About this file
This document is a Solicitation Modification for a Request for Quote (RFQ) for Underground Fuel Storage Tank Inspection & Maintenance at the Detroit Veterans Affairs Medical Center (VAMC). The solicitation (Number 36C25025Q0578) is issued by the Department of Veterans Affairs Network Contracting Office in Kettering, Ohio, with a target implementation date of 05-29-2025. The modification addresses five contractor questions related to contract terms, including clarifications on option year wage rates, contract duration, and service contract labor standards.
Key details include a potential five-year contract with an option to extend, governed by Service Contract Labor Standards (SCLS) wage determinations. The VA clarified that while service wages might differ from local tradesman rates, contractors must meet minimum SCA wage requirements. The modification also removes a specific contract clause (FAR 52.237-3) and confirms the solicitation was posted to SAM.gov on 5/15/2025. Contractors are expected to submit pricing that complies with the specified wage determinations, with the understanding that actual wages can exceed the minimum rates as determined by the contractor.

Morgan Stein Contracting Officer
The purpose of this Solicitation modification is the following:
1. To provide responses to questions received to the Solicitation. See attached Questions with VA Responses document.
2. Remove clause FAR 52.237-3 from the requirement.
Question 1) C.2 52.217-9 Page 22 option to extend. Presumably this would occur at the end of the last option year, if so would additional funds that the Government would pay, be based on the wages that we have to pay or the published service wages. There is a considerable difference. Please elaborate.
VA Response: This not a technical question. However, C.2 refers to FAR 52.217-8, not -9. The option to extend the contract may be exercised at the end of the five-year period. When the government exercises this option, additional funds will be provided based on the terms of the contract. The wage rates applicable during the option period will follow the Service Contract Labor Standards (SCLS) or any other relevant wage determinations. The wage rates published at the time of contract modification or exercise of the option will serve as the basis for any potential pricing adjustments.
If there are changes to the wage determinations by the Department of Labor, the awardee/vendor is required to provide documented evidence of these changes and how they impact pricing. It is the vendor's responsibility to inform the Government of these changes by submitting a request that documents how the wage rates have changed from the original contract price. The Contracting Officer (CO) will then review the submission and determine if any adjustments are warranted. The burden of proof lies with the vendor. The extent of any difference in rates is not predetermined and will be evaluated on a case-by-case basis.
Question 2) C.4 continuity of service effectively could require us to be present for an additional 6 mos with training personnel making the contract a 5.5 year effort. Is this correct, please elaborate.
VA Response: Could – This not a technical question. However, this clause is being removed from this solicitation and requirement, as indicated in Block 14 of this solicitation modification.
Question 3) Items 1 & 2 above would potentially affect our pricing VA Response: This is not a technical question. No question was indicated; therefore, no response is provided.
Question 4) I am not able to, at the time of writing, to see this effort in SAM.Gov.
VA Response: This is not a technical question. However, please note that the solicitation was successfully posted to SAM.gov on 5/15/2025.
Question 5) The published service wages (particularly in reference to paragraphs C.2, 3 & 4) are considerably less than a tradesman or technician in the Detroit area would get (i.e. Davis Bacon wages). Would we be held to the lower service wages for additional work reimbursement or would we be allowed Davis Bacon wages?
VA Response: This is not a technical question. However, the minimum rate you are required to pay must adhere to the SCA (Service Contract Act) wage determinations. As a business, you may set your rates as you see fit, provided they meet or exceed the minimum SCA rates for the applicable worker classifications. Davis-Bacon wage rates do not apply, as they are specific to construction contracts. You are free to pay your employees as you deem appropriate, as long as you comply with the minimum SCA wage requirements.
