AMENDMENT NO. 1
Department of Veterans Affairs (DVA)
Yukon, OK – Community Based Outpatient Clinic (CBOC) VA Request for Lease Proposals
No. 36C24W25R0116 This amendment is to provide answers to Request for Information.
Question 1: Is the submission required to be broken into a “Volume I Technical Proposal” and a “Volume II Price Proposal” or can everything be submitted together?
Answer 1: There is no required format for submission. Separate volumes would be preferred.
Question 2: What are the normal hours for the facility?
Answer 2: Normal hours for the facility will be Monday through Friday from 7:00am to 5:30pm.
The facility may also have extended clinics on occasion outside of those hours to include weekends. Any hours of operation referenced in the RLP should be changed to 7:00am to 5:30pm. Please note ASR Section 8.1 requires snow removal prior to the working hours. Snow removal should be completed by 6:30am and 5:00pm and as needed throughout the business day.
Question 3: Please clarify the maximum Rentable Area. The RLP indicates a larger ABOA range than the Rentable Area range.
Answer 3: In the event your proposal is an existing building, the government will accept 22,155 to 26,586 ABOA SF. In the event your proposal is a new build, then the government has requested a minimum of 22,155 ABOA SF with a maximum of 24,370 rentable square feet
(RSF).
Question 4: The Program for Design does not list a reception area. Prior solicitation responses stated that a 4-person 300 SF space is needed for reception. Please confirm this response still applies.
Answer 4: A reception area large enough for four (4) individuals to sit at the front desk is required.
This will include three (3) receptionists and one (1) travel assistant. It will need to be approximately 300 SF and include space for a printer.
Question 5: The Program for Design lists 2 Telecom Rooms (TR). For clinics this size, 1 TR would provide adequate coverage, and we have seen other clinics use a single TR, which can leave more ABOA for other service. Alternatively, a single TR could be larger, at 170 SF, to provide more space for various systems within the room. Is the VA open to such a change?
Answer 5: One large room is acceptable, however the longest CAT 6a wire that can be ran is 300ft. Depending on the design of the building, this may not be possible with only one IT closet.
If the IT closet can be centrally located such that CAT 6a wires can reach the farthest corners of the building (including distance through the ceiling, turns, and down the walls) then all racks should be able to fit in a 10'x14' room.
Question 6: The ASR requests Mini-Split units for Medication, Clean Storage, and Lab. We suspect this is in response to a lack of separate thermostat control in the existing clinic. If we provide separate thermostat (separate VAV) for each of these rooms, is that an acceptable route in lieu of the Mini-Split?
Answer 6: It will be the lessors responsibility to ensure that temperature control systems work to maintain any room temperature required by the VA. The VA will not provide funding for the addition of a mini-split, or any other modifications needed to adequately maintain the required temperature, in future if the chosen primary system fails to maintain the required temperatures.
Question 7: The ASR quotes a portion of VA PG 18-3 Topic 1 regarding NFPA 101 and other NFPA codes which the VA uses. While the project can certainly comply with NFPA 101 and the other codes, we believe it is worth clarifying that as a leased facility, it will also be required to comply with the local version of IBC adopted by the State of Oklahoma. The two code sets must be viewed as complementary with the design meeting the requirements of both, not one overriding the other. Similarly, while we do not anticipate any situations where a conflict would exist, the project must meet the requirements of IBC in addition to the referenced VA Fire Design Manual.
Answer 7: Agreed. To clarify, the building must comply with all Federal, State, and Local building requirements.
Question 8: The ASR quotes a portion of VA PG 18-3 Topic 1 regarding the AHJ for the project.
Because the project must be permitted in the City of Yukon, we believe it is worth clarifying that the City's permitting agency will be considered an AHJ and the VA will be able to complement them in their review but will not have authority to override the AHJ. This does not mean that the VA will not be able to guide the quality or direction of the project in regards to the life safety requirements.
Answer 8: Agreed. To clarify, the building must comply with all Federal, State, and Local building requirements.
Question 9: The ASR references the Physical Security and Resiliency Design Manual. However, the RLP also includes Exhibit C VA Security Requirements with as an FSL II. Typically, we see clinics such as this one only needing to meet the FSL II requirements. Including PSRDM could mandate a 25'-0" standoff of any parking or drive aisle from the building facade. It could also increase the facade blast requirements. Both of those could increase the cost of the lease.
Please confirm whether PSRDM must be utilized or if it can be omitted since FSL II is provided.
Answer 9: VA Police space will be reviewed in depth as part of the design process. The FSL II requirements are all that's generally required at the CBOC locations.
Question 10: Please clarify which spaces are required to have built-in desks provided by the Lessor as opposed to VA-furnished furniture.
Answer 10: The VA will provide all staff workstations. Millwork for other areas will be discussed as part of the design process.
