| ID | Document | Page Number | Section Title | Paragraph Number | Quoter's Questions | Government Response |
| DP.01 | RFQ | Section II MSPV Business Process B. | Section II. MSPV Business Process B. Pricing It states that the PVs will use the exact price [the BPA established price] plus a distribution fee agreed upon between the PV and VA – In the MSPV Prime Vendor solicitation (36C10G19R0022) Statement of Work, Section 1 Scope B.1.e. says the distribution fee will be capped at 5% - can we expect that cap will apply? | This question is not applicable to this Supply RFQ. | ||
| DP.02 | Quote Sheet | Based on the historical data, we found substantially different sales than was provided. We also found many products with historical sales that aren't on the requested item list. What is the VA's expectation of total number of products to be evaluated? Can the supplier provide its full product catalog appropriate for the category? If so, this will significantly increase the number of items to be evaluated compared to what was provided on the historical data list. | Historical sales data is provided for reference purposes and should not be considered an exact amount. All supplies quoted will be evaluated. Quotors are welcome to submit all supplies that fall in the scope of the RFQ's category description (see Attachment B, Historical data tab) that they are authorized to sell by the OEM, excluding supplies already covered under the AbilityOne Procurement List. Each item, should be entered as a new row on the Quoted Sheet tab in Attachment B. All quoted items require an letter of authorization from the OEM. |
| DP.03 | RFQ/Quote Sheet | Will clinical representatives be reviewing the products offered in this solicitation? | Yes, as stated in the SOW, "VA evaluation team to include clinical staff will review submitted items to assure they fit within the category description and determine if the items are needed to support clinical practices across the VA." | |||
| DP.04 | Quote Sheet | There are instances where "OEM Name" in the historical data does not match the "Supply Description" provided. For example OEM number 15-9604-8 has a "OEM Name" of Fresenius Medical Care, but has a Becton Dickenson "Supply Description". In this case BD is the actual OEM. (there are many other examples) How can the actual OEM or authorized supplier bid this product? | For supplies the quoter believes are incorrectly described in the historical data tab, the quoters are welcome to provide the supplies under the name and number they believe is correct. | |||
| DP.05 | RFQ/Quote Sheet | Some products cross multiple solicitation categories as defined by the VA, can we offer products under multiple solicitations? For example, IV sets are requested in the needles and syringe solicitation, but there is a separate solicitation for IV & Irrigation Supplies. Because the solicitation responses are not necessarily released at the same time, we want to ensure the VA has coverage for these items. | Yes items can be quoted under multiple solicitations for which the items falls in the scope of the RFQ's category description (see Attachment B, Historical data tab) that they are authorized to sell by the OEM. Note that a item will only receive a BPA for only one category. | |||
| DP.06 | RFQ | 11 | Section III. Work Requirements | C. | With the non-manufacturer blanket waiver and this additional Section III Work requirements language, C. Trade Agreement Act Requirements (applicable to Large Business), the use of "applicable to Large Business" opens a contracting loop hole for non-TAA approved items to be funneled through Small Business Suppliers. Is the government's intent to use Small Business Suppliers to purchase Non-TAA products with or without a product waiver? |
| If not, the “applicable to Large Business” should be removed and TAA requirements need to apply to "all" suppliers equally. | Please see the additional guidance in the Addendum to FAR 52.212-1, instructions to quoters where it defines what clauses/provisions are relevant with the tiers. | ||||||
| DP.07 | RFQ | What are the requirements for price changes? The solicitation does not provide direction? | Please see the Section II.C.3 Pricing Changes in the RFQ. | ||||
| DP.08 | RFQ | Section A8- states that "the government reserves the right to remove any supply from the MSPV product list upon 30 days' notice, resulting in cancelation of the BPA" is it the governments intent to cancel the entire BPA when one product is removed? | It is not the intent to cancel the entire BPA when one item is removed. | ||||
| DP.09 | RFQ | 11 | Section III. Work Requirements | C. | The solicitation has two service of protest clauses; which clause supersedes in this solicitation? FAR 52.233.2 or VAAR 852.233-71? | The VAAR is a supplement to the FAR. | |
| DP.10 | RFQ/Quote Sheet | I work for a small home dialysis company and we cater to the home PD patient population. Is this something that could be quoted on for just this category? I see in Historical data the products we provide now for VA’s and outside hospitals and there home programs. | Yes. | ||||
| DP.11 | RFQ | Can you explain difference between an Authorized Supplier and a Prime Vendor? | Supply RFQ will establish Supply BPAs to support the MSPV contract. | ||||
| DP.12 | RFQ | Can an Authorized Supplier submit an invoice to a VA or only the Prime Vendor? | No, invoices shall not be sent the VA Medical Centers. They should be sent to the MSPV. | ||||
| DP.13 | RFQ | Can an entity be both an Authorized Supplier or OEM and a Prime Vendor? | Yes. | ||||
| DP.14 | RFQ | Is this for Medical/Surgical Product shipped directly to VHA facilities only? | There will be no products shipped directly to VHA facilities, unless by exception as a dropshipment. | ||||
| DP.15 | Quote Sheet | On Attachment B in column S, if we don’t have a link to provide for the product literature, is it possible for us to provide the pdf version for it and add a comment in column S “No link to the website. Please see attached “name of pdf for product literature”. | Please provide a hyperlink for product literature. We will not be accepting paper copies or PDF of product literature. | ||||
| DP.16 | RFQ | The solicitation requires the supplier and prime vendor to enter into a “commercial agreement” within 30 days of award of a BPA. The solicitations further state VA is not a party to the commercial agreements. Once the prime vendor contracts are awarded, a supplier has no leverage in this negotiation. A supplier is at the mercy of the prime vendor as it relates to charges, penalties and fees, payment terms, insurance requirements and other terms and conditions a prime vendor chooses to impose. These concerns are not addressed within the solicitation. Will the VA put a maximum in place for awarded prime vendors in terms of fees? Also, how can any supplier offer VA a fair and reasonable price with no committed volume, unknown fees, charges and penalties? | 60 days. This has been corrected. It should read 60 days in the Pre-solicitation notice. The RFQ correctly states 60 days. | ||||
| DP.17 | RFQ | Can FSS Letters of Supply be used in leu of Authorized Distributor letter if signed within the last 90 days? | No, the RFQ specifically requests Authorized Distribution letters. | ||||
| DP.18 | RFQ | Will the VA allow substitutions? The solicitation does not address this question. Prime Vendors can potentially withhold orders from an SDVOSB supplier, tell VA a product is not available, offer VA a private branded label product that generates more profit to the prime vendor, and VA would believe the SDVOSB is at fault. This can occur unless the VA prohibits the delivery of private branded products as substitutes if they are note offered as part of the initial supplier solicitations and resulting BPAs. | This question is not applicable to this Supply RFQ. | ||||
| DP.19 | RFQ | Section E.152.212-1 | In section E.1 52.212-1 Instructions to Quotors – Commercial Items, there are three volumes required to be submitted. For Volume I – Technical, there are no instructions on what is to be included in this document. Since Product Literature is being addressed in Volume II – Price, should the Authorized Distributor Letter be in Volume I - Technical? | Please see language in 52.212-2 for Technical Requirements. |
Authorized Distribution Letter should be included in Volume III.
