B.3 CONTRACTOR PERFORMANCE ASSESSMENT REPORTING SYSTEM (CPARS)
As prescribed in FAR Part 42.15, the Department of Veterans Affairs (VA) evaluates contractor past performance on all contracts and contracts that exceed $250,000.00 and shares those evaluations with other Federal Government contract specialists and procurement officials. The FAR requires that the contractor be provided an opportunity to comment on past performance evaluations prior to each report closing. To fulfill this requirement VA uses an online database, CPARS, which is maintained by the Naval Sea Logistics Center in Portsmouth, New Hampshire.
Each contractor whose contract award is estimated to exceed $250,000.00 requires a CPARs evaluation. A Government Focal Point will register your contract within 30 days after award and, at that time, you will receive and email message with a User ID (to be used when reviewing evaluations). Additional information regarding the evaluation process can be found at www.cpars.gov or if you have any questions, you may contact the Customer Support Desk at DSN: 684-1690 or COMM: 207-438-1690.
For contracts with a period of one year or less, the contracting officer will perform a single evaluation when the contract is complete. For contracts exceeding one year, the contracting officer will evaluate the contractor’s performance annually. Interim reports will be filed each year until the last year of the contract, when the final report will be completed. The report shall be assigned in CPARS to the contractor’s designated representative for comment. The contractor representative will have 60 days to submit any comments and re-assign the report to the CO.
Failure for the contractor’s representative to respond to the evaluation within those 60 days will result in the governments evaluation being placed on file in the database with a statement that the contractor failed to respond. The Contractor’s representative will be locked out of the evaluation and may no longer send comments.

13. Quality Assurance Surveillance Plan (QASP)
a. The Vendor will be evaluated in accordance with the QASP. The QASP provides a systematic method to evaluate performance for the stated BPA.
b. This QASP explains the following:
i. What will be monitored?
ii. How will the monitoring take place?
iii. Who will conduct the monitoring?
iv. How will monitoring efforts and results be documented?
c. This QASP does not detail how the vendor accomplishes the work. Rather, the QASP is created with the premise that the vendor is responsible for management and quality control actions to meet the terms of the BPA. It is the Government’s responsibility to be objective, fair, and consistent in evaluating performance.
d. This QASP is a “living document” and the Government may review and revise it on a regular basis. However, the Government shall coordinate changes with the vendor through BPA modification. Copies of the original QASP and revisions shall be provided to the vendor and Government officials implementing surveillance activities.
e. Government Roles and Responsibilities:
i. The following personnel shall oversee and coordinate surveillance activities.
1. Contracting Officer (CO) – The CO shall ensure performance of all necessary actions for effective contracting, ensure compliance with the BPA terms, and shall safeguard the interests of the United States in the contractual relationship. The CO shall also assure that the Vendor receives impartial, fair, and equitable treatment under this BPA. The CO is ultimately responsible for the final determination of the adequacy of the Vendor’s performance.
2. Contracting Officer’s Representative (COR) – The COR is responsible for technical administration of the BPA and shall assure proper Government surveillance of the Vendor’s performance. The COR shall keep a quality assurance file. The COR is not empowered to make any contractual commitments or to authorize any contractual changes on the Government’s behalf.
f. Performance Standards:
i. The Vendor is responsible for performance of ALL terms and conditions of the BPA. CORs will provide BPA progress reports quarterly to the CO reflecting performance on this plan and all other aspects of the resultant BPA. The performance standards outlined in this QASP shall be used to determine the level of vendor performance in the elements defined.
Performance standards define desired services. The Government performs surveillance to determine the level of vendor performance to these standards.
g. Methods of QA Surveillance:
i. Various methods exist to monitor performance. The COR shall use the surveillance methods listed below in the administration of this QASP.
1. Direct observation: 100% surveillance
2. Periodic inspections: inspections scheduled and reported quarterly per COR delegation or as needed.
3. Validated user/customer complaints: data shall be collected from actual patient complaints. Complaints shall be investigated and verified.
4. Random sampling: vendor logbooks shall be reviewed by COR for compliance
5. Verification and/or documentation provided by vendor: vendor provided information on services provided to COR.
h. Performance Requirements:
i. The Performance Requirements are listed below. The Government shall use these standards to determine vendor performance and shall compare vendor performance to the standard and assign a rating. At the end of the performance period, these ratings will be used, in part, to establish the past performance of the vendor on the BPA and for purposes of providing the CO with information for inclusion on CPARS:

(response and documentation from vendor)
This is a critical element that shall be successfully performed daily. If the Contractor does not immediately or as soon as practicable notify the Government of the delay or inability to perform, the Contractor shall be held to the disincentive above. The Government may be able to have the specimens re-contained in the appropriate manner to avoid spoilage or contamination. This disincentive is based on the VA’s internal costs of the medical professionals performing the tests and packaging the transport coolers, the need for patients having to return for retesting, as well as overtime costs required.
14. Problem Resolution
The CO, upon discussion with COR and VA lab personnel, will resolve complaints concerning vendor relations with Government employees and/or patients. The CO is final authority on validating complaints. In the event the vendor is involved and named in a validated complaint, the Government reserves the right to refuse acceptance of the services being rendered. This does not preclude refusal in the event of incidents involving physical or verbal abuse by vendor personnel towards VA personnel, CBOC personnel, COR, and other vendor personnel while performing services as specified in this BPA.
If vendor performance does not meet the Acceptable Quality level, the CO shall inform the Vendor. This will normally be in writing unless circumstances necessitate verbal communication. In any case the CO shall document the discussion and place it in the contract file. When the COR and the CO determines formal written communication is required, the COR shall prepare a Contract Discrepancy Report (CDR), and present it to CO. The CO will in turn review and will present to the vendor's program manager for corrective action.
The Vendor shall acknowledge receipt of the CDR in writing. The CDR will specify if the Vendor is required to prepare a corrective action plan to document how the Vendor shall correct the unacceptable performance and avoid a recurrence.
The CDR will also state how long after receipt the Vendor has to present this corrective action plan to the CO. The Government shall review the Vendor's corrective action plan to determine acceptability. The CO is ultimately responsible for the final determination of the adequacy of the vendor’s performance and the acceptability of the vendor’s corrective action plan. Any CDRs may become a part of the supporting documentation for any contractual action deemed necessary by the CO or for purposes of reporting vendor past performance on CPARS.
The solicitation and subsequent contact include FAR 52.222-41, Service Contract Labor Standards (SCLS). The Offeror and resultant contract awardee, by signing the offer and contract, is acknowledging they have reviewed the clause and will fully comply throughout the contract period. It is the responsibility of the Contractor to determine and pay the appropriate prevailing wage rate and fringe benefits for the location. The Government will not be held responsible for any mistakes in applying the SCLS.
VA reminds contractors of the Department of Labor Regulations which implement the SCLS and which reads at 29 CFR § 4.155:
Employee coverage does not depend on form of employment contract. The Act, in section 8(b), makes it plain that the coverage of service employees depends on whether their work for the contractor or subcontractor on a covered contract is that of a service employee as defined in section 8(b) and not on any contractual relationship that may be alleged to exist between the contractor or subcontractor and such persons. In other words, any person, except those discussed in §4.156 below, who performs work called for by a contract or that portion of a contract subject to the Act is, per se, a service employee. Thus, for example, a person's status as an “owner-operator” or an “independent contractor” is immaterial in determining coverage under the Act and all such persons performing the work of service employees must be compensated in accordance with the Act's requirements.