Question 11: Please confirm that a perimeter fence is required. Prior solicitation responses indicated that the fence was not required.
Answer 11: The VA does not require a permanent perimeter fence as part of the final VA clinic.
All offerors should verify local city codes and ordnances as to whether or not a fence would be required to meet any city requirements. Additionally, traffic deterrence measures in front of the facility, such as bollards or big rocks to prevent automobiles crashing into the facility may be required. These security issues will be resolved during design planning.
Question 12: The ASR states that fencing shall comply with requirements of the VA Physical Security Design Manual for Life Safety Protected Facilities. Under the current VA Physical Security and Resiliency Design Manual, there is no defined fence requirement for "life safety protected" facilities. Instead, the PSRDM wants an assessment of the risk and fencing provided if deemed necessary in that assessment and to a level of protection per that assessment. In this competitive solicitation, there is no opportunity to review that risk assessment. If a fence is required, we request a specific requirement be given by the VA to maintain equality among proposals.
Answer 12: See response to Question 11.
Question 13: The ASR states that Level 5 drywall finish is required in all occupied spaces unless the space receives wall covering. Level 5 finish is very expensive to achieve and usually reserved for special locations. Most projects do not ever use a Level 5 finish because it is unnecessary and would drive a high project cost. The VA standard specification from the Techical Information Library (TIL) states "Use Level 4 finish for all finished areas open to public view." Please confirm Level 4 will be acceptable.
Answer 13: Yes, a Level 4 finish is acceptable due to the substantial cost increase associated with a Level 5 finish. It should also be noted that walls should have a non-textured finish based on Infection Control compliance.
Question 14: Please confirm what classifies as "security partitions" for the police area. Is this intended to mean UL 752 Level 4 ballistic-resistant per PSRDM 5.13.3.1 or a less stringent requirement?
Answer 14: VA Police space will be reviewed in depth as part of the design process. Level 4 ballistic resistant partitions are not generally required in CBOC's. They usually have a locking office where they can mount monitors for security cameras. A partition may be used to prevent accidental exposure when opening the door.
Question 15: The ASR states a minimum door width of 3'-6". This is common practice in VA facilities for all doors where a patient may routinely enter. However, for non-patient areas (offices, storage rooms, staff restrooms, etc.) we typically see the VA accepting a 3'-0" minimum door size.
Please confirm whether non-patient areas will be allowed to have 3'-0" doors.
Answer 15: This door width is to accommodate both patients and staff members who use supportive devices for mobility.
Question 16: The ASR states that acoustic doors shall be used to achieve the STC ratings specified. Please confirm this is intended to mean the NIC values listed in section 2.4.4.
Answer 16: Acoustic doors are not required for all locations. Options to reduce sound transmission will be discussed during the design phase and are not limited to doors.
Question 17: The ASR states that the lessor shall provide audio/visual and teleconferencing equipment for the conference/group rooms. These would normally be VA-furnished items as they need to interface with the VA's IT systems. Please confirm these will be VA-furnished.
Answer 17: The VA will provide all IT equipment, including conferencing equipment. The contractor may be required to adjust locations for data ports, electrical outlets, and wiring to support conference room equipment. This will be discussed during the design process.
Question 18: The ASR states that fencing shall comply with requirements of the VA Physical Security and Resiliency Design Manual for Life Safety Protected Facilities.
Answer 18: See response to Question 11.
Question 19: The ASR notes emergency power generating capabilities. Please clarify whether this is intended to be a emergency generator or a battery backup system. If a generator system, please clarify the duration of runtime for the generator and what items must be on emergency power. Prior solicitation responses indicated 24-hour run time. Prior solicitation responses stated that a generator is required for dental and procedural rooms.
Answer 19: This CBOC will need a back-up emergency power generator to support the dental clinic and procedure rooms. Specifications will be discussed during the design process. The primary use will be to allow the dentist or care provider to finish any procedure that was started prior to a power outage.
Question 20: If a generator system is required, please clarify whether a pad-mounted freestanding generator will be acceptable.
Answer 20: Yes
Question 21: Exhibit B, section 6.0 requires the design to comply with VA Plumbing design Manual. VA plumbing design manual defines Community-Based Outpatient Clinic (CBOC) as a patient care building (section 4.1 General) and requires two separate water service entrances that will allow for servicing without outage (section 4.10 Backflow preventers). Please verify whether two separate water service entrances are required or a single service entrance with dual parallel piped backflow preventers is acceptable.
Answer 21: Per the TIL and confirmation through M&O, a single service entrance with dual full flow, parallel piped reduced pressure backflow preventers is considered acceptable to allow for maintenance without a water shutdown.
Question 22: Prior solicitation responses indicated that the largest delivery truck would be a 25-foot box truck. Please confirm this still applies.
