3. Description of Supplies or Services: The X-ray Department currently uses a weightbearing foot/ankle imaging platform to place patients in the optimal position for easy capture of weight bearing foot images during their x-ray procedures. Those images are used by Podiatry/Orthopedic Clinicians to assist in their ability to assess the impact of weight on the bones in the feet/ankles of patients with a multitude of foot/ankle problems. Additional brand name or equal platforms are needed for (2) other x-ray rooms at the facility. The requested item is:
· CD-24701 – STEP PLATFORM FOR U-ARM SYSTEM – Quantity of 2
- Must be easily mobile (on wheels with locking mechanism)
- 500 lbs weight limit
- Easy to clean/disinfect
- Must have a wide, clear top to allow imaging of both feet at once, as needed
Market research queries were conducted using VetCert, DSBS, VA NAC, FPDS-NG, GSA Library databases and other resources. The results found that the OEM, Clear Images Devices, LLC is a large business. The OEM was called and a follow-up email sent to confirm authorized distributing vendors. Confirmation was received that resellers exist; however, the OEM was unable to confirm their identities at this time. Emails were also sent to other known medical/imaging equipment vendors to determine product availability. Replies were received from (1) SB and (1) LB confirming availability. There is no reasonable expectation of obtaining two or more offers from responsible SB concerns.
The product is not listed in the NMR Class Waiver database. The VA and SBA Rules of Two cannot be met. An unrestricted solicitation will be posted to the GPE at SAM.gov.
The estimated value of the proposed action is $ 13,766.00
4. Authority:
Order Against FSS: Authority of the Multiple Award Schedule Program, Title III of the Federal Property and Administrative Services Act of 1949 (41 USC 251, et seq.); Title 40 USC 501, Services for Executive Agencies; and Section 803 of the National Defense Authorization Act of 2002 (PL 107-107) and implemented by FAR 8.405-6. Mark the applicable exception:
|_| An urgent and compelling need exists, and following the procedures would result in unacceptable delays(FAR 8.405-6(a)(1)(i)(A);
|_| Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; (FAR 8.405-6(a)(1)(i)(B));
|_| In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order and the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order was not previously issued under sole-source or limited-sources procedures (FAR 8.405-6(a)(1)(i)(C)); or
|X| Items peculiar to one manufacturer. An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer). A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer (FAR 8.405-6(b)).
5. Rationale/explanation to support cited authority: The weightbearing foot/ankle imaging platform currently in use at the facility is manufactured by Clear Image Devices, LLC. The staff has found this unit to be very stable for patients to stand during the imaging process when compared to previously used models. This platform meets the facility’s Safe Patient Handling and Mobility requirements; helps staff maintain reusable medical equipment standards; and comply with OSHA requirements set forth in VA Directive 1220, VA Handbook 6500.6, OEM product use instructions, and other resources.
The same platforms are needed in the additional x-ray rooms to maintain consistency. They would allow employees to routinely use the same product regardless of the imaging room being utilized; ensuring predictable image quality throughout the department.
6. Note that this determination satisfies the requirements of FAR 8.405-6. The requirement to prepare a written justification IAW FAR 6.303 does not apply to Federal Supply Schedules.
