Combined Synopsis/Solicitation Notice
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested. The Government reserves the right to make no award from this solicitation.
Solicitation number 36C25023Q0027 is being issued as a Request for Quote (RFQ). The government anticipates awarding a firm-fixed price contract resulting from this solicitation. This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2022-07, effective August 10, 2022.
The associated North American Industry Classification System (NAICS) code for this procurement is 812910 (size standard $8.0 million).
The Department of Veterans Affairs, Veterans Health Administration, Network Contracting Office (NCO) 10 requires a contractor to provide Aviary Bird Care/Replacement & Aviary Maintenance Services for the Saginaw VA Medical Center, located in Saginaw, Michigan, for a period of performance of one year with four possible option years. Please reference the Statement of Work for specific information and requirements.
The anticipated contract period is December 1, 2022 – November 30, 2027, if all options are exercised.
Quotes shall be received on or before the date and time specified in Block 8 of the SF1449 Solicitation. Solicitation posting and closing dates are subject to change as necessary and amendments will be issued accordingly.
This solicitation requires registration with the System for Award Management (SAM) at time of offer, pursuant to applicable regulations and guidelines. Registration information is at www.sam.gov.
This is an open-market combined synopsis/solicitation for services as defined herein. The government intends to award a contract as a result of this combined synopsis/solicitation that will include the terms and conditions set forth herein. To facilitate the award process, all quotes must include a statement regarding the terms and conditions herein as follows:

B.2 STATEMENT OF WORK
I. GENERAL:
Aleda E. Lutz (Saginaw) VA Medical Center, located at 1500 Weiss Street, Saginaw, Michigan 48602 requires a base year contract with four available option years, exercisable at Government discretion, for Aviary Birds and Maintenance. Contractor shall furnish all labor, supervision, materials, and equipment necessary to maintain all of the birds, the aviary and the bird population on a monthly basis. Contractor shall provide several species of birds, ensuring compatibility and quantity of birds are sufficient for aviary space. Contractor shall maintain the aviary so that all birds are kept in a good healthy state, within a secure clean environment that provides suitable habitat and surroundings for the birds, and that is visually pleasing to the viewing public.
II. HOURS OF OPERATION:
a. Normal Work Hours: The service schedule will be developed between the contractor and Contracting Officer Representative (COR) prior to any service being performed. Work shall be performed so that it does not interfere with the facility functions. Normal facility business hours are 8:00 AM-4:30 PM Monday through Friday. The Bird Aviary is in a lunch/break area for staff and visitors, therefore, work will NOT be scheduled between the hours of 11:00 AM and 2:00 PM.
b. National Holidays: No work shall be scheduled or performed on a holiday observed by the Federal Government (see Federal Holidays (opm.gov) for a list of Federal holidays) or any day specifically declared by the President of the United States to be a national holiday.
III. SPECIFICATIONS:
a. Contractor shall provide enough seed, millet treats, bedding and supplies between normally scheduled visits. Monthly service will be scheduled to ensure a minimum of 25 days between visits. Total onsite service visits covered under this contract is twelve (12).
b. Each month the contractor shall:
i. Diagnosis and treat minor bird health problems that may arise. Birds shall be checked for general health, their beaks and toenails trimmed, and treated for mites as a preventative treatment. Any bird showing ill health shall be removed from the aviary and caged separately while remedial treatment is given. Contractor shall provide suitable bird cage for the quarantine of bird(s).
ii. The bedding shall be removed and disposed of. The aviary shall be completely cleaned and disinfected. The nests and greenery shall be cleaned and disinfected and replaced if needed. The windows shall be cleaned; and the aviary shall be dusted inside and out. The feed and water jars shall be cleaned and disinfected. The grit and cuttlebone shall be filled and replaced as needed.
iii. Breeding birds are acceptable and preferred. The contractor shall ensure compatibility of all birds in aviary to prevent loss or harm to bird over population.
iv. Bird(s) shall be removed when population exceeds the capacity of the aviary. This will occur during regularly scheduled maintenance visits.
c. Contractor shall provide guidebook and/or written directions and shall provide on-site training to assigned Saginaw VA staff. On-site staff will be performing daily, weekly and monthly care of birds in the aviary.
d. Contractor shall communicate in writing to the COR, any need to exchange or replace birds. Deceased, injured or otherwise unhealthy birds will be exchanged during regularly scheduled maintenance visits.
e. Contractor shall provide customer service technician contact information for consultation between scheduled visits.
IV. DELIVERABLES:
a. Contractor shall provide training documentation related to the care and maintenance of birds and aviaries for each technician providing services.
b. At completion of monthly service, Contractor shall submit to the COR, documentation listing tasks performed as specified in the contract. Contractor shall submit proposed list of birds, and quantities of each, that will be provided for the term of this contract.
V. PERSONNEL REQUIREMENTS
Contractor must check in with the designated Saginaw VA staff assigned to maintain the aviary between contracted service dates, when Contractor is on station for monthly services. Names and contact information will be provided to contractor after contract award.
VI. SAFETY:
a. Contractor shall provide list of, and SDS for, any chemicals before use in facility/on facility property, in performance of duties. Only chemicals approved by the COR will be authorized for use.
b. No Pesticides shall be applied without approval of the COR or the Pest Management Official (PMO). Application of EPA registered pesticides must be performed by a licensed pest control technician. Documentation must be received by COR 30 days in advance of proposed usage.
VII. CONTRACTOR PERSONNEL BADGES AND PARKING:
a. The contractor shall provide the COR with a list of contractor employees expected to enter the buildings to service the bird aviary. While on VA premises, all contractor personnel shall comply with the rules, regulations, and procedures governing the conduct of personnel and the operation of the facility.
b. An access badge will be given to the contractor’s employee upon entrance into VA buildings. Contractor must safeguard the access badge and immediately report any lost, stolen, or destroyed badges to the COR. All contract personnel must properly display their access badges. Access badges must be worn at or above the waist (facing forward.). Contractor must return the access badge(s) to the COR or designee at the end of each pick up process.
c. Access badges will be picked up at Facility Management Service, contractor check in window, located in building 1, room B115A, during normal business hours.
d. Contractor shall comply with Saginaw VA, Chapter VI, Section G, Security Management Program, Localized policies/requirements. All Saginaw VA, Chapter VI, Section G, Security Management Program, Localized policies/requirements must be met, and contractor employees cleared prior to the contractor performing work under this contract. Employees that cannot meet the security and clearance requirements shall not be allowed to perform work under this contract.
e. It is the contractor’s responsibility to park in the appropriate designated parking areas. Parking information shall be coordinated with the facility COR.
f. Saginaw VA will not validate or make reimbursement for parking violations of the contractor’s staff under any circumstance.
VIII. INTERFERENCE TO NORMAL FUNCTION:
a. Contractor may be required to interrupt their work at any time so as not to interfere with the normal functioning of the facility, including utility services, fire protection systems, and passage of facility patients, personnel, equipment and carts.
b. In the event of an emergency, contractor services may be stopped and rescheduled at no additional cost to the government.
c. Contractor shall inform the COR, or designee, of the need to gain access to secured areas. If access is required to secure areas, prearranged scheduling will be made with COR or designee.
IX. GOVERNMENT FURNISHED:
a. Saginaw VA has limited storage for supplies of food, bedding materials and associated bird maintenance materials. The Aviary has been in place for over 20 years and storage space available has been enough to accommodate contractor-supplied materials between scheduled visits.
b. Access, schedule and water sources are available and will be coordinated between contractor and COR.
c. Saginaw VA staff will provide daily care cleaning as required between scheduled contractor maintenance visits. VA staff will notify contractor of any deaths, disease or concerns that have occurred between scheduled visits.
X. QUANTITIES / SPECIES OF BIRDS
a. Building 22, Atrium enclosure is owned by the government and is approximately 6ft tall x 6ft wide x 4ft 6in deep.
b. Aviary currently has eight (8) birds and has the capacity for up to 12-14 based on species provided.

