About this file

This sole source justification document describes the Department of Veterans Affairs' award of a contract to Evideon, Inc. for $262,499 to upgrade patient monitors and interactive screens at the Ann Arbor VA Medical Center. The project requires 120 patient interactive monitors, microphones, and speakers to replace aging equipment and allow virtual family visits, integrating with Evideon's existing interactive patient TV system. Market research found no other responsible sources that could meet the requirement for equipment compatible with Evideon's proprietary system already installed across the facility. The contract was awarded on August 22, 2022 to the OEM Evideon as the sole proprietor of the current system, determined to be the only responsible source and provide the most cost-effective solution for the government's needs.

DESCRIPTION

DEPARTMENT OF VETERANS AFFAIRS

SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROCEDURES FOR CERTAIN COMMERCIAL ITEMS IN ACCORDANCE WITH FAR 13.5

Acquisition Plan Action ID: 36C250-22-AP-2633

1. Contracting Activity: Department of Veterans Affairs, VISN 10, Ann Arbor Medical Center, has requested to the Dayton VAMC Contracting Office, a procurement to upgrade PDI Systems and Patient Monitors throughout the Ann Arbor VAMC facility.

2237 # 506-22-2-118-0138

2. Nature and/or Description of the Action Being Processed: This procurement is for a eVideon Patient Interactive Screen Upgrade in accordance with FAR 13.5 Simplified Procedures for Certain Commercial Items and specifically FAR 13.501 Special Documentation Requirements, where acquisitions conducted under Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6, but still require a justification using the format of FAR 6.303-2. The action will be awarded as a new firm-fixed price contract.

3. Description of Supplies/Services Required to Meet the Agency’s Needs: Currently, there are ongoing problems of with the PDi interactive models failing and needing repairs. New requirements are needed for the patient movie package that is already provided, as well as new issues arising from the pandemic, and upgrading the PDi systems would give the veteran patients the comfort they need during these difficult times. This upgraded process will allow patients to use eVideon’s new application and allow patients to visit virtually with family, which has been an issue with the current setup. Awardee will use the government furnished property, provide additional equipment, complete programming, and integration, which will result in a complete upgrade that functions to the VA’s specifications as detailed in the scope.

The solution shall integrate the new patient monitors with the with existing eVideon Interactive Patient TV system, which include the following items:

The equipment that shall be installed at the VA Ann Arbor Medical Center’s Main campus (2215 Fuller Rd, Ann Arbor, MI 48105) at the following locations: 1 West 5 East, 1 West 5 West, 1 West 5 North, CLC, 3rd Floor Radiology, and 7th floor Cardiology. These locations already have PDi monitors in place, so the new monitors will be replacing these.

120 Patient Interactive Monitors (including all hardware and wiring for it to be mounted and installed properly to provide full functionality) with microphones and speakers. The monitors, microphones, and speakers shall be compatible with the current eVideon system as well as the new virtual visitor application. These items/installation/training will be completed within 60 days ARO.

Estimated cost:

4. Statutory Authority Permitting Restricted Competition:

FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:

( X ) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements ( ) Unusual and Compelling Urgency ( ) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services ( ) International Agreement ( ) Authorized or Required by Statute ( ) National Security ( ) Public Interest

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

Ann Arbor VAMC facility currently has eVideon equipment installed throughout the facility and similar items will not be compatible with this equipment. Prior procurements have requested certain items (televisions/monitors/microphones/speakers) and have not gotten these specified pieces of equipment requested, only to find out that the new equipment was not compatible with the eVideon system. eVideon provides specific electronics that are compatible with their system, failure to meet these requirements will make this equipment unable to provide access to all prior purchased applications. It is imperative that all equipment (televisions, monitors, microphones, speakers, and the new virtual visitor application) function appropriately with the eVideon system. To replace the eVideon system throughout the entire facility would be too costly. Therefore, the new equipment and updates being performed must be compatible with the eVideon system. The specific equipment being requested for this project is the only equipment that will meet the requirements/needs of the facility.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: During past procurements for this type of equipment (eVideon), it was discovered that other vendors are not able to have the connectivity for the eVideon equipment, which caused the system connectivity to fail with the additional applications that are at this facility. It is for this reason and confirmation from the President of eVideon, that a Sole Source Justification for eVideon to complete this project be completed. eVideon is a Small Business vendor and is the OEM of this system. eVideon’s President & Founder was contacted and requested any potential authorized distributors for this equipment; response was provided, stating that there are no resellers for this equipment. An Intent to Sole Source to the eVideon was placed on Contract Opportunities (36C25022Q0619), which provided no responses for this equipment/installation/training.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:

This is a Sole Source acquisition and will be awarded to the OEM, eVideon. eVideon is the sole proprietor of the current system that is already installed at the facility. Placing a new system throughout the facility would be very costly and would not be in the best interest of the Government. The CO will request catalog pricing from the manufacturer; anticipated cost will be considered fair and reasonable based on current catalog/price lists. CO will compare pricing from the quote received to the manufactures published catalog/price lists to show the pricing is fair and reasonable.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market Research was conducted beginning with the VIP search, using NAICS Code 334220; this provided 189 vendors. Additionally, using the same NAICS Code, and the key words “Upgrade Monitors” were used and that provided 14 vendors. To further identify the specific requested items, the key word “eVideon” was used and this gave no potential SDVOSB/VOSB vendors that could provide the requested items. In addition to this research, the OEM, eVideon, a Small Business vendor was contacted and confirmed that there are no resellers for these products.

Requested items are BAA/TAA compliant.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition: An Intent to Sole Source was posted on Contract Opportunities, providing an ample opportunity for additional vendors to provide an interest in competing for this procurement (36C25022Q0619). However, there were no responses to the Intent to Sole Source, which confirms that no other vendors are able to provide the connectivity the eVideon offers for their equipment/installation/training.

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:

eVideon, Inc.

1059 Wealthy SE, Suite 202 Grand Rapids, MI 49509

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: For any subsequent procurements of this type of equipment and services, the marketplace will be surveyed to determine if there are any other sources which can provide equipment and services to satisfy the Government’s requirement.

12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
