness. Offerors shall explain the basis for how the proposed coefficients were developed. The coefficients shall include home office overhead, project management, supervision, equipment, insurance, bonding, profit, subcontractor and/or consultant overhead and profit as may be applicable, and any and all other project related direct and indirect costs. The explanation shall, at a minimum, address the offeror's pricing, and the basis for any assumptions. The price proposal shall be based on the offeror's approach to meeting the Scope of Work Statement overall requirements. It is the offeror's responsibility to demonstrate price reasonableness.

The Offeror’s/contractor’s coefficients (in percentage format, no more than 3 decimal places) shall contain any/all applicable profit and burden costs such as, but not limited to, bond premiums; insurance; compliance with environmental and safety laws/regulations, taxes, overhead, general and administrative expense and any/all other associated indirect costs required to perform the work.

The Government reserves the right to eliminate an offeror from competition if its price is unreasonable Offerors whose price is determined to be incomplete, unreasonable and/or unbalanced may not be considered for award. The offeror’s proposal will be reviewed for compliance with the requirements of the solicitation. If the Contracting Officer (CO)determines the offeror non-responsible, the CO will comply with FAR Subpart 19.6, Certificate of Competency and Determination of Responsibility. Based on the offeror’s price proposal, the offered amounts per CLIN and the proposed Total Evaluated Price (TEP) will be evaluated `for completeness, reasonableness, and balanced pricing.

Completeness: The Government will evaluate completeness of the offeror’s submitted Factor I – Price Proposal. Price Proposals shall be complete and clear and not require additional explanation of information. Completeness is defined as completing in its entirety CLINS 0001, 1001, 2001, 3001, and 4001 and completing the Price Schedule Worksheet in its entirety to include Summary, Base year, Ordering Year One, Ordering Year Two, Ordering Year Three and Ordering Year Four. The Government may make a final determination as to whether a proposal is acceptable or unacceptable based solely on the proposal as presented and submitted.

Reasonable: The offeror’s price proposal will be evaluated to ensure it is fair and reasonable IAW FAR 15.404. Price reasonableness will be based on an evaluation of the offeror’s Total Evaluated Price (TEP). The TEP will be the total/sum of all proposed prices for separately priced contract line items for base plus four years to include CLINS 0001, 1001, 2001, 3001, and 4001. An assessment that the proposal is not reasonable will result in the offer being unacceptable for award. An offeror’s proposal shall represent the offeror’s best efforts to respond to the RFP.

Balanced: In accordance with FAR 15.404-1(g), the Government will evaluate the Offerors Price Evaluation Worksheet of the RFP to determine if the proposed coefficient of one or more of the CLINs is significantly over or understated as indicated by application of price analysis techniques. The proposal may be rejected if it is determined to be unbalanced and as a result poses an unacceptable risk to the Government. Offerors are encouraged to include explanatory notes regarding any fluctuations in coefficients that may otherwise be viewed as unbalanced.

3. Factor 2 - Past Performance:

The past performance assessment will assess the offeror’s ability to successfully accomplish the proposed effort based on the offeror’s demonstrated past work record. The recency and relevancy of the information, the source of the information, context of the data and general trends in the contractor’s performance will be considered. For purposes of this evaluation, recency is defined as active or completed efforts performed within the past five (5) years from the issuance date of this solicitation. The Government will take into account past performance information regarding predecessor companies (if used), affiliates, or other divisions, if such was provided for evaluation and if the offeror’s past performance volume demonstrates the company, affiliate, or division will provide the offeror with resources for the instant proposed effort, such as workforce, management, facilities, or other capabilities demonstrating direct and meaningful involvement in the performance of the proposed instant effort. The purpose of the past performance evaluation is to assess the degree of confidence the government has in the offeror’s ability to successfully perform the requirements of the JOC effort based on the offeror’s demonstrated record of past performance in providing construction projects that met the customer's needs, including cost and schedule.

Past Performance Assessment: In assessing present and past performance, the Government will employ several approaches.