Answer 22: This is not possible to confirm, but most parking lots with 2 driveway access should be able to accommodate larger vehicles that can't turn around.
Question 23: This section notes a November 15, 2026 Lease Commencement Date or upon acceptance of the space. Please confirm this is still applicable and when the VA expects to award this lease.
Answer 23: Confirmed. The award date can be influenced by a number of factors and is not easily identified. The VA will work diligently to examine all offers and will award the procurement after all offers have been completely and fairly evaluated. At this time the VA anticipates awarding this procurement during the first quarter of 2026.
Question 24: Note that public transportation is required near the site. As noted in previous RFI's there is no public transportation in this area. Confirm this section is not applicable to this Solicitation.
Answer 24: The VA prefers sites be near public transportation when available. In the event public transportation is not available, the VA will not factor the availability of public transportation in a positive or negative way towards any proposal.
Question 25: It seems the wage determination list is not the appropriate list for this project as it does not include the construction trades. Can you provide the correct wage determination for this area.
Answer 25: See Attached.
Question 26: We noticed that the RLP documents feature a TICS Table (Exhibit N), but Section
3.07 of the RLP calls for an allowance. With that being said, we want to confirm that offerors are not required to fill out a TICS as part of the initial offer.
Answer 26: TICS Tables will be completed during the build-out phase and are not required as part of the initial offer.
Question 27: For past performance, if offerers participated in previous rounds of this procurement, do we need to re-submit our PPQ’s to our references? Or can the prior PPQ’s from past rounds of this procurement count towards the evaluation for this round?
Answer 27: Please re-submit all past performance questionnaires.
All other requirements remain unchanged.

** Workers in this classification may be entitled to a higher minimum wage under Executive Order 14026 ($17.75) or 13658
($13.30). Please see the Note at the top of the wage determination for more information. Please also note that the minimum wage requirements of Executive Order 14026 are not currently being enforced as to any contract or subcontract to which the states of Texas, Louisiana, or Mississippi, including their agencies, are a party.
Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the
Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.
Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at https://www.dol.gov/agencies/whd/government-contracts.
Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses
(29CFR 5.5 (a) (1) (iii)).
The body of each wage determination lists the classifications and wage rates that have been found to be prevailing for the type(s) of construction and geographic area covered by the wage determination. The classifications are listed in alphabetical order under rate identifiers indicating whether the particular rate is a union rate (current union negotiated rate), a survey rate, a weighted union average rate, a state adopted rate, or a supplemental classification rate.
Union Rate Identifiers
A four-letter identifier beginning with characters other than
""SU"", ""UAVG"", ?SA?, or ?SC? denotes that a union rate was prevailing for that classification in the survey. Example:
PLUM0198-005 07/01/2024. PLUM is an identifier of the union whose collectively bargained rate prevailed in the survey for this classification, which in this example would be Plumbers.
0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. The date, 07/01/2024 in the example, is the effective date of the most current negotiated rate.
Union prevailing wage rates are updated to reflect all changes over time that are reported to WHD in the rates in the collective bargaining agreement (CBA) governing the classification.
Union Average Rate Identifiers
The UAVG identifier indicates that no single rate prevailed for those classifications, but that 100% of the data reported for the classifications reflected union rates. EXAMPLE:
UAVG-OH-0010 01/01/2024. UAVG indicates that the rate is a weighted union average rate. OH indicates the State of Ohio.
The next number, 0010 in the example, is an internal number used in producing the wage determination. The date, 01/01/2024 in the example, indicates the date the wage determination was updated to reflect the most current union average rate.
A UAVG rate will be updated once a year, usually in January, to reflect a weighted average of the current rates in the collective bargaining agreements on which the rate is based.
Survey Rate Identifiers
The ""SU"" identifier indicates that either a single non-union rate prevailed (as defined in 29 CFR 1.2) for this classification in the survey or that the rate was derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As a weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SUFL2022-007
6/27/2024. SU indicates the rate is a single non-union prevailing rate or a weighted average of survey data for that classification. FL indicates the State of Florida. 2022 is the year of the survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. The date, 6/27/2024 in the example, indicates the survey completion date for the classifications and rates under that identifier.
?SU? wage rates typically remain in effect until a new survey is conducted. However, the Wage and Hour Division (WHD) has the discretion to update such rates under 29 CFR 1.6(c)(1).
State Adopted Rate Identifiers
The ""SA"" identifier indicates that the classifications and prevailing wage rates set by a state (or local) government were adopted under 29 C.F.R 1.3(g)-(h). Example: SAME2023-007
01/03/2024. SA reflects that the rates are state adopted. ME refers to the State of Maine. 2023 is the year during which the state completed the survey on which the listed classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination.
The date, 01/03/2024 in the example, reflects the date on which the classifications and rates under the ?SA? identifier took effect under state law in the state from which the rates were adopted.
