Sheet1
| ID | Paragraph (reference RFP, SOW, or Attachments) | Page Number | Section Title | Paragraph Number | Offeror's Questions | Government Response | |
RFQ | I am hoping to find out if the subject effort is a new requirement or a follow-on to an existing contract? If the latter, can I please find out the incumbent contractor's name and contract number? | The Supply BPAs are a new requirement. | |||
RFQ | 32 | E.1 52.212-1 INSTRUCTIONS TO QUOTERS—COMMERCIAL ITEMS (OCT 2018) | In the MSPV 2.0 solicitation I am unable to find the submission email address. When I have the solicitation completed do I send it to you or someone else? | The CO's email address is on the front page of the SF 1449. | |
RFQ | Would we be able to submit a proposal without the 8(a) or hub zone? | Please see language in the amendment revising 52.212-2 Evaluations. | |||
RFQ | As an AbilityOne agency with two BOAs, should we respond to the relevant solicitations or does this language eliminate the need for us to respond? Additionally, If this is not the correct means of posing the question I would respectfully request your guidance on how to get the answer. | Yes, AbilityOne vendors may submit quotes, but Offerors should not submit quotes for any supplies already covered under the AbilityOne Procurement List. | |||
RFQ/Presolicitation | I am enquiring about the subject solicitation number. In the Pre-Solicitation Notice, are you looking for a Group Purchasing Organization that can synchronize with a prime vendor for the distribution of medical supplies, equipment, and other services? I am partnered and contracted with a national Group Purchasing Organization. | Please see RFQ for specific language as we are looking for Suppliers to support the MSPV contract and not a group purchasing organization. | |||
Quote Sheet | There are items in this solicitation that we manufacture, but many not in the correct solicitation? Should this go on another solicitation? What's the Process? | The Historical data provided are for reference purposes only and should be used as estimates. Offerors are not restricted to quoting these supplies. Offerors are welcome to submit all supplies that fall in the scope of the RFQ's category description (see Attachment B, Historical data tab) that they are authorized to sell by the OEM. Each item, should be entered as a new row on the Quoted Sheet tab in Attachment B. All quoted items require a Authorized Distributor Letter from the OEM, even if the Offeror is a subsidiary of the company or the company is a subsidiary of the quote's company. | |||
RFQ | I am counting 15 category solicitations or pre-solicitations on FBO today. | ||||
| a. | Will there be additional categories added? | ||||||
| b. | If so could you share what those categories will be? | ||||||
| i. | I am seeing products that do not belong in some of the categories just looking for additional information so I can help your colleagues appropriately categorize the items. | a) Yes |
b) Each RFQ is posted in FBO. VA shared the category list with industry during an earlier RFI
i) VHA has used clinical subject matter experts that will make final determination of items deemed within scope for a category. Offerors may quote items across categories and in more than one category. Each OEM will only be awarded once and will be available broadly once awarded.
Quote Sheet | 31 | E.1 52.212-1 INSTRUCTIONS TO QUOTERS—COMMERCIAL ITEMS (OCT 2018) | This file is password protected and we are not able to edit it. Can you please assist? | The file has built in macro validations that will alert and assist the user when they incorrectly enter data. This will minimize the need to have quotes resubmitted with corrections. The quote sheet is password protected to ensure these validation measures are not accidently corrupted. This will not prevent the user from filling out all fields required. |
RFQ | 31 | E.1 52.212-1 INSTRUCTIONS TO QUOTERS—COMMERCIAL ITEMS (OCT 2018) | Can you please clarify what is needed as quote & Award Document, representations and certifications? | Please see language in the amendment revising 52.212-1, Instructions to the Offerors. |
Quote Sheet | If there isn’t a hyperlink for the product literature on the company’s website or catalog, what is the second option of submitting a product literature in column “S” on attachment B? Is it a must to have the item set up on the company’s website? | Yes, Please provide a hyperlink for product literature in the Attachment B, quote sheet. We will not be accepting paper copies or PDF of product literature. | ||
RFQ/Quote Sheet | Quote Sheets | We are a manufacturer of many of the products on several of the recently issued MSPV solicitations. Once I complete the quotations forms for each, where do I send my quote sheets? Do I email them directly to you or is there another process I need to follow? | Quote Sheets should be emailed to the CO. Please see language in the amendment revising 52.212-1, Instructions to the Offerors. | |
RFQ | 5 | Section B - SCOPE #2 | 2 | 1.) Can you please clarify what this statement means "excluding supplies already covered under the AbilityOne Procurement List”? 2.)Will AbilityOne items already be on the list with the prices listed that are set by the commission? 3.) Can you also tell me if the AbilityOne items that are currently on the Formulary will remain on the Formulary? 4.) Will these items be provided by the AbilityOne Non-Profit agencies that currently hold BOA’s or will these items now be provided by a SD/VOSB and/or a VOSB? | At this time, VHA will not consider items currently awarded on the AbilityOne Procurement List. Offerors should not submit offers for any supplies already covered under the AbilityOne Procurement List.
