About this file
This document is an amendment to a solicitation for wheelchair transportation services at the Cincinnati VA Medical Center. The amendment provides responses to questions submitted by offerors regarding the contract requirements. Key details include:
The incumbent provider is First Care Ohio, LLC, which provides wheelchair transportation services. The solicitation is for a small business set-aside, as the VA's market research did not identify two Service-Disabled Veteran-Owned Small Businesses (SDVOSBs) or Veteran-Owned Small Businesses (VOSBs) with the required Emergency, Medical, and Fire Transportation Service (EMFTS) certification who were interested in bidding. The VA requires the contractor to have EMFTS licensing in Ohio, Kentucky, and Indiana, as well as a Cincinnati chauffeur license, to perform the services. Pricing is to account for unaccompanied travel time and mileage, as the contractor may need to travel over 100 miles to reach veteran residences. No additional pricing CLINs will be added for these trips. The VA does not have a requirement for 24/7 on-call services or a differential for night trips, as historical usage has not included after-hours transportation.

Questions and Responses
1. The solicitation set 5 days for a successor company to provide drivers lists. When will the contracting officer provide the certified list of the names, mailing addresses, and if known, phone numbers and email addresses of all service employees working under the contract and its subcontracts at the time the list is submitted for current or predecessor contractors or their subcontractors.
Response: The incumbent, within 5 days, will email the awardee a list of employees willing/wishing to change companies from the incumbent to the follow-on awardee.
1. Who are the current or predecessor contractors and subcontractors providing ambulatory, wheelchair, and stretcher rides services?
Response: The incumbent for the Wheelchair Transportation Services that provides Wheelchair transportation for Cincinnati VAMC is First Care Ohio, LLC. Ambulatory or Stretcher services does not pertain to this acquisition.
1. How Are there currently and will there be in the future any ambulatory rides provided by veteran owned companies under a contract or any other means where a driver will transport a veteran and receive compensation from the VA?
Response: This acquisition is not for ambulatory.
1. The solicitation for the previous or current First Care ambulance contract 36C25019Q9582, provides in Para 5.4.17 required vehicles to be configured for wheelchair rides. Will wheelchair rides still be provided under any other means and how is that not a conflict with VETFIRST or first right of refusal after contract award?
Response: The purpose of this acquisition is to award a contract to a vendor to provide wheelchair patients to/from appoints. Question number 11 goes in depth with the VETS FIRST program. Please review that answer.
1. Are there currently any wheelchair rides being performed outside this contract, if so by whom?
Response: We maintain our own Veteran Transportation Service (VTS) program that provides Wheelchair trips and community programs that provide wheelchair transport when available.
1. Para 5.4.20 A fixed seat position or a fixed secured floor or sidewall wheelchair lock must be approved for each ambulatory or wheelchair restricted passenger being transported, according to the passenger’s needs. Driver shall ensure wheelchair locks are secured and seat belts and shoulder harnesses are in place before the vehicle is driven, how many ambulatory, wheelchair, and stretcher rides are being performed per month are being performed and by who?
Response: See Question 12 response.
1. Does Uber/Lyft, DAV, transit authorities (in Ohio, Indiana, Kentucky), county veteran organizations, or any other entities provide rides for rides for veterans and of so, who and how many by types including para transit?
Response: Yes. It varies month to month.
1. How does the government receive vehicle information (safety/inspections/license plates/etc.), driver information (license number, list, etc.) from Uber/Lyft, DAV, transit authority?
Response: Not applicable.
1. The VA paying beneficiary travel to veterans, how is the government providing ambulatory/stretcher reides without a practice of allowing unwarranted VA employees to select vendors, and award them contracts for these type rides?
Response: Ambulatory/stretcher rides do not pertain to this acquisition.
1. Since the contract is afterhours (24/7). Is there not be a Afterhour CLIN that was factored in the IGCE that pays for standby/on call time or something in the solicitation that evaluation this services that is not contracted under the normal duty times between 7am-7pm?
Response: All CLINS have been added to the Cost Schedule. No other CLINS will be added. No deferential will be added for an after normal duty time scheduled trip. We have this in the PWS to enable us to use it if needed. Over the past 5 years we have not had a wheelchair transportation trip after normal duty times.
1. Under what contract will these type of rides be provided and will these type of rides that does not seem to be part of a current contract comply with the rule of two or VETFIRST?
Response: The VA’s Vets First Contracting Program is a crucial initiative within the Department of Veteran Affairs. The VA has a longstanding commitment to contracting with SDVOSBs and VOSBs. The program’s goal to support and empower vets by providing them with opportunities to participate in federal procurement.
In this acquisition specifically, our Market Research did not identify two SDVOSBs and/or VOSBs with an Emergency, Medical, and Fire Transportation Service (EMFTS) certification that were interested in submitting a quote, hence the requirement has been solicited as a small business set-aside.
1. What are the number of all rides and who are they being performed by?
Response: This solicitation provides estimated quantities which are based on historical utilization of incumbent contract.
1. Para 1.3 calls for the contractor to travel at an undetermined distance outside of the 20-mile radius with no mileage reimbursement until they reach the veteran home. How will the contractor be paid for driver time, vehicle wear and tear, mileage, gas, etc. for a instance where they must first travel over 100 or more miles to reach the veteran home?
Response: Offerors are to price CLINs to account for unaccompanied time and mileage. We do not intend to add additional CLINs to the cost schedule or approve additional invoicing for services not on the price schedule.
1. Under what CLIN did the government IGCE factor this cost in or how does the government expect the contractor to be reimbursed for to trip to the veteran's home? Please provide example of how such reimbursement would work?
