B.2 STATEMENT OF WORK

Part I: General Information A. Introduction The Department of Veterans Affairs, Aleda E. Lutz VAMC located at Saginaw, Michigan requires a comprehensive confined space evaluation and associated employee training to help minimize safety risks that may be associated with confined space entry. A site visit will be arranged for review of the facility.

B. Background Aleda E. Lutz VAMC needs to maintain compliance with federal Occupational Safety and Health Administration’s standard for Confined Space Entry, 29 CFR 1910.146 and Confined Space in Construction Standard, 29 CFR 1926. Aleda E. Lutz VAMC has requested support to deploy safety expertise and services to conduct a confined space evaluation, which will include an audit, space identification and classification, entry procedures, and employee training for permit and non-permit required confined spaces located throughout the Saginaw campus.

C. Scope

The Contractor shall provide all necessary labor, supplies (i.e. manhole cover remover), equipment and reports for confined space identification and auditing, space classification, entry procedure identification, hazards with the confined spaces and employee training. In addition, update the required confined space program for the facility including review and updates on internal and contractor forms for entry.

D. Applicable Regulations:

· Confined Space Entry, 29 CFR 1910.146

· Confined Space in Construction Standard, 29 CFR 1926etc

Part II: Work Requirements & Qualifications

A. Qualifications of Contractor Personnel:

a. Majority of the work must be performed by a Safety and Health Technician with knowledge, skills and abilities to acutely execute all requirements in this contract for confined space.

b. All work shall be reviewed and approved by a contractor that is either Certified Safety Professional (CSP) or Certified Industrial Hygienist (CIH).

B. Technical Requirements/Deliverables:

a. Contractor shall provide all necessary labor, supplies, equipment and reports the Aleda E. Lutz VAMC confined space evaluation and training project.

i. Tasks include the entire campus are as follows:

1. Confined space identification and auditing

2. Space identification/classification

3. Entry procedure identification and policy development

4. Identification of all hazards within the confined spaces

5. Employee training

6. Review and revisions of the facility’s current Confined Space Program and forms.

C. Qualified Safety Professional(s) shall visit the campus to conduct an on-site evaluation to further understand the current and potential confined spaces inside and outside of the facility’s buildings. All buildings are included in Appendix A and the site map in Appendix B.

a. In order to provide safe entry, the hazards within these spaces must be identified and classified.

b. Contractor shall collaborate with the COR at Aleda E. Lutz VAMC to evaluate the number of confined spaces and hazards within each area, such as engulfment or atmospheric hazards etc.

i. Each individual space will need to be surveyed, hazards identified, and assessed.

ii. List of the building and square footage are attached in Appendix A.

D. Contractor shall evaluate the compliance and behavioral application of any existing confined space entry procedures, identify gaps, and provide an action plan for improvement.

a. Contractor shall prepare confined space entry procedures (Program Policy), to include recommendations for proper labeling of each confined space in accordance with Confined Space Entry, 29 CFR 1910.146 and Confined Space in Construction Standard, 29 CFR 1926 to help the Aleda E. Lutz VAMC employees safely navigate and perform required work within the discovered confined spaces.

b. Contractor shall compile new entry procedures into a standardized format, consistent with Aleda E. Lutz VAMC formatting and maintain any applicable and existing identification systems (procedure numbers, space IDs, etc.). This will also involve collaboration with local fire department for emergency procedures.

c. Contractor shall include visual documentation, an electronic map, and excel database with GPS location information for all identified spaces. This database will note the type of space, and hazards within each space.

E. Contractor shall attach warning signs and/or appropriate placarding at the entrance to all designated permit-required/non-permit required confined spaces.

a. Signs are designed to notify individuals who might not otherwise recognize a confined space as permit required and enter them inadvertently.

b. Outside confined spaces signage to be made of durable material or metal to withstand the weather.

c. Indoor confined spaces signage to made to withstand regular cleaning.

F. Contractor shall work with Aleda E. Lutz VAMC to deliver one session of Confined Space Training for appropriate employees regarding the existence and location of each confined space and the hazards they pose.

a. In accordance with Confined Space Entry, 29 CFR 1910.146 and Confined Space in Construction Standard, 29 CFR 1926 for confined space entry, a qualified instructor(s) shall visit each campus to conduct training sessions.

i. Training shall be conducted utilizing:

1. Computer presentations

2. Videos

3. Case Studies

4. Exercises

5. Graphics

ii. Training shall be cover and is not limited to:

1. Hazard identification

2. Avoidance

3. Control and prevention

4. Responsibilities as outlined by OSHA standards.

iii. Upon successful completion of Training, participants shall be presented with certificates of achievement.

iv. The training must include a classroom and field training elements as appropriate to the operator level. Field training for VAMC staff will be conducted. The contractor is responsible for providing all training materials.

v. The training shall include the submission of an electronic copy of the training for future facility training use. The contractor will provide all training materials in Microsoft Word 2016, Power Point and CAD 2013 in an unlocked electronic copy. In addition, hard copies of the materials will be provided as well.

PART III: SUPPORTING INFORMATION

A. Security All Contractor employees shall comply with VA security management and obtain temporary VA badges.

B. Place of Performance

C. Period of Performance

Period of Performance shall be from the date of award, not to exceed 90 days.

D. Hours of Work

All work shall be performed during regular business hours (8:00 am to 4:30 pm) unless the COR or CO deem the work necessary excluding Federal Holidays including:

· President’s Day,

· Memorial Day,

· Juneteenth,

· Fourth of July,

· Labor Day,

Appendix B: Site Map.