13 Quote Sheet If we are providing an alternate cross for a items, where do we have to add this information as Attachment B only gives us the option of entering the data for items already found on Tab 2 (Historical Data). There is no other columns provided where we can provide the information for the alternate option. Column E is only for OEM found on Tab 2 (exact match but not for alternate option) and it is the same on all the other files. 2) On Attachment B for solicitation number 36C24C19Q0034 - Syringes and Needles - When we populate the exact match item numbers into the SN Proposed Supplies tab, anything populated from the SN Historical Data tab below row 15 automatically defaults to a “No” response, even though the OEM number is an exact match. The Historical data provided are for reference purposes only and should used as estimates. All quoted items require a Authorized Distributor Letter from the OEM, even if the Offeror is a subsidiary of the company or the company is a subsidiary of the Offeror's company
The error on the Quote Sheet was corrected in the latest version of Attachment B, which was posted as an amendment.
RFQ | Volume I Technical | Can you please provide further information or requirements needed for the Technical part? | Please see revised 52.212-1, Instructions to the Offerors in the RFQ | |
RFQ | 1. Is there a list of the 49,000+ items in which the VA is looking for Authorized Suppliers to provide a quote for? I see the Attachment B spreadsheet and each tab, but what products should be quoted specifically in order for the VA to compare pricing between vendors. 2. if a SB submits an offer with lower pricing that’s technically acceptable with acceptable Past Performance than a SDVOSB or VOSB, will the solicitation be cancelled and re-solicited, or simply awarded to the SB? 3. How many awards are expected? Could the VA award multiple BPAs with 1 to a SDVOSB, 1 to a VOSB and 1 award to a SB? | There will not be a list of over 49K items posted. Awards will be made utilizing the tiered evaluation method. It is unknown how many awards will be made. | ||
RFQ | SOW | Is the attached MSPV 2.0 SOW the applicable SOW to include Attachment I and Attachment II for this solicitation, and thus should be uploaded to the FBO Posting? | Please see SOW in Supply RFQ as the Supply RFQ does not have a requirement to include Attachment I and Attachment II | |
RFQ | 5 | Section I Background, A(3) in the last sentence | Can you provide the MSPV Product List? This is referenced on Page 5 of the Solicitation under Section I Background, A(3) in the last sentence “The MSPV Product List will include all supplies awarded under BPAs”. It’s also references in SOW on Page 39 in Section B(1) is the first sentence “…the VA-established MSPV Product List pricing…” | The MSPV Product List may be developed from all of the Supply BPAs awarded from these solicitations. |
RFQ | The pre-solicitation notice stated that an authorized distributor/supplier and the Prime Vendor shall establish a Commercial Agreement within 30 days of this award. However, the solicitation appears to indicate that commercial agreements may be established within 60 calendar days. Is it the VA's intent to have commercial agreements under MSPV 2.0 established in 30 or 60 days? | 60 days. This has been corrected. It should read 60 days in the Pre-solicitation notice. The RFQ correctly states 60 days. | ||
RFQ | Section E.8 Evaluation | In Section E.8 52.212-2 EVALUATION—COMMERCIAL ITEMS, it is stated that “Before award, the contracting officer will conduct an affirmative responsibility check to include past performance and experience.” This statement occurs in each BPA solicitation released so far, and is the only mention we can find in the solicitations regarding the evaluation of an offeror’s past performance. Is there further detail you can provide on any specific past performance requirements? Or is there no defined requirement, so past performance will be subjectively evaluated by the contracting officer on a case-by-case basis? Will the answer to this question apply to all other MSPV 2.0 BPA solicitations as well, or should the same question be asked of each Contracting Officer? | This language will be utilized in every RFQ. The Contracting Officer will conduct an affirmative responsibility check to include past performance and experience under the standard in FAR Part 9 analysis. | |