VHA SUPPLEMENTAL CONTRACT REQUIREMENTS FOR ENSURING ADEQUATE COVID-19 SAFETY PROTOCOLS FOR FEDERAL CONTRACTORS A. VHA Supplemental Contract Requirements for Ensuring Adequate COVID-19 Safety Protocols for Federal Contractors as shown below is hereby incorporated into the scope of work for the subject contract.
1. Contractor employees who work in or travel to VHA locations must comply with the following:
a. Documentation requirements:
1. If fully vaccinated, shall show proof of vaccination.
i. NOTE: Acceptable proof of vaccination includes a signed record of immunization from a health care provider or pharmacy, a copy of the COVID-19 Vaccination Record Card (CDC Form MLS-319813 r, published on September 3, 2020), or a copy of medical records documenting the vaccination.
2. If unvaccinated and granted a medical or religious exception, shall show negative COVID-19 test results dated within three calendar days prior to desired entry date. Test must be approved by the Food and Drug Administration (FDA) for emergency use or full approval. This includes tests available by a doctor’s order or an FDA approved over-the-counter test.
3. Documentation cited in this section shall be digitally or physically maintained on each contractor employee while in a VA facility and is subject to inspection prior to entry to VA facilities and after entry for spot inspections by Contracting Officer Representatives (CORs) or other hospital personnel.
4. Documentation will not be collected by the VA; contractors shall, at all times, adhere to and ensure compliance with federal laws designed to protect contractor employee health information and personally identifiable information.
2. Contractor employees are subject to daily screening for COVID-19 and may be denied entry to VA facilities if they fail to pass screening protocols. As part of the screening process contractors may be asked screening questions found on the COVID-19 Screening Tool. Check regularly for updates.
a. Contractor employees who work away from VA locations, but who will have direct contact with VA patients shall self-screen utilizing the COVID-19 Screening Tool, in advance, each day that they will have direct patient contact and in accordance with their person or persons who coordinate COVID-19 workplace safety efforts at covered contractor workplaces. Contractors shall, at all times, adhere to and ensure compliance with federal laws designed to protect contractor employee health information and personally identifiable information.
3. Contractor must immediately notify their COR or Contracting Officer if contract performance is jeopardized due to contractor employees being denied entry into VA Facilities.