Other Sources of Information: Pursuant to FAR 15.305(a)(2)(ii), the Past Performance Team evaluation is not limited to review of the information provided in the offeror’s Present/Past Performance volume to include but not limited to Past Performance Questionnaire. Present/Past performance information may be obtained from the Government’s Federal Awardee Performance and Integrity Information System (FAPIIS), Contractor Performance Assessment Reporting System (CPARS). The Government reserves the right to use performance information from other sources such as commercial sources. Data from previous source selections may be used if the data is recent and relevant. Note: The attached Past Performance Questionnaire form is optional and can be returned after the proposal due date, but No Later Than (NLT) May 7, 2025.

Adverse Past Performance: Offerors shall be given an opportunity to address adverse past performance information if the offeror has not had a previous opportunity to respond to the information. Recent contracts will be examined to ensure that corrective measures have been implemented. The past performance evaluation assessment will consider issues including but not limited to the number and severity of the problems, the appropriateness and/or effectiveness of any corrective actions taken (not just planned or promised), and the overall work record. Prompt corrective action in isolated instances may not outweigh overall negative trends.

PAST PERFORMANCE RATING DESCRIPTIONS CATEGORIES

RECENCY

RELEVANCY

PERFORMANCE CONFIDENCE

RECENCY

Recency Definition: An evaluation of each past performance information citation will be completed to determine if the project is recent. To be determined recent, a project must be ongoing or completed within the past five years from the date of solicitation issuance. This includes projects awarded prior to this period, but still had performance during the recency timeframe.

RELEVANCY

Relevancy Definition: The Government will perform an independent determination of relevancy of the data provided and/or obtained. A relevancy determination will be made for each Past and Present Performance contract that has met the recency criteria. The Government is not bound by the offeror’s opinion of relevancy. The government will conduct an in-depth evaluation of all recent past performance information to determine scope (broad range of repair, alteration, renovation, maintenance, and minor construction projects on various real property); magnitude (value of the task order/stand-alone contract); and complexity (multiple functions/trades, and performance at multiple locations, etc.) per the Statement of Work.

PERFORMANCE CONFIDENCE

Performance Confidence Definition: The government will perform evaluations of a contractor’s ability to perform a proposed contract successfully. These ratings are based on performance criteria, including quality of work, timeliness, cost control, and customer satisfaction. These criteria are used to gauge a contractor’s reliability and suitability for future contract awards.

Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or is so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a)(2)(iv)). Therefore, the offeror shall be determined to have unknown past performance and will be assigned a performance confidence rating of “Neutral”.

Offerors are cautioned to submit sufficient information and in the format as specified. The Government intends to award a single contract without discussions with respective offerors. Therefore, the offerors initial offer shall contain the offeror's best terms from a price and past performance standpoint. As stated in FAR 15.306(a)(2), 'If the award will be made without conducting discussions, offerors may be given the opportunity to clarify certain aspects of proposals (e.g., the relevance of an offeror's past performance information and adverse past performance information to which the offeror has not previously had an opportunity to respond) or to resolve minor or clerical errors." The Government, however, reserves the right to conduct discussions if deemed in its best interest. Prior to discussions, a competitive range may be established and the offerors within the competitive range will be part of the discussions if deemed necessary. The Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.

D. TASK ORDER PROCEDURES:

Offerors are required to propose on all items as solicited in the Price Schedule to be considered responsive to the Task Order RFP. Offerors shall explain the basis for development of the coefficients. The explanation shall, as a minimum, address the offeror’s perception of the accuracy of the unit price book (RS Means) and the basis for any assumptions regarding expected volume (dollars) of work under the contract.

PRICING:

UNIT PRICE BOOK (UPB): The most recent version of RS Means cost estimating data will serve as the UPB for this contract. The UPB is updated annually after 1 January and no later than 15 January. The contractor’s proposals for the work described in each task order will be based on the pricing information and the units of measure specified in the UPB. Any of the R.S. Means UPB’s could be used in the generation of the government estimates, the specific task order will list which UPB’s are utilized. It is expected that the contractor will use the same UPB’s, but in the event that the contractor has reason to believe a different UPB should be utilized, any line items associated with that UPB must be spelled out in their answer to the Request For Proposal (RFP).

If the government specifies an item, which meets both the RS Means line-item description and the characteristics called out in the Technical Specifications the contractor is obligated to furnish that item, regardless of actual cost compared to the RS Means cost.