RFQ | 30 | Page 30 of the solicitation states “If this RFQ requires that you submit product samples, you must deliver them to us at the location specified for our receipt on or before the deadline for submission of your quote.” Where in the RFQ will it be stated whether product samples will be required? | No product samples are being requested at this time. | |
Quote Sheet | Is there someone I can speak with regarding questions on completing the EMS Quoted Supplies Tab? | |||
| I have some basic question on a couple of the fields and the “Overview & Instruction” tab and “Data Fields for Reference” tabs do not address my questions. | Updated instructions are posted within the revised documents in the posted amendment. | |||||
RFQ | 6 | Section 4 | In consideration of section 4 on page 6, which excludes supplies already covered under the AbilityOne Procurement List from this solicitation, do organizations that currently sell products on the Procurement List through the AbilityOne program need to respond to this solicitation with products on the Procurement List in order to supply those products through MSPV 2.0? | No, Offerors should not submit offers for any supplies already covered under the AbilityOne Procurement List. |
RFQ | If a BPA is established for a product and it is added to MSPV 2.0, does that mean all VAMC must buy that product through MSPV 2.0? Can a VAMC purchase a different manufacturer’s product not on MSPV 2.0 if a similar product is on MSPV 2.0? | MSPV program is highly encouraged for VAMC use, but there may be clinical need to purchase outside of MSPV program.
RFQ | Will the commercial agreements between Authorized Suppliers and the 5 PV be consistent? | This is not part of the Supply BPAs but an agreement between the BPA awardee and the PV. |
RFQ | Can the PV charge the Authorized Supplier additional fees / charge backs such as PV handling fees, extended payment terms, or any other hidden fees that would increase the authorized Supplier’s costs? It is difficult to provide a product bid price if we have 5 different PV that can increasing our cost of goods sold, without knowing these costs prior to submitting the bid price. | This question is not applicable to this Supply RFQ. |
RFQ | Will multiple BPA be awarded for the same type of product from different manufacturers? | BPAs will be awarded for a "single unique item". |
RFQ | Is a certified Small Business not included in the tiered approach? Section E8 establishes the tiered order of priority… SDVOSB, VOSB with the third tier being Small Business concern w/ Historically Under-utilized Business (HUB) Zone small business, with the last tier being a Large Business Concern. | Small businesses are included in tier 3 under the tiered evaluation approach. Please see language in the amendment revising 52.212-2 Evaluations. |
RFQ | Is the “Women Owned Small Business” and/or “Small Business” Classification restricted to US citizens with 51% ownership AND 51% of the manufacturing / assembly conducted in the US? | Please refer to the U.S. Small Business Administration (SBA) for ownership & manufacturing guidance for SB classifications. |
RFQ | Will product salient characteristics / requirements be used as part of the process to determine “best benefit to the Government” be published? | Descriptions are within Attachment B, Quoted Supplies tab |
RFQ | Evaluation of Best Benefit to Government – Without documenting the technical product requirements / salient characteristics, how will the technical / clinical staff determined which competing product will best meet / exceed the VAMC needs? | Please see language in the amendment revising 52.212-2 Evaluations. |
RFQ/Quote Sheet | Quote Sheet – EMS Quoted Supplies tab: Our 1 product competes against multiple products on the Historical Data tab. How would we designate this on the EMS Quoted Supplies tab? Or, would we list our 1 product for each of the competitive products listed, referencing the competitive product we would suggest replacing with our 1 product? | It is not necessary for Offerors to indicate which items they believe should 'replace' Historical items. Offerors are welcome to submit all supplies that fall in the scope of the RFQ's category description (see Attachment B, Historical data tab) that they are authorized to sell by the OEM, excluding supplies already covered under the AbilityOne Procurement List. Each item, should be entered as a new row on the Quoted Sheet tab in Attachment B. All quoted items require an letter of authorization from the OEM. |