C.3 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)
The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 15 days of contract expiration.

C.4 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)
(a) The Government may extend the term of this contract by written notice to the Contractor within 15 days of contract expiration; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 30 days before the contract expires. The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed five (5) years.
(End of Clause) C.5 VAAR 852.219-75 SUBCONTRACTING COMMITMENTS MONITORING AND COMPLIANCE (JUL 2018)
(a) This solicitation includes the clause: 852.215-70 Service-disabled veteran-owned and veteran-owned small business evaluation factors. Accordingly, any contract resulting from this solicitation will include the clause 852.215-71 Evaluation factor commitments.
(b) The Contractor is advised that in performing contract administration functions, the Contracting Officer may use the services of a support contractor(s) to assist in assessing Contractor compliance with the subcontracting commitments incorporated into the contract. To that end, the support contractor(s) may require access to the Contractor's business records or other proprietary data to review such business records regarding contract compliance with this requirement.
(c) All support contractors conducting this review on behalf of VA will be required to sign an “Information Protection and Non-Disclosure and Disclosure of Conflicts of Interest Agreement” to ensure the Contractor's business records or other proprietary data reviewed or obtained in the course of assisting the Contracting Officer in assessing the Contractor for compliance are protected to ensure information or data is not improperly disclosed or other impropriety occurs.
(d) Furthermore, if VA determines any services the support contractor(s) will perform in assessing compliance are advisory and assistance services as defined in FAR 2.101, Definitions, the support contractor(s) must also enter into an agreement with the Contractor to protect proprietary information as required by FAR 9.505-4, Obtaining access to proprietary information, paragraph (b). The Contractor is required to cooperate fully and make available any records as may be required to enable the Contracting Officer to assess the Contractor compliance with the subcontracting commitments.

C.6 VAAR 852.242-71 ADMINISTRATIVE CONTRACTING OFFICER (OCT 2020)
The Contracting Officer reserves the right to designate an Administrative Contracting Officer (ACO) for the purpose of performing certain tasks/duties in the administration of the contract. Such designation will be in writing through an ACO Letter of Delegation and will identify the responsibilities and limitations of the ACO. A copy of the ACO Letter of Delegation will be furnished to the Contractor.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e)(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial products or commercial services. SECTION E - SOLICITATION PROVISIONS
E.1 ADDENDUM TO FAR 52.212-1 INSTRUCTIONS TO OFFERORS – COMMERCIAL ITEMS
Provisions that are incorporated by reference (by Citation Number, Title, and Date), have the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make their full text available. The following provisions are incorporated into 52.212-1 as an addendum to this solicitation:
OFFER SUBMISSION
Offers shall be submitted via email only, with the RFQ number in the subject line, to Jeanne Ortiz at jeanne.ortiz@va.gov by the date and time identified on the SF1449, block 8. Offers shall be assembled by the following sections and each section shall be easily identified. There will be a one-time question and answer period. All questions shall be submitted via email only, to jeanne.ortiz@va.gov no later than Friday, October 7, 2022, by 10:00 AM Eastern Time (ET).
Section A – Offer Form (Standard Form 1449) Signed and dated. SAM UEI Number shall be entered in the block with the Offerors name and address.
Section B – Pricing Pricing shall be submitted as requested in strict accordance with the Price/Cost Schedule. Do not alter the price schedule whatsoever. Total price will be evaluated by the Government. Proposed price should reflect a clear understanding of the requirements and is consistent with the various elements of the offer.
Section C – Offerors Representations and Certifications A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically). An offeror shall complete only paragraph (b) of this provision if the offeror has completed the annual representations and certifications electronically at www.sam.gov/portal/public/SAM/. All Offerors shall be registered and current in the System for Award Management (SAM) database at time of offer.
Section D – Technical Approach Offerors shall submit a quote addressing all aspects of the Statement of Work (SOW). All required certifications shall be submitted as part of the offer.
The offeror shall identify any subcontractors proposed under this solicitation. All technical elements applicable to the utilization of subcontractors must be addressed in the technical quote and detail provided.
The technical approach section should be as detailed as necessary to fully explain the proposed methods and rationale; it should reflect a clear understanding of the nature of the work being undertaken.