UNIT PRICE SOFTWARE: Estimates shall be computed using Unit Type, Standard Union Labor, Master Format 2018 and U S Standard measurement.

Means Cost Works pricing is updated on an annual and quarterly basis, The contractor shall use the Means Cost Works established pricing in effect as of the date the contractor’s Task Order Price Proposal is received by the Government from the contractor. That price shall remain fixed throughout the life of the Task Order.

Working in an Occupied Hospital shall not be added to the RS Means Cost breakdown as a Labor Adjustment Factor. Any cost associated with these factors may be included into the coefficient rate.

LINE-ITEM UNIT PRICES AND QUANTITIES: The price set forth in the RS Means software on the date proposal is due shall be multiplied against the coefficient to determine line-item unit cost. Use location of the facility where work is to be completed for all RS Means pricing.

COEFFICIENT/WAGE DETERMINATION: The purpose of applying the coefficient(s) to direct costs, national average bare costs as obtained from the Unit Price Book, and/or negotiated bare costs of non- Unit Price Book (non-pre-priced) items, is to compensate the Contractor for all indirect costs and profit for performance.

After the first year of the IDIQ contract and each year after, the contracting officer will incorporate a new wage determination into the contract and the most current update of R.S. Means pricing*. The contractor will use the updated R.S. Means Cost Estimating System (unit price book) multiplied by the coefficient in the basic contract to price individual task orders. The coefficient(s) will remain unchanged throughout the life of the contract and no other contract adjustments will be made as a result of the incorporation of the new or revised wage determination. Annual updates will occur on a yearly basis thereafter, IAW with RS Means updates, not from the anniversary date of the awarded contract.

The government expects reasonable coefficients to accomplish the resulting task orders. Submitted coefficient(s) less than one (1.00) requires an acknowledgement from the bonding company that work will be bid and may potentially be accomplished at less than cost.

Task order prices will be based on negotiated quantities times the total of the current established prices in the R.S. Means database bare cost column (which means no markup for overhead and profit (O&P)) times the current City Cost Index (weighted average percentage) for the VA facility location. After the City Index has been applied, his amount will then be multiplied by the coefficient proposed for the applicable category. Any non-priced items will then be added on to the total to arrive at the total task price for a unit of work. Example: Pricing will be determined at the task order level as follows:

Total amount of RS Means items:

x City index x Coefficient + any non-priced (R.S. Means) items = total task order price.

The categories of pricing coefficient(s) in this contract are based on a combination of normal working hours and other than normal working hours. If a task order includes work that has more than one pricing coefficient category, the work will be weighted, and the applicable coefficient applied to its portion of the direct costs.

The Offeror must include a coefficient cost for work to be performed during standard and premium working hours; the appropriate coefficient will be applied to each task order issued under the contract.

LINE-ITEM UNIT PRICES: Unit prices include consideration of direct material, labor, and equipment costs, but do not include indirect costs and profit. Indirect costs and profit are in the coefficients.

NON-PREPRICED ITEMS: Items of work not covered by RS Means Software, but within its scope, may be negotiated by the Contracting Officer. Added items of work shall be incorporated into and made a part of the task order in accordance with VAAR 852.236-88 Changes and shall be performed at the negotiated unit price. Non-prepriced work shall be so noted on each task order. Non-prepriced proposals shall be supported with verifiable documentation showing a minimum of two competitive quotes. Non-prepriced items shall be proposed in bare costs only (material, equipment and labor) multiplied by the quantity and the coefficient. If the dollar value of the non-prepriced items exceeds 10 percent of the dollar value of the task order proposals must be supported with verifiable documentation and quotes from at least three sources.

E. VAAR 852.219-75 VA NOTICE OF LIMITATIONS ON SUBCONTRACTING CERTIFICATE OF COMPLIANCE:

Offers are reminded to complete the attached VA Notice of Limitations on Subcontracting Certificate of Compliance. To be eligible for evaluation and consideration for award, offerors must return the entire LOS Certificate of Compliance clause containing a fully completed certification at the time offers are due. Otherwise, the offer will be rejected and not forwarded for evaluation. In addition to other offeror ‘fill-in’ requirements for this clause, a fully completed certification must include the insertion of the offeror’s name in the brackets containing the following verbiage: “[Insert Name of Offeror]”.
