Justification and Approval (J&A) For
Single (Sole) Source over $250,000
Acquisition Plan Action ID: TBD 2237 No.: 506-25-1-586-0003
1. Contracting Activity: Department of Veterans Affairs, VISN 10, VA Ann Arbor Medical Center
2. Nature and/or Description of the Action Being Processed: Repairs and upgrades to Elevator S4. Required to correct issues related to a citation for a failed weight test.
3. Description of Construction – Scope of Work Statement: Upgrades for Elevator S4 in building 1E To get this elevator back in service.
4. Statutory Authority Permitting Other than Full and Open Competition:
( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per 41 USC §3304(a)(1) as implemented by FAR 6.302-1;
( X) (2) Unusual and Compelling Urgency per 41 USC §3304(a)(2) as implemented by FAR 6.302-2;
5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the
Authority Cited Above (applicability of authority):
Unusual and Compelling Urgency (FAR 6.302-2, 6.303-2(a)(9)(ii)) –
The contractor currently holds our existing elevator Maintenance contract. Contractor is very familiar with the facility and the technical issues concerning the failed elevator certification tests due to their work on the elevator maintenance contract.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:
NA due to the urgent and compelling nature of the issue.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The
Contracting Officer shall determine fair and reasonable price based on market research and comparison to similar services provided by the set-aside SDVOSB.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:
The elevator for this acquisition is non-functional and simple repairs are not possible. Additionally, this elevator due to age etc is now being cannibalized for parts to help keep elevator S-3 operational. This contractor is being selected due to their performance on our elevator Maintenance contract and their performance on two separate acquisitions for the upgrade of another 14 elevators on this site. Their unique qualifications are their Existing knowledge of our systems. Availability of labor and materials necessary to execute the work.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition:
The elevator for this acquisition is non-functional and simple repairs are not possible. Additionally, this elevator due to age etc. is now being cannibalized for parts to help keep elevator S-3 operational. This contractor is being selected due to their performance on our elevator Maintenance contract and their performance on two separate acquisitions for the upgrade of another 14 elevators on this site. Their unique qualifications are their Existing knowledge of our systems. Availability of labor and materials necessary to execute the work.
This is a limited risk that elevator S-3 will fail during this acquisition period. Failure of S-3 while S-4 is out of service would cause significant and negative impacts to facilities operations for OR procedure medical emergency response etc.
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:
Elevated Technologies – SDVOSB firm for elevator work
11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:
Continued work for elevator upgrades through the normal capital planning program. The facility has been and shall continue through the normal process for the remaining elevators on site. A separate acquisition for the design and replacement of 13 additional elevators will be awarded soon.
12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