RFQ | Tiered Evaluation Scenario 1: Similar Product by Different Manufacturers: If SDVOSB submits a bid on a multi grip head immobilizer from Manufacturer A and a Small Business Owned supplier submits a bid on a multi grip head immobilizer from Manufacturer B; Will each Tier’s (SDVOSB and SB) Proposals be opened and evaluated to determine if the SDVOSB supplier’s proposal and Product is the Best Value vs the SM supplier’s proposed Product? How will this process work? Scenario 2: Same Product and Same Manufacturer with Different Suppliers: If a SDVOSB submits a bid on a Multi Grip Head Immobilizer from Manufacture A, and a Small Business Owned supplier submits a bid on a multi grip head immobilizer from Manufacture A; Will the Small Business Owned supplier’s bid be opened/evaluated if the SDVOSB bid is determined to meet the need and is of good value? | Please see language in the amendment revising 52.212-2 Evaluations, to see how these scenarios would unfold under this solicitation |
RFQ | Section II. MSPV Business Process B. Pricing | It states that the PVs will use the exact price [the BPA established price] plus a distribution fee agreed upon between the PV and VA – In the MSPV Prime Vendor solicitation Section 1 Scope B.1.e. says the distribution fee will be capped at 5% - can we expect that cap will apply? | This question is not applicable to this Supply RFQ.
RFQ/Quote Sheet | For companies planning to offer large numbers of items, will a full product catalog suffice for product literature under the technical requirement? | |
| No, we are requesting a hyperlink to each quoted item. | ||||
RFQ/Quote Sheet | In the case of a product possibly fitting into multiple categories, what is the best course of action? Should the supplier submit under all applicable categories, make their best faith effort to match to a category, submit to the CO for assistance, or something else? | Submit to multiple categories that the item falls in scope, if in doubt. |
RFQ/Quote Sheet | How will the VA handle a situation involving an offeror submitting the same item on different/multiple categories? | A unique item will only be awarded once. |
Quote Sheet | Based on the historical data, we found substantially different sales than was provided. We also found many products with historical sales that aren't on the requested item list. What is the VA's expectation of total number of products to be evaluated? Can the supplier provide its full product catalog appropriate for the category? If so, this will significantly increase the number of items to be evaluated compared to what was provided on the historical data list. | Historical sales data is provided for reference purposes and should not be considered an exact amount. All supplies quoted will be evaluated. Offerors are not restricted to quoting these supplies.
RFQ/Quote Sheet | Will clinical representatives be reviewing the products offered in this solicitation? | Yes | ||
RFQ/Quote Sheet | Some products cross multiple solicitation categories as defined by the VA, can we offer products under multiple solicitations? For example, IV sets are requested in the needles and syringe solicitation, but there is a separate solicitation for IV & Irrigation Supplies. Because the solicitation responses are not necessarily released at the same time, we want to ensure the VA has coverage for these items. | Yes items can be quoted under multiple solicitations for which the items falls in the scope of the RFQ's category description (see Attachment B, Historical data tab) that they are authorized to sell by the OEM. Note that a item will only receive a BPA for only one category. | ||
RFQ | What are the requirements for price changes? The solicitation does not provide direction? | Please see the Section II.C.3 Pricing Changes in the SOW | ||
RFQ | Section A8- states that "the government reserves the right to remove any supply from the MSPV product list upon 30 days' notice, resulting in cancelation of the BPA" is it the governments intent to cancel the entire BPA when one product is removed? | It is not the intent to cancel the entire BPA when one item is removed | ||
RFQ | 11 | Section III. Work Requirements | C. | The solicitation has two service of protest clauses; which clause supersedes in this solicitation? FAR 52.233.2 or VAAR 852.233-71? | The VAAR is a supplement to the FAR
RFQ/Quote Sheet | I work for a small home dialysis company and we cater to the home PD patient population. Is this something that could be quoted on for just this category? I see in Historical data the products we provide now for VA’s and outside hospitals and their home programs. | Yes | ||