Response: The Government IGCE is not public information. It is a tool used to assist with budgeting of few acquisitions and in some cases assist with determining fair and reasonableness of offerors quoted prices.
1. Is the VA considered a health care facility, as defined in section 1751.01 of the Ohio Revised Code, that provides ambulette services only to patients of that facility?
Response: No. Not exclusively to the Cincinnati VAMC. We offer veterans who require wheelchair transportation service to/from not just the Cincinnati VAMC, but also to local clinics, public hospitals, and other VA medical facilities.
1. Is the contract require the contractor to provide services to the public on a regular basis for the purpose of transporting individuals who require the use of a wheelchair or other mobility aid to receive health care services?
Response: The services provided by this contract will be offered to qualifying veterans. This service is not limited to the Cincinnati VA Medical Center location. Other locations may include local clinics, public hospitals, and other VA medical facilities.
1. The contract requirements operations in Indiana, Kentucky, and Ohio. What are the licensing requirements for each jurisdiction and for a foreign entity that is not based on Ohio or does not transport the Ohio general public or accept Medicare/Medicaid payments?
Response: Contractor licenses are required to operate this service in Kentucky, Ohio, and Cincinnati. Those licenses are Disabled Persons Vehicle (DPV), EMFTS and Cincinnati’s chauffeur license. The Contract Specialist contacted the state of Indiana Department of Homeland Security and Indiana does not require a license for this service. Commonwealth of Kentucky requires a DPV authority. This licenses generally can be granted same day as the application. Proof of EMFTS license will be the only license we require at the time of offer submittal due to the length it takes to acquire.
Commonwealth of Kentucky requires a Disabled Persons Vehicle Authority Application found on form TC 95-594 on KY Motor Carriers forms library Forms Library (TC 95) | KYTC.
Cincinnati Chauffeur License can be obtained by contacting Officer Funk of Public Vehicles department at 513-352-3708.
State of Ohio Board of Emergency Medical, Fire, and Transportation Services can be found https://ems.ohio.gov/about-us/state-board-of-emfts
1. Kentucky has a wheelchair licensing requirement, why does Kentucky licensing requirements for a company operating in Erlanger or Florence and within 5 mins of the Kentucky CBOC, 10 minutes of Cincinnati VA, about a half hour from the Indiana CBOC, and a little over an hour from the farthest Ohio CBOC not meet VA needs for safety and inspections versus the Ohio licensing for emergency medical fire transportation service?
Response: The EMFTS requires licenses to perform wheelchair services. This license can take a little as 30 days to acquire, but the normal time it takes for a contractor is 180 to 270 days. It is for this reason we require EMFTS license at the time of offeror’s quote.
1. What is the government need for a license if a company is operating out of Kentucky or Indiana where they are not providing patient care and dropping patients off in Kentucky, Ohio, Indiana?
Response: EMFTS is a state required license. Since transportation will be to/from public own medical facilities and clinic, the EMFTS license is required.
1. What is the government need for a current CPR certification when the contract is not for BLS or patient care and is there an obligation for a driver or attendant to administer CPR to a veteran they have no work or other personnel relationship with?
Response: There is no law that requires a person to perform CPR on a patient. We are requiring our transportation services to have this available.
1. What is the government need for contractor patient care requirement of the EMFTS license for oxygen indicates and mandates providing BLS that would require in patient care for the use oxygen on veterans experiencing cardiac arrest, respiratory distress, or an obstructed airway?
Response: Some patients are wheelchair bound and transport their own personal O2 tanks.
1. There is no price realism in evaluation a price for a trip when it also includes unknown quanities of addons such as attendants. There is not CLIN that describe quanity of Attendant services. Please describie or quanify with the number on how often and how many times this service will be used? What is the historic daily use of attendants?
Response: The services we require for this acquisition has been listed in the PWS and listed as invoiceable actions in the CLIN structure found on the Cost Schedule. Quantities are estimated and have been calculated from historical utilization of past contract(s). This requirement has been solicited using FAR Part 13, Simplified Acquisition Procedures, which does not provide for an evaluation of price realism.
1. Please provide the CLIN used by the government on it's IGCE that pays for on call time imposed by the 24 hr contract requirement and for attendant the go on call when travelling with a veteran when the VA request limits on their movement for the to and from trip?
Response: We do not have a 24 on call CLIN. We do not intend to add this CLIN to the Cost Schedule.
1. What is the historic usage for trips outside of the 7am-7pm window? Has the government provided a CLIN in the IGCE that accounts for for Night pay which is a 10 percent differential paid to an employee for regularly scheduled work performed at night?
Response: We have yet to have a trip after normal duty hours. We have the PWS worded incase that service is needed.
No, we will not offer any differential for those trips.
1. If a company does not transport the Ohio public for Medicare patients (i.e., non-veterans), what is the VA need for the EMFTS license?
Response: See Question 19 response.
1. Please explain how the VA need for safety and inspections is meet by the EMFTS and how such information (one annual inspection/renewal) will be accessed and utilized by the VA to meet it's needs?
Response: See Question 19 response.
1. How is the EMFTS meeting the safety and inspections requirements of Kentucky and Indiana as if the Ohio license apply to this VA contract, Kentucky licensing requirements will also apply in meeting the VA needs for safety and inspections and would make operating in Kentucky illegal without meeting the same licensing requirement as needed in Ohio?
Response: See Question 17 response.
1. How are VA needs for safety and inspections meet by VTS in states that do not have a EMFTS license?
Response: See Question 19 response.