VHA Supplemental Contract Requirements for Ensuring Adequate COVID-19 Safety Protocols for Federal Contractors (Amended October 25, 2021)

1. Contractor employees who work in or travel to VHA locations must comply with the following:

a. Documentation requirements:

1) If fully vaccinated, shall show proof of vaccination.

i. NOTE: Acceptable proof of vaccination includes a signed record of immunization from a health care provider or pharmacy, a copy of the COVID-19 Vaccination Record Card (CDC Form MLS-319813_r, published on September 3, 2020), or a copy of medical records documenting the vaccination.

2) If unvaccinated and granted a medical or religious exception, shall show negative COVID-19 test results dated within three calendar days prior to desired entry date. Test must be approved by the Food and Drug Administration (FDA) for emergency use or full approval. This includes tests available by a doctor’s order or an FDA approved over-the-counter test.

3) Documentation cited in this section shall be digitally or physically maintained on each contractor employee while in a VA facility and is subject to inspection prior to entry to VA facilities and after entry for spot inspections by Contracting Officer Representatives (CORs) or other hospital personnel.

4) Documentation will not be collected by the VA; contractors shall, at all times, adhere to and ensure compliance with federal laws designed to protect contractor employee health information and personally identifiable information.

2. Contractor employees are subject to daily screening for COVID-19 and may be denied entry to VA facilities if they fail to pass screening protocols. As part of the screening process contractors may be asked screening questions found on the COVID-19 Screening Tool. Check regularly for updates.

a. Contractor employees who work away from VA locations, but who will have direct contact with VA patients shall self-screen utilizing the COVID-19 Screening Tool, in advance, each day that they will have direct patient contact and in accordance with their person or persons who coordinate COVID-19 workplace safety efforts at covered contractor workplaces. Contractors shall, at all times, adhere to and ensure compliance with federal laws designed to protect contractor employee health information and personally identifiable information.

3. Contractor must immediately notify their COR or Contracting Officer if contract performance is jeopardized due to contractor employees being denied entry into VA Facilities.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

SECTION E - SOLICITATION PROVISIONS

ADDENDUM to FAR 52.212-1 INSTRUCTIONS TO OFFERORS—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES Provisions that are incorporated by reference (by Citation Number, Title, and Date), have the same force and effect as if they were given in full text. The following provisions are incorporated into 52.212-1 as an addendum to this solicitation:

E.1 INSTRUCTION TO OFFERS

1. Standard Form 1449 – Fill in and sign Block 30a, and also provide acknowledgement of any solicitation amendments.

2. Pricing – Proposed pricing shall be submitted on the Price/Cost Schedule. The Offeror must completely fill out the Price/Cost schedule. Each quotation must include an offer to provide all basic services/supplies required.

All requests for information/questions must be submitted via email to Julia.rang@va.gov and received by the contracting officer, no later than the date and time specified in Block 20 of the SF1449.

All quotes must be submitted in electronic format to the Contracting Specialist, by the date and time specified in Block 8 of the SF 1449, via email to Julia.rang@va.gov. All quotes must be viewable using Microsoft Office products or Adobe Reader. Hard copy quotes or quotes submitted by fax will not be accepted.

Offerors shall submit documentation in their quote evidencing that they can meet or exceed the acceptability standards provided below.

Award Basis: The Government intends to award a firm fixed priced contract to the responsible offeror whose offer, conforming to the requirements in this request for quote, will be most advantageous to the Government, price and other factors considered.

A Best Value award will be made as described in FAR 13.106-2 Comparative Analysis, based upon the following evaluation factors:

Technical Capability

• Offeror provided documentation evidencing that it can meet the requirements of confined space updates and training located in the Statement of Work (SOW).
• Offeror shall provide evidence of having required licenses/certifications as directed by the SOW and RFQ attachments.

Past Experience

• Contractor shall provide proof of past experience of providing services related to updating and providing reports, identifications, and confined space safety updates along with employee training.

Past Performance

• Past performance will be evaluated for responsibility determination. Contractor must provide satisfactory past performance providing services related to confined space safety updates and training.

Price

• The Contracting Officer will evaluate line-item prices and determine whether they are fair and reasonable. The Government will evaluate quotes for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options shall not obligate the Government to exercise the option(s).

All quotes shall be submitted by the due date recorded in block 8 of Standard Form 1449 via email to Julia Rang at Julia.rang@va.gov.

The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it ‘‘does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services’’ in paragraph (c)(2) of the provision at 52.204–26, or in paragraph (v)(2)(ii) of the provision at 52.212–3.

(a) Definitions. As used in this provision— Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204–25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition. (1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115–232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to—

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115–232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to—

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for “covered telecommunications equipment or services.”

(d) Representations. The Offeror represents that—

(1) It [ ] will, [ ] will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds “will’’ in paragraph (d)(1) of this section; and

(2) After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that— It [ ] does, [ ] does not use covered telecommunications equipment or services, or use any equipment, system, or service that uses covered telecommunications equipment or services. The Offeror shall provide the additional disclosure information required at paragraph (e)(2) of this section if the Offeror responds “does’’ in paragraph (d)(2) of this section.

(e) Disclosures. (1) Disclosure for the representation in paragraph (d)(1) of this provision. If the Offeror has responded “will’’ in the representation in paragraph (d)(1) of this provision, the Offeror shall provide the following information as part of the offer:

(i) For covered equipment—

(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);

(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and

(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(ii) For covered services—

(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or

(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under…