RFQ | Can you explain difference between an Authorized Supplier and a Prime Vendor? | Supply RFQ will establish Supply BPAs to support the MSPV contract. | ||
RFQ | Can an Authorized Supplier submit an invoice to a VA or only the Prime Vendor? | No, invoices shall not be sent the VA Medical Centers. They should be sent to the MSPV. | ||
RFQ | Can an entity be both an Authorized Supplier or OEM and a Prime Vendor? | Yes | ||
RFQ | Is this for Medical/Surgical Product shipped directly to VHA facilities only? | There will be no products shipped directly to VHA facilities, unless by exception as a drop shipment. | ||
RFQ | The solicitation requires the supplier and prime vendor to enter into a “commercial agreement” within 30 days of award of a BPA. The solicitations further state VA is not a party to the commercial agreements. Once the prime vendor contracts are awarded, a supplier has no leverage in this negotiation. A supplier is at the mercy of the prime vendor as it relates to charges, penalties and fees, payment terms, insurance requirements and other terms and conditions a prime vendor chooses to impose. These concerns are not addressed within the solicitation. Will the VA put a maximum in place for awarded prime vendors in terms of fees? Also, how can any supplier offer VA a fair and reasonable price with no committed volume, unknown fees, charges and penalties? | 60 days. This has been corrected. It should read 60 days in the Pre-solicitation notice. The RFQ correctly states 60 days. | ||
RFQ | Can FSS Letters of Supply be used in leu of Authorized Distributor letter if signed within the last 90 days? | No, the RFQ specifically requests Authorized Distribution letters. | ||
RFQ | Will the VA allow substitutions? The solicitation does not address this question. Prime Vendors can potentially withhold orders from an SDVOSB supplier, tell VA a product is not available, offer VA a private branded label product that generates more profit to the prime vendor, and VA would believe the SDVOSB is at fault. This can occur unless the VA prohibits the delivery of private branded products as substitutes if they are note offered as part of the initial supplier solicitations and resulting BPAs. | This question is not applicable to this Supply RFQ | ||
RFQ | Section E.152.212-1 | In section E.1 52.212-1 Instructions to Quoters – Commercial Items, there are three volumes required to be submitted. For Volume I – Technical, there are no instructions on what is to be included in this document. Since Product Literature is being addressed in Volume II – Price, should the Authorized Distributor Letter be in Volume I - Technical? | Volume language was removed in updated RFQ. Please see language in the amendment revising 52.212-1, Instructions to the Offerors. | |
Quote Sheet | Can I submit an alternative ‘me too’ product for consideration? (We have one which also lifts 400lbs - https://www.winncare.com/fiche-produits-moving_and_handling-hoist_winn_motion_175-8-441-int.htm ) | Yes | ||
Quote Sheet | Can I submit products for consideration where there is no historical ‘me too’ product that is innovative within the product category? i.e. Camel for use in smaller spaces than a traditional hoist? ELK for EMS category etc.? https://mangarhealth.com/us/store/product/safe-patient-lifting/camel-lifting-cushion/ | Yes | ||
Quote Sheet | The item listed (Line 25) Abbott Medical Optics, OPOR4520L Laminar Flow Phaco Tip 45 DEG INFSLV 20G is not for Optometry. It is for OR surgery. How can we get this removed and placed on the OR list when it comes out? | Integrated Product Teams (IPT) will review and consider. VHA has used clinical subject matter experts that will make final determination of items deemed within scope for a category. Offerors may quote items across categories and in more than one category. Each OEM will only be awarded once and will be available broadly once awarded. | ||
RFQ/Quote Sheet | In order for an offer to be accepted, must it include pricing for ALL the items on the spreadsheet? Or can we submit our price quotes for the items that we currently have distribution privileges? In other words, “is this an ALL-or NONE award “? | This is not an All or One award. Offerors are not restricted to quoting supplies listed on the Historical Data. | ||
RFQ | Is this BNOE RFQ, or only SOLE Source for specific RGQ name and part#? | This is not a Brand Name or Equal nor a Sole Source RFQ. | ||
