About this file

This document is a Single Source Justification for Simplified Acquisition Procedures (SAP) under the Simplified Acquisition Threshold (SAT) for the Department of Veterans Affairs (VA). It describes a requirement to upgrade the Building Automation System (BAS) at the Richard L. Roudebush VA Medical Center (VAMC) in Indianapolis, Indiana. The upgrade is needed to improve the reliability and compatibility of the BAS, which is critical for patient safety and facility operations. The total estimated cost for the one-time purchase is $45,446. The justification cites the highly specialized nature of the existing BAS and the need for expertise in information technology, computer networking, and HVAC systems. The incumbent maintenance contractor, Conserv, Inc. (a small business), is identified as the only source capable of meeting the agency's requirements without substantial duplication of costs or unacceptable delays. The related federal contract opportunity indicates that the VA awarded a contract to Conserv, Inc. on July 24, 2024 for the BAS upgrade.

VHAPG Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source

Attachment 1: Single Source Justification for SAP under the SAT

DEPARTMENT OF VETERANS AFFAIRS

Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C250-24-AP-3020

1. Contracting Activity: Department of Veterans Affairs, Network Contracting Office (NCO) 10 located at 260 E University Avenue, Cincinnati, OH 45219-2356, in support of VISN 10, Richard L. Roudebush (RLR) VA Medical Center (VAMC), 1481 West 10th Street, Indianapolis, IN 46202-2803. 2237 #: 583-24-4-663-0152

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: This new request by the RLR VAMC is proposed to upgrade their out-of-date brand name Building Automated System (BAS). The BAS is used to monitor and control HVAC mechanical equipment in the facility that is critical to patient safety and facility operations. The upgrade will improve reliability of the BAS and compatibility with existing equipment within the facility. The requested brand name supplies/services includes:

FX20 – JACE Network Controller (FX-28) - Quantity of 1

FX20 – JACE Network Controller (FX-33) - Quantity of 1 FX30 – JACE Network Controller (IJ-02) - Quantity of 1

FX30 – JACE Network Controller (IJ-03) - Quantity of 1 FX30 – JACE Network Controller (IJ-04) - Quantity of 1 SVR – Niagara Server – Quantity of 1

SVR – Server Hardware Replacement – Quantity of 1

The estimated cost of this one-time purchase is $45,446.00.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: The highly complex and specialized nature of the RLR VAMC’s BAS dictates that the Controls Integration Contractor must demonstrate the experience, ability, knowledge, and skills in the areas of information technology, computer network design, object-oriented programming techniques, large scale hospital HVAC systems, government acquisition policies, the phasing of renovations in a hospital environment, the specific policies and standards for the existing and future state building management at the RLR VAMC, and all applicable VA standards for HVAC and building control systems.

Conserv, Inc (Small Business) currently has a contract for the maintenance of the BMS. The OEM, Johnson Controls, Inc is a large business. OEM letter dated 05/23/2024 is on file confirming that Conserv, Inc is an Authorized Building Controls Specialist (ABCS) channel partner authorized reseller within their contracted territory. Using a non-authorized dealer to replace these controllers would void any warranty on the system. Accordingly, based on experience at the RLR VAMC by the Government’s technical experts, Conserv, Inc is the only firm capable of providing the supplies and services described in this section without the agency experiencing substantial duplication of cost that could not be expected to be recovered through competition and unacceptable delays in fulfilling its requirements.

4. Description of market research conducted and results or statement why it was not conducted: Market research queries were conducted using VetCert, GSA eLibrary, GSA Advantage, DSBS, VA NAC, Ability One databases, and other resources. The results found that the OEM, Johnson Controls, is a large business. Due to the existing maintenance contract for the RLR VAMC BAS, Conserv, Inc has been identified as the sole small business capable of meeting the agency needs for this requirement. There is not a reasonable expectation of obtaining offers from two or more responsible small business concerns. The VA and SBA Rules of Two cannot be obtained. Based upon market research and comparison to the Government IGCE, there is a reasonable expectation that award can be made at a fair and reasonable price offering best value from Conserv, Inc.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