Quote Sheet | 30 | E.1 52.212-1 INSTRUCTIONS TO QUOTERS—COMMERCIAL ITEMS (OCT 2018) | It states that the size limitation is 10 Megabytes per email. The technical part is going to exceed the 10 megabytes because of the pictures. Attachment B on its own without any data field completed is more than 3500KB. Is it possible for us to submit our bid responses into a couple of separate emails? Please confirm. | Please submit several emails if necessary. |
RFQ | 5 | B.2 Statement of Work | Any suppliers and resellers who participate in MSPV 2.0 must be authorized to provide the supplies by the OEM. An Authorized Distributor Letter from the manufacturer shall be included with the response. What VOLUME # should the Authorized Distribution Letter be included? Volume I or Volume III? | All required documents should be included in one email to the CO. Please see language in the amendment revising 52.212-1, Instructions to the Offerors. |
Quote Sheet | Column’s H, J, L, N, O, P, Q, R, are only modifiable by drop down selection – Is there a way you could enable the file to have copy and/or paste functionality? The VA’s purchase over 1,000 line items of high use line items alone. This would help us respond to you quicker. | The columns have fixed lists to provide standardization to quote submissions. Additionally the file has built in macro validations that will alert and assist the user when they incorrectly enter data. These validation components of the Quoted Sheet will minimize the need to have quotes resubmitted with corrections. Per the Overview & Instructions tab, it is recommended that you copy & paste you quotes as 'values' into the Quoted Supplies tab. | ||
Quote Sheet | The data provided in this file identifies ~$660K in spend for the category of needles across several specialties. There is ~$1.1M in additional “needle” spend not identified in the historical data tab. Do I add the products to this file or is another needle solicitation forthcoming? Is there a way I could indicate product spend for the benefit of your team? | The Historical data provided are for reference purposes only and should be used as estimates. Offerors are not restricted to quoting these supplies. Offerors are welcome to submit all supplies that fall in the scope of the RFQ's category description (see Attachment B, Historical data tab) that they are authorized to sell by the OEM. Each item, should be entered as a new row on the Quoted Sheet tab in Attachment B. All quoted items require a Authorized Distributor Letter from the OEM, even if the Offeror is a subsidiary of the company or the company is a subsidiary of the Offeror's company | ||
Quote Sheet | Is the SAC asking for cross reference/cross match information? If so, where should that information be entered into the spreadsheet? If not, why is the SAC not requesting that information? | This question is not applicable to this Supply RFQ | ||
RFQ/Presolicitation | I am co-founder of a small business that introduced a new and unique tube feeding delivery system in Feb 2018. We have national distribution but have not done any business with the VA at this point. Can you tell me if tube feeding supplies will be included in solicitation #36C24C19Q0044? (IV & Irrigation) Attached is our capabilities statement for your reference. | Tube feeding supplies do not fall under the IV & Irrigation product category or any other current MSPV Supply RFQ Solicitation | ||
Quote Sheet | Where do we have to list the full suite of items application to each sub level? Please explain. | Provide all quoted supplies on the Quoted Supplies tab in Attachment B. All supplies can be listed together regardless of category sub level. | ||
RFQ/Presolicitation | We are working on several of the MSPV opportunities. Would you happen to have a sample Letter of Authorization template that we can send to our manufacturers? | Contact the OEM as they should have their own Authorized Distributor Letter format | ||
RFQ | We did not see a requirement for a “Letter of Supply” or “Letter of Commitment” in the solicitation to be submitted with the bid. Is a “Letter of Supply” or “Letter of Commitment” required? We would prefer a “Letter of Supply” or “Letter of Commitment” requirement in the solicitation to eliminate the vendors who do not have an agreement in place with the manufacturer and a supply to the Prime Vendors and the VA cannot be guaranteed. | Per the Section III.A.5 in the RFQ, a Authorized Distributor Letter must be submitted. | ||
